Previous issue date: 2015 / The study aims to investigate the policies of access to primary education, for people with disabilities, in the city of Fortaleza. Knowing that the right to education is constitutionally guaranteed to all persons, without any discrimination, and that there is in Brazil a robust regulatory apparatus that ensures it, is necessary to analyze its effectiveness, especially with regard to disabled people, who in most often they have serious physical limitations that prevent them from getting around freely. Conducting research about the city of Fortaleza is justified by the absence of studies that address this theme involving the said state entity. Investigates the current Municipal town Plan of Education, analyzing its guidelines, goals, actions and current public policies available for children and adolescents with disabilities in the region, corresponding school-age to primary education, seeking to relate them with the education levels of this population group. It appears that there is a significant number of children and adolescents in these conditions outside schools. There is little information available about existing public policies that meet, but the available data demonstrates the inadequacy and ineffectiveness of these policies on the entry and maintenance of this population parcel in school environments. The educational reality experienced in the city is a clear affront to the fundamental rights of these people. The methodology is descriptive-explanatory, it is bibliographic and documentary regarding data collection. / O trabalho se propõe a investigar as políticas públicas de acesso ao ensino fundamental para as pessoas com deficiência física no município de Fortaleza. Sabendo-se que o direito à educação é constitucionalmente assegurado a todas as pessoas, sem qualquer distinção, e que há no Brasil um robusto aparato normativo que o assegura, é preciso analisar a sua efetividade, ainda mais no tocante aos deficientes físicos, que na maioria das vezes possuem graves limitações corporais que os impedem de se locomover livremente. A realização da pesquisa no âmbito do município de Fortaleza se justifica pela ausência de trabalhos que abordem essa temática envolvendo o referido ente estatal. Investiga-se o atual Plano Municipal de Educação da cidade, analisando-se suas diretrizes, metas, ações e as atuais políticas públicas disponíveis para as crianças e adolescentes com deficiência física da região, em idade escolar correspondente ao ensino fundamental, buscando relacioná-las com os índices de escolaridade dessa faixa populacional. Constata-se que há um número expressivo de crianças e adolescentes nessas condições fora das escolas. Poucas são as informações disponíveis sobre as políticas públicas existentes que as atendam, porém, os dados acessíveis demonstram a insuficiência e a inefetividade dessas políticas quanto ao ingresso e manutenção dessa parcela populacional nos ambientes escolares. A realidade educacional vivenciada no município representa uma nítida afronta aos direitos fundamentais dessas pessoas. A metodologia é descritivo-explicativa, sendo bibliográfica e documental quanto à coleta de dados.
