Feminisation a period of labour market changes in South Africa

The post-1994 role of women in the South African economy is changing with respect to issues such as education and employment opportunities. In the past, men tended to hold the primary or ‘good’ jobs, which have the greatest stability and promotional potential, whilst women tended to hold the secondary or ‘poor’ jobs, which have lower stability and lower wages (Kelly, 1991). Women’s labour force participation has risen significantly over the years since 1994, but more in depth research is needed in order to determine where and how changes could be implemented to ensure that any past gender inequalities fall away with minimal impact on the economy as a whole. As such, certain dynamics within the labour market need to be considered. Firstly, pre-market types of discrimination, including issues such as gender discrimination during the acquisition of human capital through educational attainment should be considered. In most countries, women enter the labour market with severe disadvantage in that they have been subject to discrimination in schooling opportunities (Standing, Sender & Weeks, 1996). Secondly, the feminisation of the labour force is dealt with, as well as what factors affect the female labour force participation decision (i.e. the decision of whether to participate in the labour market or not). iv Thirdly, employment discrimination is investigated, including the concept of ‘occupational crowding’. An analysis of trends in the occupational structure of economically active women in South Africa shows the typical shift out of agriculture into industrial related jobs (Verhoef, 1996). Lastly, wage discrimination is analysed, in order to determine if women get lower rates of pay for ‘equal work’. The objectives of this study are aimed at determining whether there have been any positive changes with respect to women in any of these focal areas mentioned above. There are studies that have established gender differentials when it comes to formal education, and these place women at the disadvantaged end (Bankole & Eboiyehi, 2000). If one considers the educational measures, namely, the levels of literacy, years of education, and overall educational attainment, employed by this country to determine whether there are in fact observed differences between the education of boys and girls, the following was found: Males rate higher with respect to two of these measures, namely literacy and educational attainment, and are thus able to exhibit lower levels of poverty than females in South Africa. Men exhibit slightly higher literacy rates than women of the same age (Statistics South Africa, 2002), and men also rate higher than women when it comes to university education. With regards to primary and secondary school attainment v since 1994, the gender gap does appear to have disappeared. The ‘neoclassical model of labour-leisure choice’, as applied in this study, shows that as the wage rate increases, women have an incentive to reduce the time they allocate to the household sector and are more likely to enter the labour market. In South Africa, however, the increase in the female participation rate has merely translated into a rise in unemployment and has not been associated with an increase in the demand for female labour. This implies that South African women are being ‘pushed’ into the labour market due to economic need, rather than being ‘pulled’ into the labour market in order to earn a higher wage. Women are gradually becoming better represented at all levels across a wide range of occupations. Women, however, continue to face greater prospects of unemployment and to earn less than their male counterparts even when they do find employment. These lower female wages are partly as a result of ‘occupational crowding’, whereby women are over-represented in certain occupations resulting in excess labour supply which drives down the wage rate. It has been determined that the problem of occupational crowding is a real and immediate one and has been found to depress wages within certain female specific occupations.

