[pt] Os conflitos urbanos contemporâneos interpelam os campos do Direito
Constitucional e do Direito Urbanístico, no que tange aos seus desdobramentos no
âmbito da tutela do direito à cidade. A presente dissertação realiza reflexões sobre
a dimensão da participação popular no processo de construção, implantação e
execução dos planos diretores, adotando como caso-referência o município de
Paraty, privilegiando a análise do anteprojeto de Lei Complementar do Plano
Diretor de Paraty divulgado pela prefeitura municipal em novembro de 2010.
Levando em consideração que a participação popular no planejamento urbano
municipal, como signo da democracia e da cidadania, pressupõe um ambiente
dotado de transparência, publicidade e abertura às demandas populares, o estudo
constatou que a participação popular, ao garantir a legitimidade da norma
urbanística, viabiliza a eficácia do plano diretor, na perspectiva da realização das
funções sociais da cidade. / [en] The contemporary urban conflicts demand the constitutional and urban law
fields, in what concern to its developments on tutelage s range of the right to the
city. The actual dissertation reflects about the dimension of people s involvement
on the construction process, implementation and execution of master plans, taking
as reference-case Paraty municipality, privileging the analysis of the
Complementary Law of Paraty s Master Plan draft published by city hall in
November 2010. Considering that people s involvement in municipal urban
planning, as a sign of democracy and citizenship, presumes an environment
endowed with transparency, advertising and openness to people s demands, the
study verified that people s involvement, assuring the rightness of urban principle,
enables the effectiveness of the master plan, in perspective of achieving the social
functions of the city.
