Inaction in Proceedings before the Administrative Authorities - abstract The dissertation thesis deals with the issue of inactivity of administrative authorities in proceedings before them, which from the point of view of legal doctrine and application practice represents the most widespread form of inactivity in public administration. It can be considered as one of the most serious negative phenomena in public administration and its execution. Public administration is primarily seen as an executive (active) activity aimed at fulfilling its tasks set by or based on the legal order and carried out within its limits. As a rule, both legislation and scholarly literature contain material concerning public administration activities and their forms. The issue of inactivity often remains neglected, while in application practice it is a relatively common undesirable phenomenon, which the addressees of public administration encounter relatively often. The dissertation thus represents another source of reflection on this topic. The author interconnected two levels - theoretical and application, which allowed him to examine the issue of inactivity of administrative bodies in a broader context. This thesis is focused on the proceedings on the administrative offenses of artificial persons in the first instance, particularly on the peculiarities resulting from the nature of the proceedings, the subject of which is a criminal charge in the meaning of Art. 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms, and the accused person that is a fictitious artificial person. The thesis is divided into eight chapters. The first chapter deals with differences between the administrative and the court offenses, their classification and subsuming under the term "criminal charge" pursuant to Art. 6 of the Convention as interpreted by the European Court of Human Rights and national courts. In the second chapter, author provides insight into the principles of administrative law and administrative proceedings which are in each case interpreted in the light of the proceedings on administrative offence of the artificial person; attention is also paid to appropriate and necessary modifications of the principles. At the end of this chapter, the principles primarily applied with regard to criminal procedural law are analyzed. A heated debate was going on during the past few years among Czech lawyers concerning punishment of legal entities. It culminated as the law on criminal liability of legal entities and proceedings against them was passed. However, this has not solved all the problems of legal regulation of delicts committed by legal entities. The question of reform of administrative punishment remains relevant, although not urgent. The current legislation suffers certain defects, in particular its incompleteness, which has to be addressed in legal practice by using laws whose primary field of application lies elsewhere; those laws do not address all peculiarities of administrative punishment of legal entities. While the main discussion is centered on substantive law, proceedings for administrative delicts of legal entities deserve attention as well. My thesis is divided into four parts. Although there is no such special type of proceedings, it is an issue which deserves an attention. Every one of us is a part of highway traffic every day. Therefore it is important not only to know the rules by of it but also the rules and principles of the proceedings in which are transgressions against safety and smooth highway traffic heard. Termos de compromisso em processo administrativo sancionador da Comissão de Valores Mobiliários / Settlement agreements in administrative proceedings before the Brazilian securities and Exchange commission

O estudo trata dos termos de compromisso, mecanismo de solução consensual aos processos administrativos sancionadores cuja utilização foi facultada à Comissão de Valores Mobiliários por inserção de norma legal específica na Lei 6.385/76, em 1997. A parte inicial trata da natureza dessa ferramenta, relata os argumentos favoráveis e contrários à sua utilização no âmbito do mercado de valores mobiliários brasileiro; analisa a disciplina e as balizas legais aplicáveis, com referência ao processo legislativo e ao contexto regulatório em que foi criado; bem como examina as vantagens proporcionadas à administração pública e aos agentes do mercado pela celebração de tais acordos. Segue-se uma segunda parte, na qual são apresentados os procedimentos pertinentes à adoção dos termos de compromisso, a interação entre a CVM e o Ministério Público Federal, a influência dos acordos sobre as entidades de autorregulação e a discussão a respeito da destinação dos valores arrecadados com os acordos substitutivos. Casos práticos (apreciados pela autarquia) e experiências estrangeiras (regras e impressões doutrinárias) são apresentados no decorrer do trabalho, quando pertinentes. / This study addresses the settlement agreements (termos de compromisso), a consensual solution to administrative proceedings that may be used by the Brazilian Securities and Exchange Commission (Comissão de Valores Mobiliários) since the inclusion, in 1997, of a specific legal provision in Law 6,385/76. The first part of this work deals with the nature of the aforementioned tool, reports the arguments for and against its use in the Brazilian securities market; analyzes the discipline and limitations set forth by applicable law, considering the legislative and regulatory context in which it was created; as well as examines the advantages provided by such agreements to the government and market agents. A second part, which presents relevant procedures for the adoption of the settlement agreements, explains the interaction between the CVM and the Federal Prosecutors Office (Ministério Público Federal), the influence of such agreements on self-regulatory organizations and discusses the allocation of amounts collected with the agreements. Case studies (analyzed by CVM) and foreign experiences (rules and impressions of scholars) are presented throughout the text, when relevant.