The status of employees employed by temporary employment services

The traditional employer-employee relationship came under an increased threat the past two decades with employers finding the option of utilising the services of Labour Brokers more attractive. Various reasons existed for this tendency amongst employers to opt for the use of Labour Brokers, some of these reasons being valid but mostly some reasons being born out of fear for the unknown labour law duties and obligations that were proposed to be placed on employers post 1994. In the absence of an action plan between the role players in the labour fraternity pathing the way traditional employer-employee relationships could be salvage, employers resorted to the appointment of Labour Brokers and Government on their part retaliated by considering either the total ban of Labour Brokers or the regulation of the profession to such an extent that same became largely unattractive and problematic. The non-addressing of problems and fears faced with by employers post 1994 resulted in an opportunity waisted to narrow the gap between employers and employees with the fight over work force power being the more important factor taken into consideration. This treatise will explore the options that faced the roll players post 1994 in the labour market, the reason for choices made and the effect same has had since on the labour market. The problematic amendments made to Section 198 of the Labour Relations Act in an attempt to iron out the wrinkles poor choices made by the stake holders over the regulations of Labour Brokers, will be discussed. The ripple effect the amendments to Section 198 of the Labour Relations Act had on other pieces of South African legislation will be considered and the uncertainty and confusion it has created discussed. Specific attention needs to be drawn to the intention of the legislature as to which party, the Labour Broker or employer, will be responsible for the ramifications of the wrong doings of an employee. Also, which party will be responsible to the employee to fulfil its labour rights as granted in the Constitution of South Africa. Unleashing reaction to the regulations of Temporary Employment Services does not seem to be a problem, the problem arises where the regulations proposed did not unleashed the desired reaction and roll players finding themselves frustrated and with having no alternative as to turn the Courts to solve the largely self-inflicted conundrum. The courts are left with the task of clarifying the legislature’s true intension in amending section 198 of the Labour Relations Act, which impact the writer with all due respect do not think the legislature even appreciated when the amendments were drafted. Currently, there is dividing views on the future of Labour Brokers per se in South Africa and the interpretation concerning Section 198 of the Labour Relations Act, as amended. The focus of this treatise is to highlight the different interpretations given to these amendments this far and highlight that if it is in fact the wish of stake holders in the Labour fraternity that Labour Brokers should continue to exist, clarification is needed by our Constitution Court on certain vital issues and as discussed in this treatise.

The disputed “equitable treatment” in political party broadcasts: an analysis of the SABC coverage of the 2014 South African general elections

The aim of this study was to establish whether the South African Broadcasting Corporation (SABC) performed according to its mandate in ensuring a fair broadcast coverage of all political parties that participated in the 2014 national general election. The study was undertaken as a result of the complaints by political parties who accused the SABC of bias during the election. The study focused on two SABC radio stations, namely SAFM and UKHOZI FM. In executing the research, particular attention was paid to the coverage of political party manifestos, town hall election debates and radio interviews. The study was written utilising the theoretical paradigm of Social Responsibility Theory, as this is largely deemed the most ethical guide in testing South African journalism. The research was conducted in accordance with the Independent Complaints Authority of South Africa (ICASA) regulations that govern broadcast media during elections. The second part of the analysis deconstructed the SABC’s media coverage of the 2014 election through Media Monitoring Africa – a non-profit organisation that monitors and reports on media coverage of elections, whilst simultaneously taking ICASA stipulated guidelines into account. The MMA and ICASA equipped the study with reports which were compiled after an intense monitoring of SABC’s coverage of the 2014 election. Through the analysis of political parties’ accessibility to the election broadcast programmes on SABC platforms, the study concluded that although there were errors, the SABC treated all parties fairly during the 2014 general elections. The study also found that poor corporate governance at the SABC did not impact directly on the public broadcaster’s ability to deliver fair election broadcasting. By conforming to the social responsibility role that calls for high professional conduct, fairness and objectivity as expected in the public broadcaster, this study found that the SABC was committed to a fair coverage of the 2014 election.

The income tax implications of becoming a republic resident

The aim of this treatise is to identify the income tax implications of the persons becoming South African tax residents. It will provide a clear understanding of the income tax implications for natural and non-natural persons wishing to take up residence in South Africa. The definition of “resident” in section 1 of the Income Tax Act, 1962, has a direct impact on the tax implications bearing down on any foreigner planning to reside within the Republic of South Africa, especially in relation to the prevention of the double taxation. The following issues or areas have been identified, these issues are summarised below. The persons receiving foreign pensions may be exempt from normal tax under section 10 (1)(gC) and in terms of the tax treaty, they may also escape taxation in their former country of residence. The treatise will look at various treaties that exist between the South Africa and other countries and to discuss the taxing rights. There is a case of double non-taxation and good reason for immigrants to come and avoid tax in South Africa. It is suggested that the legislation and the double tax agreements should be amended. A person who becomes a resident will receive a step-up in base cost for assets other than South African immovable property and assets of a permanent establishment in South Africa under paragraph 12(2)(a) of the Eighth Schedule. The main purpose of the legislation is to ensure that these assets are correctly valued, determining the base cost, when the person becomes a tax resident. The valuation of these assets carries with it the problem of securing sufficient evidence long after the valuation. Most of the tax planning for such for immigrants revolves around estate duty and donations tax. The person would donate his assets to an offshore discretionary trust before taking up residence in South Africa. The advantage is that donations tax will be avoided because there are exemptions in terms of section 56, for assets acquired before becoming a resident. The income and capital gains vested in nonbeneficiary can be taxed in the hands of the donor in terms of section 7 and paragraph 72 of the Eighth Schedule. The donor should be aware of the antiavoidance measures; section 7(2) to 7(8) and paragraph 72 of the Eighth Schedule will deem a different person other than the person who is entitled to the income to be taxable on that person. The income and gains received by the beneficiary of a trust can be taxable in the hands of the donor. The assets owned by the trust will be sheltered from South African estate duty. The foreign discretionary trust, as a non-resident, will not be liable for tax in South Africa. The beneficiaries of such a trust will be liable for income tax from the trust distributions, once they have acquired a vested right to the income. The liability of income tax is deferred to the year when the trustees decide to make distributions. The distribution by the trustees in a subsequent year creates a delay or postponement for taxes which should be paid by the beneficiaries. The trustees are most likely to make distributions in a tax year when the tax rates are low. There are tax opportunities for the immigrants who intend to take up residence. The tax resident might be subject to withholding taxes on foreign income from the previous country of residence, but might be subject to Double Tax Agreement between South Africa and other countries.

