Uncontested proceedings in cases involving minors The aim of this thesis is to provide a comprehensive overview of non-contentious proceedings in cases involving minors with a defined focus on the adoption proceedings and court custody of minors. The purpose of my thesis is to analyse the area of international child abduction and the proceedings of that. Chapter One describes the contentious and non- contentious proceedings and distinction between that with an overview of non-contentious proceedings in cases involving minors and their distribution. For the purpose of this text, non- contentious proceedings in cases involving minors are divided into two subdivisions, namely the adoption proceedings and court custody of minors. Chapter Two concentrates on court custody of minors. Chapter Three focuses on the international child abduction, which is selected from court custody of minors. New substantive law was the cause of creation of the new system of procedural law, which shows a certain degree of shortcomings regarding the procedure for the adoption of an full age. Since the late 20th century there has been an increase migration in of people due to the development of new technologies, easier ways of travel and the opening of national borders. People travel abroad for jobs, studies, or exploring new countries. During these travels some of them find life partners abroad, settle down there, conclude marriages and establish families. It often happens that such marriages end in divorce. If children are born in such a wedlock questions arise as to who will take care of them, who will pay maintenance etc. In some cases a parent decides to solve a conflict situation in such a way that he/she moves with the child without consent of the other parent to another place within the country or he/she decides to move to another country, usually to the country of his/her origin. He/she wants to settle there with the child and to legalize staying there. Such removal where national borders are crossed is considered to be international child abduction. The basic document dealing with the issue of international child abductions is the Hague Convention on the Civil Aspects of International Child Abduction (hereinafter the Hague Convention) adopted on 25 October 1980 and currently acceded to by 87 states. An investigation into theory completion techniques in inductive logic programming

Traditional Inductive Logic Programming (ILP) focuses on the setting where the target theory is a generalisation of the observations. This is known as Observational Predicate Learning (OPL). In the Theory Completion setting the target theory is not in the same predicate as the observations (non-OPL). This thesis investigates two alternative simple extensions to traditional ILP to perform non-OPL or Theory Completion. Both techniques perform extraction-case abduction from an existing background theory and one seed observation. The first technique -- Logical Back-propagation -- modifies the existing background theory so that abductions can be achieved by a form of constructive negation using a standard SLD-resolution theorem prover. The second technique -- SOLD-resolution -- modifies the theorem prover, and leaves the existing background theory unchanged. It is shown that all abductions produced by Logical Back-propagation can also be generated by SOLD-resolution; but the reverse does not hold. The implementation using the SOLD-resolution technique -- the ALECTO system -- was applied to the problems of completing context free and context dependant grammars; and learning Event Calculus programs. It was successfully able to learn an Event Calculus program to control the navigation of a real-life robot. The Event Calculus is a formalism to represent common-sense knowledge. It follows that the discovery of some common-sense knowledge was produced with the assistance of a machine.

The Effects of a New ACL-Injury Prevention Device on Knee Kinematics and Hamstring and Quadriceps Co-Contraction : A Pilot Study

Background: The incidence of anterior cruciate ligament (ACL) –injury is 3-5 times greater in female athletes compared to male athletes. This may be partially attributed to lower levels of hamstring-quadriceps co-contraction in females with subsequent knee kinematics that increases risk of ACL-injury. Finding training methods that improves co-contraction and increases knee stability is important. Objectives: To evaluate the effects of a new device on hamstring-quadriceps co-contraction and to investigate if training with the device can alter knee kinematics in female athletes. Study design: Controlled experimental study design with repeated measures. Method: Twenty soccer and floor ball athletes were measured with electromyography (EMG) for hamstring-quadriceps co-contraction while performing squats with and without the device. Thirteen athletes also underwent three-dimensional kinematic analyses, measuring knee abduction angles (at initial ground contact and peak angle) during a drop jump, before and after a six week intervention period with the device. Friedman’s test and Wilcoxon signed rank test was used to assess differences and effect sizes (ES) were calculated. Results: Co-contraction was consistently larger on the device (medial side: p<0.001, ES=0.88; lateral side: p<0.001, ES=0.80) and the ratio of medial-to-lateral co-contraction increased (p=0.001, ES=0.79). In the kinematic analysis low adherence rates amongst our subjects meant that the effects of the device on kinematics could not be measured. Conclusion: Performing squats with the new training device stimulates increased hamstring-quadriceps co-contraction and increases the ratio of medial-to-lateral co-contraction. The effects of the device on knee kinematics have yet to be determined.

This study concerns teachers' conceptions of what it means to be pedagogical. The work has itsstarting point in van Manen's work concerning pedagogical tact. By using this concept vanManen tries to describe teachers' tacit and intuitive skills to decide what to do or what not to do in any given situation. This study is based largely on the assumption that van Marten's concept is too narrow and perhaps invalid in certain contexts. The study was conducted as a phenomenographical study with the help of video-stimulated-recall-interviews. Four aspects of the phenomena were identified:: The pedagogical relation: this aspect is constructed by four qualitatively different conceptions: parent-like, friend-like, manager-like and partner-like. The pedagogical control: this aspect is also constructed using four conceptions: as a question of finesse, negotiation, organisation and as a question of rules of the game. The pedagogical teaching: here the aspect consists of three conceptions: to transmit know-ledge, to make children work and to help children learn. The pedagogical ways of coping with dilemmas: the last aspect is made up by three conceptions: situational, principle and methodological. Different types of dilemmas occur according to whether the classroom is organised as collective teaching or individualised teaching. The results show that the phenomena being pedagogical can only be partly understood throughthe concept pedagogical tact. Further, the understanding of the phenomenon seems to be dependent on how the classroom is organised. Being pedagogical can therefore be seen as complex and as contextually dependent. It is influenced not only by cultural and historical factors but also on the type of activities undertaken.