The existence of other concepts and the necessary compliance with certain duties impose an obligation upon suppliers to perform their activities as designed by the legal system, notably by the Federal Constitution of 1988. In that context, the omissive or comissive conduct, subject to give rise to the application of an administrative penalty, imposes the need for supplier to be properly repressed, in accordance with the proper legal proceedings. Thus, since the Federal Constitution of 1988 approximated the administrative to the legal proceedings, creating a similar legal regime resulting from the clause of the proper legal proceedings, without forgetting the underlying principle of some of its norms and the need of a uniform treatment of the theme throughout the national territory, Law # 9,784/99, for being a true Code of Administrative Proceedings, must be used to regulate the administrative proceedings of consumer protection. Sanctioned after eleven years of the effectiveness of the Federal Constitution of 1988, Law # 9,784/99 reflects the Administrative Reform of the State, allowing the effective implementation of a Democratic Rule of Law since it allows the administered to participate in the creation of the sanctioning administrative act. Notwithstanding, Law # 9,784/99, as a result of the possibility of implementing the reformatio in pejus, which is nothing more than the possibility of aggravating the situation of the appellant upon the judgment of their appeal, means an important instrument of perfecting and preserving the consumer protection rules while it permits coping with constitutional wishes related to consumer protection and abiding by the grounds and fundamental objectives of the Federative Republic of Brazil / O desenvolvimento da atividade econômica, à vista do tratamento constitucional atribuído à defesa do consumidor, não ocorre de forma livre e voltada unicamente ao atendimento dos anseios do fornecedor. A existência de conceitos outros e a necessária observância a certos deveres impõem a obrigatoriedade de o fornecedor desenvolver suas atividades conforme os caminhos desenhados pelo ordenamento jurídico, notadamente pela Constituição Federal de 1988. Nesse contexto, a conduta, omissiva ou comissiva, passível de dar ensejo à aplicação de uma penalidade administrativa impõe a necessidade de o fornecedor ser adequadamente reprimido, respeitado o devido processo legal. Assim, uma vez que a Constituição Federal de 1988 aproximou o processo administrativo do judicial, criando um regime jurídico similar decorrente da cláusula do devido processo legal, sem olvidar sobre o caráter principiológico de algumas de suas normas e da necessidade de tratamento uniforme do tema em todo o território nacional, a Lei n°9.784/99, por consistir em verdadeiro Código de Processo Administrativo, deve ser utilizada para regular o processo administrativo de defesa do consumidor. Sancionada após onze anos de vigência da Constituição Federal de 1988, a Lei n°9.784/99 reflete a Reforma Administrativa do Estado, permitindo a implementação efetiva de um Estado Democrático de Direito na medida em que permite ao administrado participar da formação do ato administrativo sancionador. O processamento das atividades administrativas: o caso dos departamentos didáticos de uma universidade / The processing of administrative activities: a case at a teaching departmentof a university

The initiatives of innovations implemented in public organizations assume the search for efficiency and quality in services. To make these improvements happen effectively, Guimarães (2000) explains that it is necessary to break upwith the traditional models of managing resources and to introduce a new culture able to meet different requirements and complexities currently faced in this area. In the general context of the federal public administration, universities are bureaucratic agencies that require intensive studies on their organizational aspect, as well as a competent analysis of their administrative proceedings, since they are institutions with remarkable social responsibility because of their specific functions for generating and disseminating knowledge. This line of thinking corroborates the Institutional Development Plan (IDP) 2011-2015 of the Federal University of Santa Maria - UFSM, which shows the value of people, the quality of services, and the continuous improvement of working conditions as major challenges to be reached by the University. As a contribution to overcome these challenges, this study aimed to map the administrative proceedings