The effect of commercialisation, privatisation and liberalisation on universal access in South Africa

From the 1990s onwards, significant developments have occurred in the international telecommunications sector that have affected the South African telecommunications industry and peoples’ access to the network. Rapid developments in Information and Communication Technologies and the reorganisation of telecommunications operators through commercialisation, privatisation and the effects of market liberalisation have resulted in monopoly operators moving away from their public service mandates. Globalisation and adherence to World Trade Organisation rules are causing operators to rebalance their tariffs closer to cost. Long-distance rates are decreasing while the cost of local calls is increasing. High-end users of telecommunications services are benefiting while low-end, largely residential users are being priced off the network. The end result is a negative effect on universal access to telecommunications services. This study examines the extent to which commercialisation, privatisation and liberalization are affecting the provision of telecommunications services and the government’s goal of achieving universal access in South Africa. Qualitative research methods were utilised to establish that the state owned operator, Telkom, has transformed itself from a public service operator to one that is fully commercialised and prepared for an Initial Public Offering and competition. Telkom no longer attempts to ensure that its tariffs are affordable for all people. However, positive developments presented themselves in the form of an increasingly competent regulator, a reorganised and dedicated Universal Service Agency, and the popularity of cellular telephony. The primary discovery of this study is that the liberalisation of the South African telecommunications sector cannot be assumed to have a negative effect on the provision of service. This study finds that liberalisation will most likely benefit the country through the role out of new infrastructure, the provision of new services and ultimately the reduction of those services themselves. In order for universal access to be achieved in this country the study recommends that the resources of the Independent Communications Authority of South Africa be enhanced to enable the regulator oversee the industry effectively. Secondly, the Universal Service Agency must provide clear definitions of universal access and universal service as well as manage the Universal Service Fund with greater efficiency. Lastly, the two bodies mentioned above must ensure that services are affordable for all people of this country.

A taxonomic revision of the genus Bergeranthus Schwantes (Mesembryanthemaceae) in South Africa

