我國監察院糾正權之研究

本論文約六萬字共分五章。第一章導論：說明糾正制度的歷史沿革，中山先生有關監 察權的主張及糾正權之性質。第二章糾正權的運用程序：首述糾正案從提議迄成立之 流程，再分述糾正權行使的主體與客體，糾正權行使的原因，糾正權行使範圍與時機 ，及糾正案的變態。第三章十餘年來糾正案內容之分：乃自民國六十三年至七十四年 糾正案之總觀，及糾正案原因、對象、提案人之分析。第四章糾正權問題的探討：就 糾正權與行政訴願權，糾正權與立法院質詢權，糾正的對象，糾正的效力，予以深入 剖析。第五章結論：分析糾正權功能的應然面與實然面，及如何加強糾正權之功能。
