Previous issue date: 2012-08-31 / This paper explores the possibility of supremacy of human rights against the State Sovereignty in the context of Globalization. Therefore, it is a study of the affirmation of human rights, the article provides a historical overview of the development of these rights to its internationalization, without neglecting to issues relating to their origin: either it comes to natural law, characterized by universality, or concerns Cultural Rights, qualified by relativity. In the next moment, given the impossibility and impracticality of isolation from the international community and the consequent need for setting standards of living, have signed up relations between states, noting aspects that reverberate in the conditions of their sovereignty (internal and international). In the context of globalization, care is the dichotomy between the economic hegemony of hegemony and social, as well as demonstrating the factors of economic growth, measured by the production of wealth and economic development, earned by human development. In such a context, it is shown the Global System of Protection of Human Rights as well as the prospect of global tranconstitucionalismo for ripening. It finally the text dichotomy established between Human Rights and State Sovereignty, resolutória perspective of supremacy when, when reaffirming Human Rights to establish an emancipatory politics against the social reality, and when the need arises active participation (local and global) institutions in decision-making, is faced with the need to preserve the rule of law (must-be) in ralação the political and economic power.
Keywords: Human Rights. State Sovereignty. Globalization. / O presente trabalho analisa a possibilidade de supremacia dos Direitos Humanos frente à Soberania dos Estados no contexto da Globalização. Para tanto, faz-se um estudo acerca da afirmação dos Direitos Humanos, perpassando por um apanhado histórico do desenvolvimento de referidos direitos até a sua internacionalização, sem descurar-se das questões atinentes à sua origem: ou se trata de Direito Natural, caracterizado pela universalidade, ou versa sobre Direitos Culturais, qualificado pela relatividade. Em momento subsequente, diante da impossibilidade e inviabilidade de isolamento da comunidade internacional e da consequente necessidade de estabelecimento de normas de convivência, apresentam-se as relações firmadas entre os Estados, atentando para os aspectos que reverberam nas condições de suas respectivas soberanias (interna e internacional). No contexto da globalização, cuida-se da dicotomia existente entre a hegemonia econômica e da hegemonia social, além de demonstrar os fatores de crescimento econômico, mensurados pela produção de riquezas, e de desenvolvimento econômico, auferido pelo desenvolvimento humano. Em tal contexto, é demonstrado o Sistema Global de Proteção aos Direitos Humanos, bem como a perspectiva do tranconstitucionalismo para o amadurecimento global. Conta, por fim, o texto com dicotomia estabelecida entre os Direitos Humanos e a Soberania Estatal, numa perspectiva resolutória de supremacia, quando, ao se reafirmar os Direitos Humanos, ao se estabelecer uma política emancipatória frente à realidade social, e ao se verificar a necessidade de participação ativa (local e global) das instituições na tomada de decisões, se depara com a necessidade de preservação da primazia do direito (dever-ser) em ralação ao poder político-econômico.
