Previous issue date: 2018-07-30 / The purpose of this dissertation is to analyze whether the Federal Supreme Court (STF), in deciding whether or not the general repercussion exists, as a requirement for the admissibility of an extraordinary appeal, links its action to the requirement of rational reasoning or whether it decides based in discretionary criteria, with the resulting political implications. In order to meet this objective, were investigated the constitutionalism as a way of juridical conformation and expression of political power; the trajectory of the constitutional jurisdiction of the Supreme Court, from its inception until the creation of the institute of general repercussion and its reflections on the political role of the Court; and the aptitude of theories of legal argumentation for the realization of rational control of decisions, mainly from the criteria proposed by Neil MacCormick. The series of decisions handed down to define the themes of general repercussion in the period of one year was analyzed, so as to cover the second half of 2017 and the first half of 2018. Two cases considered paradigmatic for the purposes here were also analyzed pursued, consistent with Themes 350 and 597 of the general repercussion system. It is a research of a qualitative nature, of a bibliographic type, pure as to the use of the results and descriptive of the objectives.

Rational control. / Esta dissertação tem por objetivo geral analisar se o Supremo Tribunal Federal (STF), ao decidir sobre a existência ou inexistência de repercussão geral, como requisito de admissibilidade do recurso extraordinário, tem vinculado sua atuação à exigência de fundamentação racional ou se tem decidido com base em critérios discricionários, com as implicações políticas daí decorrentes. Para o atendimento desse objetivo, foram investigados o constitucionalismo como um modo de conformação jurídica e expressão do poder político; a trajetória da jurisdição constitucional do STF, desde sua criação até o surgimento do instituto da repercussão geral e seus reflexos para o papel político da Corte; a aptidão das teorias da argumentação jurídica para a realização de controle racional de decisões, principalmente a partir dos critérios propostos por Neil MacCormick. Bem assim, foi analisada a série de decisões proferidas para definir os temas de repercussão geral no período de um ano, de modo a abranger o segundo semestre de 2017 e o primeiro semestre de 2018. Foram analisados também dois casos considerados paradigmáticos para os fins aqui perseguidos, consistentes nos Temas 350 e 597 da sistemática de repercussão geral. Trata-se de pesquisa de natureza qualitativa, de tipo bibliográfica, pura quanto à utilização dos resultados e descritiva quanto aos objetivos.
