Řešení sporů v rámci WTO / Dispute resolution within the framework of WTO

This thesis, entitled WTO Dispute Settlement Mechanism focuses on the issue of direct effect of WTO law with respect to the possibility of private persons to claim damages in case they are affected by the retaliatory measures adopted by the injured WTO-member in response to the violation of WTO rules perpetrated by their government. In connection with the aforesaid, the thesis compares the approach of the United States of America with the one of the European Union. Given the fact that the jurisprudence of the European Court of Justice regarding the issue of direct effect of WTO law has undergone substantial development, the thesis also analyses the jurisprudence and its outcomes. This thesis is divided into two parts. The first one introduces the dispute settlement procedure before the Dispute settlement body under the Understanding on Rules and Procedures Governing the Settlement of Disputes. The thesis focuses on particular stages of the procedure before the DSB and introduces the particular actors of the dispute settlement mechanism. The first part consists of three chapters, first of which deals with particular actors, second defining particular stages of the procedure and third focusing on the stage of implementation of DSB decisions. This diploma thesis deals with the regulation of the activities of banks, which has already been relatively extensive but as a result of the most recent financial crisis, it has been extended by new rules and requirements. The aim of this thesis is to clarify the essence of the basic obligations of the banks related to the entry into the banking sector and to working in the sector, and last but not least to leaving the sector and to the termination of the banking activity. All these obligations are then amended by new requirements for crisis management and the insurance of deposits, which are also based on prudential and precautionary principles and aim at maintaining the security and stability of the banking sector. This thesis is divided into six individual chapters but they are connected with each other. The initial chapter defines the key concept of this thesis, namely the concept of the bank from the legal perspective because the legal definition of the bank is slightly different than the economic definition. This thesis as well enumerates the forms of legal regulation that can be used in this area of law, whether it concerns directly applicable European legislation, primary or delegated legislation or non-binding statements and recommendations of regulators. The aim of this paper is to analyze the role of cultural and historical perceptions of parties to a conflict by prism of the protracted conflict model (PC). The theoretical part initially focuses on explication of the protracted conflict concept theory and argues for its presence in the IR theory. Subsequently, the clarification of the national narratives theory as a form of cultural and historical perceptions drawn from nationalism theories is included. Further, the analysis of national narratives in the PC model is conducted and its findings are presented. The last part contains characteristics of the Israeli-Palestinian conflict as a PC and the application of theoretical findings and conclusions in the conflict.

This thesis consists of two parts: text and programming part. It is divided into seven chapters. Its main goal is to compare heuristics for dynamic traveling salesman problem in a few perspectives. The text part of this thesis theoretically describes heuristic methods and in the programming part are wake up to life via VBA in MS Excel. The results of computational experiments on these heuristic methods are presented in the last chapter. In the first part, the traveling salesman problem and its solution are being described. Characteristic of the modification in a form of dynamic traveling salesman problem follow. Next chapter presents the programming solution chosen heuristics. The final chapter presents experimental results obtain with programmed heuristics.

The final thesis follows the effort of the European Union to transfer responsibility for issues in the banking sector from taxpayers to its shareholders and creditors. It adopts many new tools and measures. The first part of the thesis is devoted to the banking union project, which unifies the supervision and procedures for solving the crisis at the European level. Emphasis is placed on the newly adopted Single resolution mechanism. Since the adopted legislation does not apply exclusively to the Eurozone countries the second part of the thesis analyses the implementation of the BRRD into Czech law, and the related amendments concerning the Czech banking sector. The aim of the thesis is to analyse the crisis resolving procedure, which is specified in the third chapter on the example of a fictitious bank. The example monitors tools and measures that can be used in various life stages of a bank. It is mainly based on the rules laid down in BRRD and the Czech legislation ZOPRK.

Based on a multicriterial analysis, a variant proposal of BI solution for a specifi?c small company is created at the end of the thesis.