The genus Bergeranthus Schwantes comprises ten species ofleaf-succulent Mesembryanthemaceae that are centred in the Albany centre of endemism and restricted to the Eastern Cape Province of South Africa. No taxonomic revision of the genus, or key to the species of Bergeranthus, has been undertaken since its description by Schwantes in 1926. The species concepts are mostly based on single, or at best severaL cultivated plants and are notoriously narrow and in some cases incorrect. Louisa Bolus described five of the ten currently recognized species of Bergeranthus (as well as B. cookii, B.firmus, B. glenensis, B.jamesii, and B. longisepalus) from cultivated plants that she had never seen in the wild. This narrow species concept, compounded by morphological change that occurs in response to environmental factors, presents an assemblage of ill-defmed and poorly known taxa that have been prioritised for taxonomic attention by various authors. Furthermore, the generic delimitation of Bergeranthus with the closely related genera Rhombophyllum and Hereroa is unclear and requires attention before generic revisions are attempted for all three genera. The taxonomic revision presented here is based on a study of 210 wild populations of Bergeranthus as well as cultivated representatives of these and 135 herbarium specimens. A phenetic analysis based on 36 vegetative characters was initially used to delimit taxa. Thereafter sixty-three macro- and micro-morphological characters were critically assessed for the purposes of species delimitation, amendment of existing species descriptions and the description of two new species. Macromorphological characters examined included rootstock, leaf(36), inflorescence, floral (nine), fruit (nine), seed germination and seedling characters. Micro-morphological characters examined included leaf anatomy, leaf epidermal wax layer, anther shape and point of adherence, pollen and seed characters. This revision reduces two species into synonymy and two new species, B. albomarginatus and B. nanus, are described. Existing species descriptions are improved and all species are illustrated. A key to species is provided. The reproductive biology, ecology, phytogeography and distribution data of the genus are discussed towards an improved understanding of the genus. The generic delimitation of Bergeranthus and its closest relatives, Rhombophyllum and Hereroa, are discussed based on an examination of 25 morphological characters and two phenological characters and a provisional key to genera is provided. A phylogenetic analysis of all 10 species of Bergeranthus, both species of Rhombophyllum and a single species of Hereroa (H. granulata) was undertaken to support species and generic delimitation.

Detached harmonies : a study in/on developing social processes of environmental education in eastern southern Africa

Long-term social processes are explored to examine the shaping of environmental education in eastern southern Africa. The study opens with early Nguni social figurations when 'to conserve was to hunt.' It then examines colonial conservation on the frontiers of imperial expansion and developing struggles for and against wildlife preservation. These processes shaped an inversion of earlier harmonies as declining wildlife was protected in island sanctuaries of natural wilderness and 'to conserve was not to hunt.' Inside protected areas, conservation management struggles shaped new harmonies of interdependence in nature, enabling better steering choices in developing conservation science institutions. Here more reality congruent knowledge also revealed escalating risk which was linked to a lack of awareness amongst communities of 'others' outside. Within continuing conservation struggles, education in, about and for the environment emerged as new institutional processes of social control. The study examines wilderness experience, interpretation, extension, conservancies and the development of an environmental education field centre, a teacher education programme and a school curriculum. Naming and clarifying the emergent education game for reshaping the awareness and behaviour of others is examined within a developing figuration of environmental education specialists. Particular attention is given to academic and statutory processes shaping environmental education as a field of objective principles and rational processes within modernist continuities and discontinuities into the 1990's. An environmental education field centre, an earth-love curriculum and research on reserve neighbour interaction are examined as political sociologies developing within a declining power gradient and wide ranging socio-political change. Into the present, a final window on a local case of water pollution examines shifting relational dynamics revealing how environment and development education models of process may have little resonance amidst long-term socio-historical struggles and shifting controls over surroundings, others and self. A concluding review suggests that grounded critical processes engaging somewhat blind control over surroundings may yet reshape self-control and social control amongst others. The trajectories of these clarifying struggles must remain open-ended as sedimented myth and memory is reshaped within ongoing processes of escalating risk and global intermeshing.

A study of the South African national anthem as a tool for division or unification

South Africa is a nation that was born from a struggle that can be said to have turned racial divisions and discrimination into a diversity of heritages. Thus, contemporary South Africa has become a country recreated in such a way that its people are able to embrace diversity freely. This research study aimed to provide insights into South Africa’s diversity in culture and linguistics that were moulded into a single song, the South African National Anthem. The research study aimed to determine the selected sample’s (Nelson Mandela Metropolitan University Staff and Students) responses to the representation of the South African National Anthem based on two specific performances. The research study aimed to determine how the two online videos affected the perceptions of NMMU Staff and Students of the South African National Anthem and South Africa as a brand. The research study aimed to determine how the two performances of the South African National Anthem under study were received by Staff and Students at NMMU. The study also aimed to highlight the similarities and differences in the sample’s responses, based on this reception. This text analysis and interpretation was conducted to gain insight into themes that were labelled based on the questionnaire responses, thus affecting perceptions of the sample and determining whether the South African National Anthem was perceived as a tool for division or unification.

