266277.pdf: 463510 bytes, checksum: 4fb223aa5da44a5f53d1940ee55573e0 (MD5) / O escopo do presente trabalho é analisar a teologia de João Calvino, percebendo os elementos de direito, política e moral que lhe influenciam, bem como os fundamentos filosóficos de seu método, a fim de perscrutar o pensamento do reformador no que tange às questões internacionais, especificamente às idéias jurídicas aplicadas no cenário internacional, como, sobretudo, a noção de guerra justa por ele desenvolvida e legitimidade de tal prática. Empreende-se uma abordagem de cunho geral sobre o humanismo jurídico, destacando suas raízes renascentistas e seus principais expoentes, observando as modificações provocadas por tal paradigma no âmbito da reflexão e do ensino do direito. Da mesma forma, ocupa-se em perceber a inserção da figura de João Calvino e do pensamento calviniano no panorama do humanismo jurídico, evidenciando sua ancestralidade epistemológica e as ferramentas por ele extraídas do arcabouço intelectual humanista para sua atividade teológica. Não obstante, expõe e analisa a reflexão político-jurídica inserta na teologia de Calvino, sobretudo em suas Instituições da Religião Cristã, dando ênfase ao próprio texto do reformador, afim de observar uma eventual ancestralidade do reformador na conformação do pensamento jurídico internacional secularizado da primeira modernidade. Nesse sentido, constata-se que Calvino foi sobremaneira influenciado pelo humanismo do Norte da Europa, tanto em sua formação jurídica quanto em sua formação literária, as quais lhe possibilitaram adquirir a erudição necessária para empreender seu trabalho intelectual no contexto da Reforma Protestante, o qual no que tange ao elemento político-jurídico, afirma-se no sentido de que o itinerário eminentemente temporário do Estado não afastaria sua justificação cósmica nem sua pertinência teológica, da mesma forma que o foco espiritual da Igreja realçaria e muito sua importância política. Sua teoria político-jurídica baseada nas próprias Escrituras, ainda que empreendida de forma desdramatizadora, acabou por fornecer as bases iniciais da redefinição do pensamento jurídico a que se propuseram os juristas da primeira modernidade, que racionaliza o direito, mas estabelece sua fonte, seu arrimo, nos pressupostos morais. Justamente a fundação da ordem política na moral bíblica. Ao dizer que o Estado é encarregado de salvaguardar a moral política, bem como, principalmente, extrair tal função do próprio texto bíblico, segundo o qual o Estado seria uma instituição criada e sancionada por Deus para manter a ordem pública até a consumação dos tempos, Calvino cria um programa para o Estado. Esta teoria de Calvino possibilita, legitima teologicamente, a reflexão jurídico-política a respeito das funções do Estado e do Direito.
The scope of this study is to analyze the theology of John Calvin, noticing the points of law, political and moral influence it, and the philosophical foundations of his method in order to understand reformer thinking in terms of international issues, specifically applied to legal ideas in the international arena, and, above all, the notion of righteous war that he developed and legitimacy of this practice. Undertaking an approach of general nature on legal humanism, with its Renaissance roots and its main exponents, noting the changes caused by this paradigm in the context of reflection and teaching of law. Similarly, is working on understanding the integration of the figure of John Calvin and his thought on the legal landscape of humanity, showing his ancestry and epistemological tools for him from the intellectual framework for its humanistic theological activity. However, exposes and analyzes the political and legal reflection on the theology of Calvin inserted, especially in its institutions of Christian Religion, emphasizing the actual text of the reform in order to observe any ancestry in shaping the reform of the secular thinking of the first international legal modernity. Accordingly, it appears that Calvino was particularly influenced by humanism in northern Europe, both in their legal education and in his literary training, which enabled him to acquire the knowledge necessary to undertake their work in the context of intellectual Protestant Reformation, which regarding the political-legal element, it is stated that the route of the temporary eminently not lose its justification and its relevance cosmic theological, as well as the spiritual focus of the church emphasized and its very important policy.
