Nesta dissertação, Plataformas Logísticas são apresentadas como infraestruturas para integração de transportes e geração de negócios. O interesse de diversos atores (operadores logísticos, indústrias, autoridades locais e regionais) requer um complexo planejamento de atividades associadas a aspectos geográficos, operacionais, gerenciais, administrativos e econômicos. Baseando-se em experiências internacionais, destacadamente a experiência alemã com as Güterverkehrszentren, este trabalho busca sistematizar as etapas necessárias para se avaliar a viabilidade de projetos que, muitas vezes, requerem participação pública e privada. Tal interação entre entes públicos e privados deixa o processo ainda mais complexo, dados os intrínsecos conflitos de interesse ao se planejar e projetar uma Plataforma Logística. Ao se buscar o estado da arte sobre o assunto, um procedimento de análise de projetos é sugerido e sua aplicação é feita associada ao caso da Plataforma Logística de Goiás, para a qual se identificaram possíveis fatores que levaram a não conclusão do empreendimento, apesar das medidas de governança adotadas pelo Estado. / In this dissertation, logistics platforms are presented as infrastructures for the transport integration and business generation. The interest of several stakeholders (third-party logistics, industries, local and regional authorities) requires a complex plan of activities associated with geographic, operational, managerial, administrative and economic features. Based on international experiences, especially the German experience with Güterverkehrszentren, this dissertation seeks to systematize the steps needed to assess the feasibility of projects that often require public and private participation. Such interaction between public and private entities makes the process even more complex, given the inherent conflicts of interest when planning and designing a logistics platform. Considering the state of the art on the subject, a design analysis procedure is proposed and its application is in the form of case study of the Logistics Platform of Goiás, for which have been identified possible factors leading to non-completion of the project despite measures taken by the State for governance.

Our study is focused on how the public sector can collaborate with the private sector on a certain issue. The public sector wanted to create a project to increase bicycling in the municipality of Kalmar. Our problem was to develop a sustainable way to collaborate between the two parties. We managed to present a suggestion on how the public sector with communication could improve their Public Relations with the private sector and therefore letting the parties benefit from their differences, thus making it possible to release synergy.Using semi-structured interviews and a workshop, we could clarify the values and attitudes of the parties to bring forth the core values to develop a shared vision. Where the identified differences were found, we used a dialog strategy based on intercultural conflict management as a communication tool. The result was exemplified with things that were expressed in the interviews, and we presented a framework on how to think when choosing the right type of collaboration model for the specified activity.

It is been an international trend to introduce the private participation ideas to improve the public service quality. Based on the most concerned issues, such as quality and cost, in the construction and operations phases, the private sector plays an important part in major transportation projects. It is important that the government and private sectors works together to promote construction of infrastructure.
It is common to implement the BOT approach to the public major construction project. The BOT approach,which needs the cooperation of both government and private sector, is often implemented in the major construction projects. Unfortunately, due to lots of abuses and corruption happened in the process recently, both of them have to face not only challenges by public but also integrity in every government employee. We find out this is very controversial for the Kaohsiung Mass Rapid Transit project, the most media criticized. That is the reason we the KMRT project is chosen as an example for the study on the private participation in the major government projects. It is necessary to establish a mechanism to control the government and the private sector to balance both benefits.
The study will focus on the supervision and management of the administration of government to the private sectors, participating in the major transportation projects. The aim of investigation is to establish the optimal supervision and control operation model based on the maximum participation of private sector and the interest of government. The supervision and control operation model and the project progress in BOT management must according to the rules:standard operation procedures, a robust financial audit system, responsible supervision and management mechanism, and a good partnership of both parties. Therefore, the mechanism has an important function, which reflects effectiveness, efficiency, profit, prevent from abuses, response, and prospects.
The study is based on documentation, information research, case study, and suggestions from:
Laws and regulations: avoidance of old law and review and modification of new law.
System: establishment of audit management meeting and implementation of contract fulfillment management mechanism.
Practice: evaluation of planning and the feasibility study, establishment of fair and open selection process, the evaluation of the implementation ability of the private sector, the fair risk sharing in concessionary contract and the enhancement of the management operation.

