[pt] A presente dissertação tem como objetivo analisar o papel
do Ministério Público Brasileiro na concretização dos
direitos sociais por parte da Administração Pública. Para
a melhor abordagem do tema, nos dois primeiros capítulos
são estudados o Ministério Público e a Administração
Pública, tal como delineados na Constituição. A seguir,
passa-se à análise dos direitos sociais e sua efetivação.
Defende-se a concepção de que os direitos sociais devem ser
considerados direitos fundamentais e de aplicação
imediata. A falta de recursos orçamentários não pode
justificar a ausência de políticas públicas garantidoras
destes direitos sociais. Uma sociedade justa só será
alcançada quando estes direitos estiverem garantidos. Por
isso, cabe ao Ministério Público atuar pela concretização
destes direitos, pois essa é a missão institucional do
Parquet descrita no art. 129, II, da CF, qual seja, a de
zelar para que os Poderes Públicos efetivamente respeitem
os direitos assegurados na Constituição. / [en] This dissertation purposes analysing Public Ministry role
for the social rights implementation by Public
Administration. For a better understanding, in the first
two chapters Public Ministry and Public Administration are
studied as established in the Constitution. Following,
social rights and their implementation are analysed. It is
defended the conception that social rights must be
considered human rights with an immediate application. The
budget resources shortage can not justify public politics
absence. Public politics should guarantee these social
rights. A fair society will be only reached when these
rights are guaranteed. Public Ministry must act for these
rights implementation because this is its institutional
mission described in Constitution art. 129, II, which is,
looking after Public Agents effectively respect
Constitutional assured rights.
