Previous issue date: 23 / Nenhuma / A presente dissertação busca identificar, em julgamentos que versam sobre o assunto ‘meio ambiente’, a existência de uma pré-compreensão inautêntica dos operadores do Direito. Implementada a Jurisdição Constitucional e colocada à disposição diversos instrumentos jurídicos de tutela dos direitos fundamentais, advindos com o Estado Democrático de Direito, com a Constituição Brasileira e com os elementos do constitucionalismo contemporâneo, possui o Poder Judiciário um novo papel, o de efetivar a substancialidade da Constituição. Entretanto, se o intérprete não compreende o compromisso constitucional, nem mesmo a questão do equilíbrio ecológico, colabora na sua inefetividade e, por conseqüência, no aumento da degradação ambiental. Tal problema consegue ser constatado mediante o estudo do próprio processo de compreensão.