The teaching practice component of initial teacher education: a social justice approach

Research asserts that learner performance in South African schools is in a state of crisis. While many more learners’ post-1994 in South Africa have physical access to education, very few have epistemological access. The quality of the education learners receive is polarised along socio economic lines. This crisis has its roots in the legacy of colonialism and apartheid, and as such, there is a need to transform the education system to ensure equal opportunity for all learners, and ultimately economic growth and security for the country. One of the explanations offered for the crisis in learner performance is the poor teacher education system. However, there is a paucity of research in teacher education generally in South Africa, and specifically in relation to pre-service teachers. Furthermore, little attention has been given to how initial teacher education could contribute to the promotion of a social justice agenda with the intention of transforming the South African schooling system. This research seeks to understand how the expectations, scaffolding and assessment of preservice teachers’ teaching practices can be utilised to promote social justice during the Teaching Practice (TP) component of initial teacher education. In answering the research question, I analyse data and literature to identify a set of key valued functionings of quality praxis that preservice teachers ought to be provided the capability to realise, at the level of achieved functioning. This is a qualitative case study located in the interpretive paradigm. The case under study is: quality teaching practices of pre-service teachers. This case is bound by context (initial teacher education in South Africa) and setting (the pre-service teacher in the classroom). Two South African Higher Education Institutions (HEIs) were selected through purposive sampling and their respective Teaching Practice (TP) documentation was analysed. Focus group interviews were conducted with five lecturers involved in TP at one of the HEIs. The theoretical framework of the study used to guide the analysis of the data was underpinned by a social justice perspective on quality education. Given that a social justice perspective does not have analytic tools, I view quality pre-service teachers’ teaching practices as praxis and utilise the capability approach as a mechanism for identification and description of valued functionings and capabilities that contribute to quality praxis. There are four significant findings in my research. Firstly, there is consistency with regards to the valued functionings and capabilities across the TP documentation of the two participating HEIs. In other words, the conceptions of a capable pre-service teacher are similar. Secondly, if social justice goals are to be realised, greater clarity of the valued functionings needs to be evident in the TP documentation. Thirdly, the valued functionings can be categorised into those that are foundational and those that promote a social justice agenda. Finally, in promoting a social justice agenda, there are functionings that ought to be valued by the HEIs that are seemingly not currently valued.

The profitability of commercial state-owned entities

The importance of State-owned entities (SOEs) in a developing State has been argued for centuries. SOEs are perceived as the tool that the State can successfully use to implement its developmental agenda. In the Republic of South Africa, SOEs have been used to ensure universal access to electricity, water and logistical infrastructure to support industrial development, as well as basic service delivery. These entities have been expected to fund these initiatives from their own funds, which alleviated the need for commercial SOEs (also known as State-owned companies) to be profitable without continuous financial injections from the RSA government. Generally, commercial SOEs have been performing poorly financially. This research study aims to determine whether political influence might affect the profitability of these commercial SOEs. The poor financial performance plaguing the commercial SOEs hinders their ability to effectively contribute as a collective to the developmental agenda of the State, as espoused in the current strategic plan of the RSA in the form of the National Development Plan (NDP). Due to the poor financial performance and subsequent diversion of financial resources from other national priorities for their bail-out, commercial SOEs have been considered a liability rather than an asset to the RSA. To satisfy the primary and associated research objectives, qualitative primary and secondary research data have been collected. The primary data have been collected by using the semi-structured interview from the CFOs of commercial SOEs from various government departments – given their proximity to the financial performance and the drivers of this performance in commercial SOEs. CFOs are also part of the commercial SOEs senior-executive management of these entities. The general opinion of the participants and the literature review of the research study is that, indeed, political influence has had an adverse effect on the profitability of commercial SOEs, among others, as a consequence of the positioning of SOEs within the governance system of the RSA, the impact of the recruitment process for senior executives and the implications of an unfunded mandate. It is clear that in the RSA, commercial SOEs, and SOEs in general, will continue to play a pivotal role in the implementation of the developmental agendas of the State, as expressed in the NDP. With the RSA government expecting commercial SOEs to fund these activities from their own funds, it is critical that the State should be an enabler rather than a hindrance for commercial SOEs‟ profitability.
