267427.pdf: 1389157 bytes, checksum: 1d563a2dce58b9b09089861ebb75eb08 (MD5) / O objetivo do trabalho é verificar se diante do princípio da dignidade da pessoa humana, instituído como fundamento do Estado Democrático de Direito, de acordo com a Constituição da República Federativa do Brasil de 1988, é garantido à criança e ao adolescente a convivência com aquele que não detém a guarda, quando ocorre a cisão da união dos pais, de forma que se possibilite a promoção do vínculo afetivo entre pais e filhos. Após breve reflexão sobre o princípio da dignidade da pessoa humana buscou-se analisar o direito dos filhos à convivência familiar, vislumbrando o princípio do melhor interesse de crianças e adolescentes, apresentando o afeto como direito e dever jurídico, além de descrever que aos filhos é garantido o direito a manter contato com o genitor não guardião. Posteriormente, foi necessário analisar o instituto da família, de forma a compreender sua evolução e transformação no decorrer do tempo. Também se promoveu o estudo da autoridade e do poder familiar, no sentido de demonstrar que para o desenvolvimento pleno e sadio, crianças e adolescentes necessitam de limites, que são decorrentes do exercício da relação parental. Por fim, após apontar base teórica para ação judicial de guarda e regulamentação de visitas, promoveu-se análise de jurisprudências, como forma de observar a fundamentação lançada pelos tribunais pátrios e se, efetivamente, os julgadores embasam suas decisões no princípio da dignidade da pessoa humana e no melhor interesse de crianças e adolescentes. Ainda se procurou formular proposta para tornar concreto o direito dos filhos à convivência com os pais, independentemente do vínculo existente entre os genitores. / The aim of this study is to detect vhether, in face of the principle of the human being dignity, set up as a foundation of the Democratic Rule of Law, according to the Constituion of the Federal Republic of Brazil of 1988, the child and the adolescent have the companionship with those who withhold their custody granted, when the rupture of their parents occur, so that the affective bon among parents and children may be promoted. After this brief consideration on the human being dignity principle, there is also an attempt to take the right of the children to the familiar companionship into account, by conjecturing on the principle of the best interests both of children and adolescents, and presenting fondness as a forensic right and duty, besides
stating that the children are granted the right to keep in touch with their non-custodial parent. Subsequently, it was also necessary to analyse the family institution in order to understand its evolution and transformation as time went by. The study of authority and of the familiar power was also considered so as to show that children and adolescents must have limits set that derive from the parental relationships, for a full and heal thy development. And finally, after indicating the theoretical basis for the custody forensic action and visit regulations, the study promoted a jurisprudence analysis as a way to examine the background that was emitted by the native courts of justice to confer if the judgers effectively set their decisions on the principle of the human being dignity and on the best interest both of the children and of the adolescents. There was also the formulation of a final proposition to make the right of the companionship between children and parents concrete, in spite of the existing bond between the parents.
