The resolution of domain name disputes : a comparison of Jordan, United Kingdom, United States, and ICANN rules

Domain names constitute a valuable key element in electronic commerce. However, some intend to benefit from this fact by registering identical or similar trademarks as domain names, thereby depriving the legitimate owners from obtaining the domain name. This thesis aims to evaluate the protection provided for domain names, by illustrating several models that are under civil, common and international jurisdiction, namely, Jordan, the United Kingdom, the United States and by ICANN. In the first model there are no special regulations. In the second model alternative regulations are applied while, in the third model, a special act is provided; the fourth model constitutes a global protection for specific types of domain name disputes. It is concluded that the absence of a unified legal identity for domain names is the reason why diverse positions are required to protect them; concomitantly, domain name disputes have not been sufficiently addressed, and there is a necessity to provide domain names with a globally comprehensive protection mechanism.

M.A. (Communication) / The two research questions explored in this study are: a) What is the potential effectiveness of Mandela's rhetorical choices in the light of the primary and media audiences and the situation, in the selected speeches and visual material? b) What rhetorical shifts occurred in the speeches delivered between 1990 and 1994? In view of the fact that this study is political in nature and falls within the parameters of political communication, the field of political communication as it relates to rhetoric and public speaking specifically, was discussed. The nucleus of Aristotle's theory of rhetoric was discussed in conjunction with modern theories and research, with the purpose of establishing theoretical grounds for effective political oratory. To explore the two research questions, the neo-Aristotelian model of rhetorical criticism was utilised. By using this model it was possible to measure the effectiveness or potential effectiveness of Nelson Mandela's choice of strategy in the series of speeches and visual material selected. The model also prescribes a methodology whereby the important variables in political oratory are measured, including language, the credibility of the speaker, emotional strategies, logical argumentation, organisation and nonverbal behaviour. For purposes of evaluation the model prescribes an ideal model of persuasion. The ancient and modern rhetorical theory discussed in the study was utilised to construct standards by which Mandela's speeches were evaluated. The model also enabled the critic to focus on the speaker, Nelson Mandela and his political messages, while considering the rhetorical transaction, including the audiences and situation as a whole. The primary audience considered in this study consists of the mainly black supporters of the ANC who received Mandela's political messages at mass rallies. It was determined that this audience had a positive orientation towards the speaker, his messages and the ANC. Important national media audiences were also fsolated and include Whites, Indians, Coloureds, the IFP and the PAC. These audiences maintained a more negative orientation towards the speaker, his messages and the ANC. The international community in general was also considered.

