Previous issue date: 2011-08-01 / This work follows the research line of the "Fortalecimento de Políticas Públicas", from
FAPEG - Research Foundation of the State of Goiás, as well as the Post Graduation
Program in Law, from the Catholic University of Goiás. Its focus is to analyze the
Project of Complementary Law nº 135/2000, which aims the disciplinary measures
for the expropriation for social interest, for Land Reform issues, demonstrating its
pertinence in the current stage of the National Plan for the Land Reform
implementation. The competence of the direct management entities, in other words,
the Union (União), States, Federal District and Municipalities; and municipal to
legislate, declare and promote expropriation, in this case, were created to specify the
division of tasks, and consequently, to understand how the Land Reform is
conducted in Brazil. In order to present the reader to the shades of the national Land
Reform, some themes were created, together with some relevant institutes, starting
with the Brazilian land structure, then going through the concept of the Land Reform
and Political Agricultural, establishing, between this last two, its obvious relation.
Some official data, found in the IBGE - Brazilian Institute for Geography and Statistics
- web site, along with numbers that were used in important paper works presented in
seminars about Land Reform, were also highlighted, so as to allow a more critic
review of the facts related to rural expropriation, aiming land reform. Another goal
was to try to discover if the Project of Complementary Law nº 135/2000, as is was
presented in the Chamber of Deputies, meets constitutional purposes, established by
the 1988 Federal Constitution or, in other words, if the legislative proposal was
analyzed in formal and material constitutional focus, opportunity in which the studies
had its start in constitutional concepts, and ended up in the Project of
Complementary Law itself. The legal consequences arising from the term of the
Project of Complementary Law, in analysis, were also outlined, considering possible
constitutional impacts, so, some tacit derogation may occur, and the present study
tried to unveil them. In the end, in prognosis, a paradigm was established in the
National Land Reform, if the Project of Complementary Law nº 135/2000 is approved,
would they be good for the society, or not. / Este trabalho vincula-se à linha de pesquisa
da FAPEG Fundação de Amparo à Pesquisa do Estado de Goiás , bem como ao
Programa de Pós-Graduação em Direito, Relações Internacionais e
Desenvolvimento da Pontifícia Universidade Católica de Goiás. Tem por objeto
analisar o Projeto de Lei Complementar n.º 135/2000, que visa disciplinar questões
específicas de desapropriação por interesse social, para fins de reforma agrária,
desvendando sua pertinência no atual estágio de implantação do Plano Nacional de
Reforma Agrária. As competências dos entes da administração direta, ou seja, da
União, Estados, Distrito Federal e Municípios; e autárquica, para legislar, declarar e
promover a desapropriação em tela, foram levantadas para compreender a divisão
de tarefas e, consequentemente, se entender como é feita a reforma agrária no
Brasil. No intuito de apresentar ao leitor as nuances da reforma agrária nacional,
foram elucubrados alguns temas e institutos jurídicos relevantes, a começar pela
estrutura fundiária brasileira, passando pelo conceito de reforma agrária e de política
agrícola, estabelecendo entre estes dois últimos a correlação que lhes é inerente.
Alguns dados estatísticos oficiais, disponibilizados pelo sítio digital do IBGE
Instituto Brasileiro de Geografia e Estatística , bem como números que foram objeto
de trabalhos em fóruns sobre reforma agrária, também foram destacados, a fim de
se permitir uma visão crítica dos acontecimentos relacionados à desapropriação
rural, com o fito de reforma agrária. Procurou-se aferir se o Projeto de Lei
Complementar n.º 135/2000, da forma como proposto e levando em consideração
sua tramitação na Câmara dos Deputados, atende aos postulados constitucionais
estabelecidos pela Constituição Federal 1988 ou, noutras palavras, analisou-se a
proposta legislativa à luz da constitucionalidade formal e material, oportunidade em
que os estudos partiram do conceito de constitucionalidade, até adentrar nos
meandros específicos do projeto de lei complementar em voga. As consequências
jurídicas advindas da vigência da lei oriunda da proposta legislativa em análise,
também foram delineadas, haja vista que possíveis impactos infraconstitucionais
deverão ser considerados, de forma que derrogações tácitas poderão ocorrer, e o
presente estudo procurou desvendá-las, antevendo-as. Por fim, em sede de
prognóstico, estabeleceu-se um paradigma da reforma agrária nacional, caso seja
aprovado o Projeto de Lei Complementar n.º 135/2000, visando prever se seus
impactos seriam, ou não, benéficos para a sociedade.

