Previous issue date: 2008-03-10 / The Law, as every reality, possesses its production or manifestation sources. Thus, the history
acclaimed the legal norms, the doctrine, the mores, the general principles of law and the
jurisprudence as sources or forms of expression of the Law. It s relevant to know, though, in
what measure the Judiciary, through its judges, can create the Law; if would or not be a
violation of the separation of powers principle. The creative role carried out by the Judiciary
has been gaining relevance as the Constitutional Jurisdiction takes space in the life of the
post-modern State. If centuries ago it was discussed the possibility of this form of creation of
the Law, today the concern is tied to the limits of this creative power. There are several
examples from the Supremo Tribunal Federal of manifestly Law-making decisions, in spite of
the current idea that it has only a role of negative legislator . Therefore, the Supremo
Tribunal Federal has been pointing out that the judicial creation of the Law is a task, also, of
the judges. / O Direito, como toda realidade, possui suas fontes de produção ou de manifestação. Assim,
consagraram-se na história a lei, a doutrina, os costumes, os princípios gerais de direito e a
jurisprudência como fontes ou formas de expressão do Direito. Importante saber, todavia, em
que medida o Poder Judiciário, através de seus juízes, pode criar Direito; se haveria ou não
quebra do princípio da separação de poderes. O papel criador de Direito desempenhado pelo
Poder Judiciário vem ganhando importância na medida em que a Jurisdição Constitucional
toma espaço na vida do Estado pós-moderno. Se séculos atrás se discutia sobre a
possibilidade desta forma de criação do Direito, hoje a preocupação se volta para os limites do
poder criador. Vários são os exemplos de decisões do Supremo Tribunal Federal que
manifestamente criam Direito, apesar da idéia corrente de que ele exerce apenas um papel de
legislador negativo . Portanto, tem o Supremo Tribunal Federal indicado que a criação
judicial do Direito é tarefa, também, dos juízes.