A tuberculose se constitui historicamente como um dos grandes desafios para os serviços de saúde. A política pública do Tratamento Diretamente Observado objetiva o fortalecimento da adesão do doente ao tratamento e requer que a gestão em saúde se responsabilize no desenvolvimento e implantação da mesma, junto à organização dos serviços de saúde. Este estudo teve como objetivo analisar a discursividade dos gestores de saúde na transferência de política do Tratamento Diretamente Observado da tuberculose no município de Manaus/AM. Pesquisa qualitativa no campo analítico da Análise de Discurso de linha francesa. Participaram oito gestores de saúde que atuavam como integrantes de equipes gestoras. As entrevistas transcritas foram organizadas com uso do software Atlas.ti versão 6.0. Após leitura minuciosa do material empírico procedeu-se a análise por meio da base conceitual da Análise de Discurso onde procurou-se compreender os processos polissêmicos, parafrásticos e metafóricos, além da interdiscursividade dos gestores, os quais possibilitaram a identificação de três blocos discursivos: atenção à saúde na tuberculose; multiculturalidade do cenário na atenção à tuberculose; e, sentidos da transferência de políticas. Nos discursos dos gestores evidenciam-se elementos constitutivos da atenção à saúde na tuberculose, da multiculturalidade do cenário na atenção à doença e na transferência de políticas do Tratamento Diretamente Observado, os quais estão ancorados em movimentos discursivos promissores para novas formas de organização dos serviços de saúde; novas composições e desafios na gestão em saúde; na adoção da transferência de políticas enquanto políticas de Estado; e, discursos que movimentam e se assentam em formações ideológicas. Conclui-se que o atual momento vivenciado pelo cenário sugere benefícios quanto a real incorporação da política do TDO em Manaus/AM / Tuberculosis constitute, historically, in one of the big challenges to health services. The public policy of Directly Observed Therapy aims to improve patient adherence to treatment and requires that health management became responsible for the development and implementation of them, together with the organization of health services. This study had the goal to analyze the discourse of health managers in policy transfer of Directly Observed Therapy in Manaus/AM. Qualitative research in the analytical field of French Discourse Analysis framework. Eigth health managers, who worked as management teams members, participate of the study. The interviews were transcribed and then organized using Atlas. TI 6.0. After carefully reading of the empirical data, the analyze was performed through conceptual base in Discourse Analysis, when there was sought to comprehend the process of polysemy, paraphrase and metaphor, besides of health manager\'s interdiscursivity, which enable the identification of three discursive blocks: attention to health in tuberculosis; multiculturality in tuberculosis\' attention setting; and, senses of policy transfer. In the discourses of health managers, it were evident the constitutive elements of health attention in tuberculosis, of the multiculturality at the setting of disease attention and policies transfer of Directly Observed Therapy, which are anchored in promissory discourses movements to new ways of health services organization; new compositions and challenges in health management; in the adoption of policies transfer as State Policies; and discourses that moves and solidify in ideological formations. Concluding that the actual setting suggests benefices regarding the real incorporation of Directly Observed Therapy policies in Manaus/AM

Orientador: Lizete Maria Orquiza de Carvalho / Banca: Luiz Gonzaga Roversi Genovese / Banca: Luciana Maria Lunardi Campos / Resumo: Na condição de professor iniciante e pesquisador, procurei identificar os elmentos que influenciaram minha recontextualização da abordagem educacional "Aprendizagem Baseada em Problemas" utilizando como referencial teórico o conceito de discurso pedagógico de Bernstein (2003b). Tal teoria é muito utilizada em trabalhos sobre políticas curriculares, apontando que estas são modificadas, selecionadas e adaptadas quando passam de seu campo de produção para o campo da reprodução, respeitando valores, ideologias e interesses deste último. Trazê-la pata a investigação sobre a própria prática significa acreditar que o professor possui uma estrutura interna própria, a qual orienta as modificações e adaptações que faz dos diversos discursos que chegam até ele, por exemplo, o currículo, o livro didático, teorias educacionais, metodologias de ensino e orientações diversas que recebe de órgãos oficiais com o a Secretaria de Educação. Para entender esse processo de recontextualização revisei minha trajetória na educação marcando como ponto inicial o término da licenciatura em Física em 2007 finalizando com o ingresso no mestrado em 2010. Assim, relacionei minhas as ações em sala de aula do início de 2011 com valores dos campos os quais já fiz parte, incluindo o próprio contexto da escola, pois não me afastei do cargo de professor efetivo de Fisica para realizar o mestrado. (Resumo completo, clicar acesso eletrônico abaixo) / Abstract: In the condition of beginning teacher and researcher, I sought to identify the factors that influenced my recontextuaklization of "Problem-based learning" using the theoretical concept of Bernstein's Pedagogic Discourse (2003b). This theory is widely used in work on curricular policies, pointing out that these are modified, selected and adapted when moving from its field of production for the field of reproduction, respecting values, ideologies and interest of the latter. Bring it to research on their own practice is to believe that the teacher has an internal structure itself, which directs the modifications and adaptations that make the various speeches that coming to him, for example, curriculum, textbooks, educational theories, teaching methodologies and guidance it receives from various official bodies such as the Secretary of Education. To understand this process of recontextualization reviewed my career in education and as a starting point the end of the graduation in Physics in 2007, ending with thw entry into Master's Degree in 2010. So, I connected my actions in the classroom in early 2011 with values of the fields which I have done part, including the proper context of the school, because I have not departed from his professorship to perform the search. RPX ??? a system for extending the IPv4 address range