Problematika domácího násilí v souvislosti s působením zákona č. 135/2006 / The Issue of Domestic Violence in connection with the act (number ) 135/2006STŘELCOVÁ, Hana January 2009 (has links)
Domestic violence has been an urgent problem also in the Czech Republic. The necessity to solve its complexity upon level of the state, not only through non governmental, non-profit-making institutions, is especially expressed by adopting Act No.135/2006 Collection of Laws, by which some acts in scope of domestic violence protection are amended. This Act allows the Police of the Czech Republic to banish an offender committing domestic violence from mutual residence for a period of 10 days and the Act has established a new social service the so called ``Intervention Centre{\crq}q, i.e. a specialized facility that provides help with people who are endangered by domestic violence. The objective was to find out the level of public awareness, knowledge of the Intervention Centres in the Moravia-Silesian and Pilsen Regions. Within the first year of that Act operating, there were the least banished offenders v. s. number of inhabitants, just in the Pilsen Region and there were the most ones in the Moravia-Silesian Region. The theoretical work part describes forms of violence in the family, historical relationship of violent actions with women, possibilities how to prevent them or advised help measures to victims of domestic violence. Further, it is focussed on a legislative solution of that problem area in the Czech Republic and some of European countries or the USA as well. The practical work part involves results of a quantity research that was aimed to discovery of public awareness of the Intervention Centres. The research was performed by method of questioning in a way of a questionnaire. The research was focussed on consciousness of general public relating to domestic violence, whether the research respondents have ever met that phenomenon or what is their opinion on information effectiveness of the problem area. The research demonstrated low awareness of the Intervention Centres of inhabitants in both regions. However, most respondents know what domestic violence is. Nearly one third of interviewees have got certain experience with domestic violence. Majority of respondents consider the information on the Intervention Centres and domestic violence as generally useful. This work may be used to increase public awareness of the Intervention Centres or on the other side to provide the Intervention Centres employees with general public{\crq}s reflection as to availability and activity of the Intervention Centres.

Studies have been conducted to highlight the anti-inflammatory and immunosuppressive properties of cannabinoids and also their potentials for cartilage repair and regeneration. Various wound healing techniques can be used to investigate the mechanisms of chondrocyte repair in monolayers or three dimensional tissue constructs. The effect of different concentrations of the synthetic cannabinoids WIN55, 212-2 (WIN-2), URB602 and HU-308 with and without their antagonists on the wound healing of chondrocyte monolayers was investigated using a simple scratch assay model. The three cannabinoids were found to increase wound healing of chondrocyte monolayers, but at different rates. WIN55, 212-2 at a concentration of 1μM had the highest effect of increasing both migration and proliferation of chondrocytes cultured in a chondrogenic media, which increased the rate of wound closure. It was also found that treating the cells with 2μM of any of the cannabinoids lead to a decrease in cell proliferation and the rate of wound closure. These findings were further investigated, by studying the effect of WIN-2 on nitric oxide (NO) and matrix metalloproteinase-2 (MMP-2) expressed by wounded chondrocyte monolayers. Moreover, expression of collagen type-I, collagen type-II, fibronectin and S100 proteins were detected using immunofluorescence and verified quantitatively using ELISA based techniques, following treatment with 1μM and 2μM of WIN-2, for both 2D monolayers and 3D sheets. Treating chondrocytes with 1μM of WIN-2 significantly increased collagen type-II, fibronectin and S100, and significantly reduced collagen type-I compared to control groups in monolayers and chondrocyte cell sheets. On the other hand, both concentrations of WIN-2 significantly reduced the expression of the inflammation markers NO, and MMP-2, in a dose dependent manner. These findings highlight the potential use of the synthetic cannabinoid for improving the rate of wound closure as well as acting as an antiinflammatory agent, which could be used to enhance tissue engineering protocols aimed at cartilage repair.

