國際法上庇護權之研究

本論文共計一冊，約七萬字，內釮六章十六節。 第一章導論，說明庇護之重要性，並概述現行行使庇護權之方法及狀況。 第二章說明何謂庇護，再探討從神權時代至人權時代，各種庇護制度的起源及歷史發 展。 第三章討論領域庇護，首先說明領域庇護的基礎究何在？其次說明領域庇護的對象， 最後則探討領域庇護之考慮因素。 第四章領域外庇護，本章除討論領域外庇護的基礎外，也探討各國對於領域外庇護之 實踐。 第五章討論難民問題，首先澄清「難民」之涵義與迫害觀念，其次回顧難民問題，並 說明國際難民服務機構之設立情形，最後介紹法定難民之認定方式及各國考慮之因素 。 第六章結論，回顧庇護問題，並對未來作一展望。