In recent times, the imminent lack of public IPv4 addresses has attracted the attention of both the research community and industry. The cellular industry has decided to combat this problem by using IPv6 for all new terminals. However, the success of 3G network deployment will depend on the services offered to end users. Currently, almost all services reside in the IPv4 address space, making them inaccessible to users in IPv6 networks. Thus, an intermediate translation mechanism is required. Previous studies on network address translation methods have shown that Realm Base Kluge Address Heuristic-IP, REBEKAH-IP supports all types of services that can be offered to IPv6 hosts from the public IPv4 based Internet, and provides excellent scalability. However, the method suffers from an ambiguity problem which may lead to call blocking. This thesis presents an improvement to REBEKAH-IP scheme in which the side effect is removed, creating a robust and fully scalable system. The improvement can be divided into two major tasks including a full investigation on the scalability of addressing and improvements to the REBEKAH-IP scheme that allow it to support important features such as ICMP and IP mobility. To address the first task a method called REBEKAH-IP with Port Extension (RPX) is introduced. RPX is extended from the original REBEKAH-IP scheme to incorporate centralised management of both IP address and port numbers. This method overcomes the ambiguity problem, and improves scalability. We propose a priority queue algorithm to further increase scalability. Finally, we present extensive simulation results on the practical scalability of RPX with different traffic compositions, to provide a guideline of the expected scalability in large-scale networks. The second task concerns enabling IP based communication. Firstly, we propose an ICMP translation mechanism which allows the RPX server to support important end-toend control functions. Secondly, we extend the RPX scheme with a mobility support scheme based on Mobile IP. In addition, we have augmented Mobile IP with a new tunneling mechanism called IP-in-FQDN tunneling. The mechanism allows for unique mapping despite the sharing of IP addresses while maintaining the scalability of RPX. We examine the viability of our design through our experimental implementation.

An Investigation Of Bacterial And Fungal Xylanolytic Systems

Endo-b-1,4 xylanases (EC. 3.2.1.8) are typically produced as a mixture of different hydrolytic enzymes such as b-1,4-xylosidase (EC. 3.2.1.37) , a-Larabinofuranosidases (EC. 3.2.1.55), and feruloyl esterase (EC 3.1.1.73) that hydrolyze xylan molecule, which constitutes 20-30% of the weight of wood and agricultural wastes. Thus, xylan, a renewable biomass, can be utilized as a substrate for the preparation of many products such as fuels, solvents and pharmaceuticals. Besides, xylanolytic enzymes themselves are also used in food,feed, textile industries and pre-bleaching of kraft. In the first part of the study, xylanolytic systems of a soil isolate Bacillus pumilus SB-M13 and a thermophilic fungus Scytalidium thermophilum were investigated. Production rate and type of xylanolytic changed depending on the carbon source and the microorganism. However, xylanolytic enzyme production was found to be sequential, in synergy and under the control of carbon catabolite repression for both microorganisms. In the second part, B. pumilus SB-M13 b-1,4 xylanase was purified and biochemically characterized. The enzyme was stable at alkaline pHs and highest activity was observed at 60&deg / C and pH 7.5. Enzyme Km and kcat values were determined as 1.87 mg/ml and 43,000 U/mg, respectively. B. pumilus SB-M13 and S .thermophilum a-L-arabinofuranosidases were also purified and biochemically characterized. Although produced from a mesophilic microorganism, B. pumilus SB-M13 arabinofuranosidase was quite thermostable. Moreover, unlike other fungi, S. thermophilum produced alkaline stable arabinofuranosidases. Both enzymes were multimeric, alkaline stable and most active at 70&deg / C and pH 7.0. However, when compared to S. thermophilum, catalytic power of B. pumilus SB-M13 arabinofuranosidase was higher.

