taken here as an attitude or behavior of indignation, of non-submission, as a refusal
to what was established when it hinders human fulfillment, freedom, democracy,
that is, the values that are inherent to any social being. Taking dialectical and
historical materialism as a reference, it s our aim treating trangression as a culturalhistorical
category created in man s life, at specific dimensions and also thought by
them theoretically. In this sense, in our work, it has the form of disobedience,
emphasizing its historical character in the political and ethical fields. Although
disobedience cannot be considered revolutionary from marxist and revolutionary
socialist movement s points of view, it is today found in movements that resist the
capitalist order and fight against neoliberal globalization. While some of these
movements are known by their lack of previous organization and by generating
actions that might or not have a political continuity, others like the World Social
Forum, look for a material basis to build another possible world . These
movements show that besides resisting, it s necessary to create collective alternative
policies. In our analysis we consider that, professionally, we could take the
transgression to the institutional rules not as a political principle, but as a reaction to
some given situations where institutional rules or some institution members
behavior prevent the rights from happening. Here we find transgressions,
punishments and protections of some Social Work professionals who sought the
rights fulfillment in our society / O tema dessa tese é a transgressão. Queremos sugerir que ela seja
compreendida como uma atitude ou comportamento de indignação, de nãosubmissão,
de recusa ao instituído, quando ele impede a realização do humano, da
liberdade, da democracia, enfim, dos valores que afiram o ser social. Partindo do
referencial materialista histórico-dialético, é nosso objetivo tratar a transgressão
como categoria histórico-cultural, produzida na vida dos homens, em dimensões
específicas e também pensadas por eles teoricamente. Nesse sentido, em nosso
trabalho, ela assumiu a forma de desobediência, destacando a sua historicidade no
campo da política e da ética. Embora a desobediência não possa ser considerada
revolucionária, do ponto de vista do marxismo e dos movimentos socialistas
revolucionários, ela hoje está posta nos movimentos que resistem à ordem
capitalista e lutam contra a globalização neoliberal. Enquanto alguns desses
movimentos se caracterizam por sua falta de organização prévia e por
desencadearem ações que podem ter ou não continuidade política; outros, como o
Fórum Social Mundial, vem buscando uma base material para construir "um outro
mundo possível". Estes movimentos mostram que além de resistir, é preciso
construir coletivamente políticas alternativas. Em nossa análise, consideramos que,
profissionalmente, poderíamos pensar a transgressão das normas institucionais não
como princípio político, mas como uma ação diante de determinadas situações onde
a norma institucional ou a postura de determinados membros da instituição impeça
a realização dos direitos. Aqui constam as transgressões, as punições e as proteções
de alguns profissionais de Serviço Social que buscaram a realização de direitos em
nossa sociedade
