Previous issue date: 2016-01-08 / Coordena??o de Aperfei?oamento de Pessoal de N?vel Superior - CAPES / This research establishes an interlocution with philosophers of relevance in the context of contemporary theories of justice in both its procedural and deontological feature as Rawls, as in his reconstructive aspect of Critical Theory as Habermas and Honneth. This thesis aims reactualize the Kantian conception of justice and publicity from a social-normative reconstruction. It intends to go beyond the metaphysical limits pointing especially to the need for a weak social moral, social epistemology and a public opinion understood as a balance between the formal and the empirical. The first chapter argues the primacy of a public model of justice as an alternative to metaphysical and constructivist models. The Kantian State will be rethought beyond the liberal limits of protection of individual rights. In Rechtslehre will discuss the social role of the rule of law on assistance to the poor and excluded. The second chapter proposes an intersubjective moral redimensioning beyond monological limits, highlighting among others aspects the social preconditions of autonomy. The third chapter reconstructs the Kantian publicity from the public opinion as an instrument of articulation between the procedural and the empirical. The social reconstruction of publicity will be proposed from a ?ffentlichkeit der Vernunft in epistemological and aesthetic levels. The publicity of reason is an affront to the context of repression and restriction of freedom of expression diagnosed by Kant himself in Was ist Aufkl?rung. In this thesis the public opinion constitutes a political capacity of opposition to the public injustices in civil, international and cosmopolitan levels. Kant's public sphere shall be reviewed beyond the limits of bourgeois ideology punctuated by Habermas. As a final topic, the thesis discusses the normative implications of the dichotomy between active and passive citizenship. / Esta pesquisa estabelece uma interlocu??o com fil?sofos de relev?ncia no ?mbito das teorias contempor?neas da justi?a tanto no seu vi?s procedimental e deontol?gico como Rawls, quanto no seu vi?s reconstrutivo da Teoria Cr?tica como Habermas e Honneth. Esta tese pretende reatualizar a concep??o de justi?a e publicidade em Kant a partir de uma reconstru??o socionormativa. Ela tenciona ir al?m dos limites metaf?sicos apontando, sobretudo, para a necessidade de uma moral social mitigada, de uma epistemologia social e de uma opini?o p?blica entendida como um ponto de equil?brio entre o formal e o emp?rico. O primeiro cap?tulo defende a primazia de um modelo p?blico de justi?a como uma alternativa aos modelos metaf?sico e construtivista. O Estado kantiano ser? repensado para al?m dos limites liberais da prote??o dos direitos individuais. Na Rechtslehre ser? discutido o papel social do Estado de direito na assist?ncia aos mais pobres e exclu?dos. O segundo cap?tulo prop?e um redimensionamento intersubjetivo da moral para al?m dos limites monol?gicos, destacando dentre outros aspectos as pr?-condi??es sociais da autonomia. O terceiro cap?tulo reconstr?i a publicidade kantiana a partir da opini?o p?blica como sendo um instrumento de articula??o entre o procedimental e o emp?rico. A reconstru??o social da publicidade ser? proposta a partir de uma ?ffentlichkeit der Vernunft em n?veis epistemol?gico e est?tico. A publicidade da raz?o constitui uma afronta ao contexto de repress?o e cerceamento da liberdade de express?o diagnosticado pelo pr?prio Kant em Was ist Aufkl?rung. Nesta tese, a opini?o p?blica constitui uma capacidade pol?tica de oposi??o ?s injusti?as p?blicas em n?veis civil, internacional e cosmopolita. Portanto, a esfera p?blica kantiana ser? reavaliada para al?m dos limites da ideologia burguesa pontuados por Habermas. Como t?pico final, a tese discute as implica??es normativas da dicotomia entre cidadania ativa e passiva.
