Defesa: Curitiba, 01/04/2016 / Inclui referências : f. 96-102 / Resumo: O Código de Processo Civil de 2015 passou a prever a violação manifesta de norma jurídica como uma das hipóteses de cabimento de ação rescisória. De acordo com as mais modernas teorias da interpretação, a norma jurídica não está contida no texto legal, mas é dissociada dele. Norma jurídica, para essas teorias, é fruto da construção do direito pelo intérprete, de modo que a violação será sempre de uma das interpretações cabíveis a respeito de um mesmo enunciado legislativo. O Conceito de violação à norma jurídica, portanto, considerada a função atual das Cortes Supremas, diz respeito à violação de uma das interpretações possíveis a respeito de um mesmo enunciado legislativo. Norma jurídica. / Abstract: The Civil Procedure Code 2015 now provides a clear breach of the rule of law as one of the hypotheses of the appropriateness of rescission action. According to the most modern theories of interpretation, the rule of law is not contained in the legal text, but is separated from it. rule of law, for these theories, is the result of the construction of the right by the interpreter, so that the violation will always be one of the interpretations applicable on the same legislative statement. The concept of violation of the rule of law, therefore, considered the current role of the Supreme Courts, concerns the violation of one of the possible interpretations of the same legislative statement.