Presplit Blast Induced Air Overpressure Investigation At Usak Kisladag Gold Mine

In presplit blasting operations airborne energy called air blast overpressure or impulsive sound is produced. The air blast induced by blasting may vary significantly at or around an open pit mine depending on several parameters such as the amount of charge detonated, the physical distance between the blast and the monitoring locations and the weather conditions. Therefore evaluation and assessment of noise condition at or around an open pit mine is necessary. The objective of this research study is to monitor and record the noise and to investigate and assess the noise conditions that will be induced from presplit blasting operations at Kisladag Gold Mine. In this research study, several parameters such as the amount of charge, the physical distance to the location of monitoring device or residential structures and the weather condition parameters such as wind direction, wind speed were recorded, analyzed and evaluated. It is observed that with increasing charge per delay air overpressure increases, whereas with increasing scaled distances it decreases. It is also understood that wind speed and the direction are effective in air overpressure propagation also, but this subject needs further investigation. It is concluded that according to the U.S. regulations there is no damage risk to the structures and no disturbance to the inhabitants at present. Due to the uncertainties in weather conditions, in order not to take any risks, the charge amount per delay should be kept at 35 kg or less for presplit blasting at the mine.

Beam Switching Reflectarray With Rf Mems Technology

In this thesis 10x10 reconfigurable reflectarray is designed at 26.5 GHz where the change in the progressive phase shift between elements is obtained with RF MEMS switches in the transmission lines of unit elements composed of aperture coupled microstrip patch antenna (ACMPA). The reflectarray is illuminated by a horn antenna, and the reflected beam is designed to switch between broadside and 40&deg / by considering the position of the horn antenna with respect to the reflectarray. In the design, the transmission line analysis is applied for matching the ACMPA to the free space. The full wave simulation techniques in HFSS are discussed to obtain the phase design curve which is used in determining two sets of transmission line lengths for each element, one for the broadside and the other for switching to the 40&deg / at 26.5 GHz. The switching between two sets of transmission line lengths is sustained by inserting RF MEMS switches into the transmission lines in each element. Two types of RF MEMS switches, series and shunt configurations, are designed for the switching purpose in the reflectarray. The phase errors due to nonideal phase design curve and type of the RF MEMS switch are reduced. The possible mutual coupling effects of the bias lines used to actuate the RF MEMS switches are also eliminated by the proper design. To show the validity of the design procedure, a prototype of 20x20 reflectarray composed of ACMPA elements is designed at 25GHz and produced using Printed Circuit Board (PCB) technology. The measurement results of the prototype reflectarray show that the main beam can be directed to the 40&deg / as desired. The process flow for the production of the reconfigurable reflectarray is suggested in terms of integration of the wafer bonding step with the in-house standard surface micromachined RF MEMS process.

Non-destructive X-ray Flourescence Analysis Of Early Bronze Age Metal Items From Kalinkaya-toptastepe: With Critical Remarks On The Formerly Applied Electrochemical Cleaning Procedure

This thesis focuses on late Early Bronze Age metal objects from funeral context from the site Kalinkaya-Toptastepe, dated to the late 4th and 3rd millennium BCE. The site yielded a large number of metal objects from EBA necropolis of the southern slope of Toptastepe, offering an ideal closed assemblage for an archaeometrical analysis to reveal the metalworking technologies of an early small rural community of Central Anatolia. First archaeometrical analysis applied on these objects, however, revealed unexpectedly high amounts of Zinc, which turned out to be not an intentional alloy, but modern contamination due to the electrochemical cleaning, carried out in the 1970s. A second analysis has carried out after cleaning the metal objects with micro-sandblasting technique, to remove the artificial Zn contamination. The accumulated data provided us with important insights into the metal consumption and alloying traditions of a late EBA village community in Central Anatolia, showing the earliest conscious alloys were being applied in small hamlets of the EBA as well. It has been apparent that any pre-Iron Age metal object, revealing Zn in its chemical composition can not be considered as early brass, but clearly a result of modern, ill-advised cleaning application.