A Study of Private Participation in Public Construction System ¡ÐETC Judgment as Example.Guo, Ming-li 09 September 2009 (has links)
In recent years, it has been increasingly become a global trend that public construction projects are carried out through private sector investment, and business management concepts are introduced for the improvement of public service quality. Due to various factors such as quality and revenue, private sectors increasingly play an active and important role in various phases of major public construction works, from building to operation, and government has the need to incorporate the strength of private sectors to facilitate and promote the construction of major national infrastructures. Among various models of private sectors¡¦ participation in public constructions, build-operate-transfer (BOT) is the most commonly adopted business model. However, in the process of promoting major BOT cases, the government had suffers some drawbacks of abuses of power and privilege, and thereby receiving much criticism from general public, and it also has serious negative impact on the integrity of the government. The case of abuses in the government that drew the most criticisms and raised controversies was the Electronic Toll Collection (ETC) case, where as it transpired had repeatedly drawn much attention from the media and the society at large. Therefore, the ETC case is chosen as the subject of the current study.
This study is focused on the related rulings of the ETC case by Taipei High Administrative Court and the Supreme Administrative Court, and the related issues of the court¡¦s rulings on the ETC case are investigated and discussed, to clarify the nature and characteristics of BOT and related legal issues. Thus, the related rulings of the ETC case can be used as a lesson learned for future participation of private sectors in public constructions.
This study was carried out by literature search, case studies, and collection of public opinions, and as a result the following recommendations were made:
1. Legislative Perspectives:
(1) Incorporate international experiences and amend existing legislations to gear to international conventions.
(2) Establish rules of judgments for administrative sectors to avoid any abuse or impediment of administrative power.
2. Institutional Perspectives:
(1) Expand and encourage participations from all parties, including people¡¦s representatives and third parties.
(2) Realize managerial and operational mechanisms.
(3) Emphasize consumer¡¦s rights and public interests.
(4) Carry out feasibility assessment and advance planning with great care.
(5) Establish fair and open evaluation process and operation procedure.
(6)Assign reasonable risk-sharing responsibilities for special permission contracts.

A public-private partnership (PPP) is defined as a joint effort by government and the private sector for the management, operation, and funding of a venture or service.
Increasingly, government has looked to the private sector for financial support and the streamlining of processes as concerns about the public debt have risen and priorities for spending have narrowed. The users and “customers” of a public good often have a stake in the way it is managed, especially in the case of parkland, which has the ability to
dramatically affect the property values surrounding it, either positively or negatively.
Therefore a PPP may have many purposes: as a fundraising mechanism, as an advocate for stakeholders, and as a promoter for programming for the attainment of educational
and recreational goals. Ultimately, the role of the PPP is to be a liaison, knitting together the resources bestowed upon the public by the government entity with those of the less regulated private world.
This study investigates both the challenges of forming a partnership that protects the public interest as well as the factors that are critical to forming a “successful”
partnership. An examination of what led to the rise of public/private partnerships
historically is included as well as the business models and mission statements of
contemporary lead organizations at both the national and local level. In order to gain an
in-depth understanding of the complexities of these partnerships, I individually
interviewed professionals from both the public and private sides who have had careers in
public land acquisition and management. Their viewpoints provide enriching details and
reveal several common themes. Subjects were asked about the benefits of creating PPPs
and how those benefits have been distributed, and what factors have contributed to
successful PPPs. Furthermore, they reflected on tensions that have arisen within these
partnerships. And finally they were asked about their overarching philosophies regarding
government’s responsibility to its constituency versus the interests of the private sector.
The report reveals that there is no set formula to be followed step by step in the
creation and subsequent evolution of a public/private partnership, though certain
principles emerge as essential components of a strong and effective organization. These
are: having a clear understanding of the partnership’s misson and goals, being flexible
and getting creative, making friends with everyone, and courting the local population
who live around the parkland. Because there are several of these partnerships being
formed to support parks in San Antonio, Texas at the time of this report, I placed
emphasis on local statistics and anecdotes while compiling the opinions of area experts who have a long history of activism in this region. It is my intent that the findings
reported herein provide some guidance for the future leadership of these local
organizations in the context of local issues. / text

This is done with interviews and a case study of the social procurement Mitt Gröna Kvarter and its labor effort Boendebyggarna. The theoretical framework used in the thesis consists of public-private partnership and corporate social responsibility. It tries to answer the following questions: What does this social procurement mean by the concept of public-private partnership? What does this social procurement mean for the participants involved? How can social procurement be seen as a further development of public-private partnership? The thesis uses the theory development around the concepts of public-private partnership and corporate social responsibility and shows that social procurement does indeed have similarities to public-private partnership and could very well be a further development of it.