O presente estudo tem por objeto central a análise da competência disciplinar do Conselho Nacional de Justiça. Trata-se de competência concorrente ou de competência subsidiária, relativamente à atribuições das Corregedorias dos Tribunais locais? Mais do que apresentar a resposta em si competência de natureza concorrente , o trabalho busca apresentar as justificativas para esta resposta. Esta tarefa é realizada a partir da contextualização da criação do Conselho, da apresentação de sua estrutura e de seu funcionamento, bem como do entendimento jurisprudencial do Supremo Tribunal Federal acerca da constitucionalidade de sua instituição pela Emenda Constitucional n. 45, de 2004. A competência disciplinar do Conselho Nacional de Justiça busca alcançar um equilíbrio entre os importantes valores da independência e da responsabilização judicial, apresentando estreita relação com a noção de accountability e com o princípio da publicidade. Sua dimensão processual é estudada por meio da abordagem da Resolução n. 135, de 2011, que disciplina o procedimento administrativo disciplinar, da Medida Cautelar na Ação Direta de Inconstitucionalidade n. 4.638, e de decisões do próprio Conselho e do Supremo Tribunal Federal. / Il presente studio ha come scopo centrale l\'analisi della competenza disciplinare del Conselho Nacional de Justiça [Consiglio Nazionale di Giustizia organo di controllo amministrativo e finanziario del sistema giudiziario brasiliano e di supervisione sull\'operato dei magistrati]. Le attribuzioni delle Corregedorias [Ispettorati giudiziari] delle Corti locali raffigurano un esempio di competenza concorrente ovvero residuale rispetto alle attribuzioni del Conselho Nacional de Justiça? Oltre a fornire la risposta al quesito formulato, competenza di tipo concorrente, il lavoro cerca di esporre le giustificazioni a tale risposta. L\'obiettivo è conseguito tracciando le ragioni che hanno portato alla costituzione del proprio Conselho Nacional de Justiça, illustrandone la struttura e il suo funzionamento, nonché la comprensione giurisprudenziale del Supremo Tribunal Federal [Corte Suprema Federale] riguardo alla costituzionalità della sua istituzione attraverso l\'emendamento costituzionale n. 45 del 2004. In the last decade measuring a company´s performance exclusively financially has been heavily criticised. Consequently, different performance measurement systems including the Balanced Scorecard, the Performance Pyramid, and the Quantum Performance were developed, discussed and implemented in industry. Besides the financial perspective, additional perspectives (e.g. customers, processes, employess, etc) have been considered. Organisational performance is assumed to be a multidimensional phenomenon today. Hence one important aspect of the discussion of several concepts of performance measurement has been the selection of the right measures. This paper focused the problemof measuring multidimensional organisational performance. Based on the multitask agency theory we enhanced the approaches of Holmstrom/milgrom and Austin by introducing extrinsic and intrinsic motivation, cost of measurement and uncertainty of measurement into the model.

This thesis tries to define &lsquo / landscape archaeology&rsquo / as a concept / it describes and analyzes the key landscape archaeology types, dynamics, and approaches. Then, it aims to define the landscape archaeological characteristics of the Troad Region in this context.
The archaeological landscape character of the Troad Region shapes the importance of the area, not only for the Anatolian culture, but also for the European cultures and for archaeology discipline. Hence, the necessity of conservation works for the area with the horizon of this concept gains importance. Thesis defines what had been done for the area in terms of conservation and reviews the Long Term Development Plan prepared for the Troia Historical National Park Area. With a critical view of what has been done and what has not been done, it tries to emphasize the importance of grasping the landscape archaeological character of the area in conservation and management plan works. It gives a general guideline to ensure a sustainable future for the historic, cultural, social, economic and environmental nature and qualities of these kinds of areas.
