Previous issue date: 2005 / O presente estudo tem como objetivo demonstrar a constitucionalidade da política de ação afirmativa para o ingresso de afro-brasileiros nas universidades, a partir da leitura constitucional do princípio da igualdade, dos tratados internacionais de direitos humanos e de uma série de outros dispositivos constitucionais e infraconstitucionais, os quais não só amparam como também incentivam a adoção da medida. Tem em vista, a dívida histórica do Estado brasileiro com os negros e da necessidade do urgente engajamento de toda a sociedade na equalização do problema das relações raciais no Brasil. _____________________________________________________________________________________ ABSTRACT / The present study it has as objective to demonstrate the constitutionality of the politics of affirmative action for the ingression of afro-Brazilians in the universities, from the constitutional reading of the principle of the equality, of the international treated ones to human rights and a series of other devices constitutional and infraconstitutional, which not only support as also they stimulate the adoption of the measure. It has in sight, the historical debt of the Brazilian State with the blacks and of the necessity of the urgent enrollment of all the society in the equalization of the problem of the racial relations in Brazil.
