No âmbito educacional desenvolveu-se e foi amplamente estudada no campo da aprendizagem, entretanto, nas últimas décadas seu campo é sensivelmente ampliado. Com a expansão do sistema de educação superior no Brasil, o Estado assume a postura de avaliador, com vistas a garantir a qualidade dos serviços educacionais, desenvolvendo-se, especialmente nas décadas de 1990 e 2000, a avaliação institucional, que abrange a avaliação das instituições em sentido estrito, os cursos ofertados e os estudantes. Este trabalho faz uma análise ampla da avaliação, focando a avaliação institucional, para em seu seio ocupar-se especificamente dos aspectos jurídicos implicados na avaliação dos cursos de graduação. Analisados os atos normativos utilizados pelo Ministério da Educação e pela autarquia responsável pela avaliação (INEP), constatou-se a violação do princípio da legalidade, uma vez que são estabelecidas obrigações aos avaliados mediante atos normativos (portarias, resoluções, normas técnicas etc.), ou seja, os atos que deveriam apenas tornar operável, exequível, os comandos legais, acabam por invadir a esfera do legislativo, inovando originariamente no universo jurídico, afrontando a ordem jurídica. Por decorrência da ausência de previsão legal que ampare as exigências dos instrumentos de avaliação de curso, o processo avaliativo como um todo acaba por ser maculado e, consequentemente, prejudica as IES, educandos e sociedade, já que os processos de regulação e supervisão da educação superior tem por base os resultados das avaliações. / The evaluation has always integrated the processes and social relations. In education was developed and extensively studied in the field of learning, however, in recent decades is significantly expanded its field. With the expansion of higher education system in Brazil, the State assumes the posture evaluator, in order to ensure the quality of educational services, developing, especially in the decades of 1990 and 2000, institutional evaluation, which includes the evaluation of institutions in the strict sense, the courses offered and students. This work is a comprehensive analysis of the assessment, focusing on the institutional assessment, to her bosom in mind specifically the legal issues involved in the evaluation of undergraduate courses. Analyzed the normative acts used by the Ministry of Education and the governmental agency responsible for evaluation (INEP), there was a violation of the principle of legality, since they are evaluated by the obligations established normative acts (decrees, resolutions, technical standards etc.). , ie, acts that would only make operable, practicable, the legal commands, eventually invading the sphere of legislation, originally innovating in legal universe, violating the law. In consequence of the absence of legal provision to sustain the demands of ongoing assessment tools, the evaluation process as a whole turns out to be tainted and therefore affect the undermines the institutions, students and society, since the processes of regulation and supervision of education above is based on the results of evaluations.