within a Teaching Departments atCAL/UFSM and to identify difficulties to operationalize procedures. In order to achieve the objectives proposed, a study classified as a descriptive approach was carried out. In the research strategy, based on the Teaching Departments of Arts & Letters Center (CAL), the case study method was used to be aligned with the proposed objectives and with the research that guided the study. Data collection was conducted through document analysis and semi-structured interviews with the technical and administrative staff of the Teaching Departments at CAL. Results allowed us to learn about the quantitative of the administrative procedures regarding the department, as well as the classification of processes that require documentary formalization in Primers and Critics, based on the Valle e Oliveira (2009) model. Another significant element of the study was the identification of operational difficulties in implementing the procedures, since various demands have been pointed out. Moreover,operational and management practices rooted in the culture of the institution were demonstrated, which may boost debates aiming at institutional advantages. We have also designed a Tutorial,a practical tool aiming at operationalizing Critical processes, which may contribute to possible advances and positive effects ina department context. This research, with a view to the pursuit of excellence, may contribute to the consolidation of some changesas well as to the improvement of the management of people in order to stimulate more expressive, agile and consistent actions,which areexpected of a contemporary public organization. / As iniciativas de inovações implantadas nas organizações públicas pressupõem a busca pela eficiência e pela qualidade na prestação de serviços. Para que essas melhorias efetivamente aconteçam, Guimarães (2000) explica que são necessários o rompimento com os modelos tradicionais de administrar recursos e a introdução de uma nova cultura capaz de atender as diferentes complexidades atualmente enfrentadas nessa área. No contexto geral da administração pública federal, as universidades são órgãos burocráticos que demandam intensos estudos sobre o seu aspecto organizacional, assim como competente análise de seus processos administrativos, considerando que são instituições com marcante responsabilidade social, haja vista as suas funções específicas de geração e disseminação de conhecimentos. Essa linha de pensamento corrobora o exposto no Plano de Desenvolvimento Institucional PDI 2011-2015 da Universidade Federal de Santa Maria UFSM que evidencia a valorização das pessoas, a qualidade dos serviços e a melhoria permanente das condições de trabalho, como grandes desafios a serem vencidos pela Universidade. A título de contribuição para a superação desses desafios, este estudo buscou como objetivo geral: realizar o mapeamento dos processos administrativos executados no âmbito dos Departamentos Didáticos do CAL/UFSM e identificar dificuldades com vistas à operacionalização dos procedimentos. Para atingir os objetivos propostos realizou-se um trabalho classificado como de natureza descritiva, envolvendo abordagem qualitativa. Na estratégia de pesquisa a partir dos Departamentos Didáticos do Centro de Artes e Letras CAL - foi utilizado o método do estudo de caso por estar alinhado com os objetivos propostos e com a questão de pesquisa que norteou o estudo. A coleta dos dados ocorreu por meio de análise documental e de entrevistas semiestruturadas com os servidores técnico-administrativos lotados nos Departamentos Didático do CAL. Entende-se que o resultado encontrado possibilitou conhecer o quantitativo de procedimentos administrativos pertinentes ao âmbito departamental, bem como a classificação dos processos que exigem formalização documental em Primários e Críticos, baseado no modelo de Valle e Oliveira (2009). Outro elemento significativo do estudo foi a identificação das dificuldades operacionais na execução dos procedimentos, pois apontou diversas demandas e demonstrou práticas operacionais e gerenciais arraigadas na cultura da Instituição, que poderão impulsionar debates visando a proveitos institucionais. Além disso, foi elaborado um Tutorial - instrumento prático que visa a operacionalização dos processos Críticos que intenta contribuir para possíveis avanços e efeitos mais profícuos no contexto departamental. Conclui-se que esta pesquisa, tendo em vista a busca da excelência, tanto pode colaborar para a consolidação de uma mudança como para a melhoria na gestão de pessoas, no sentido de estimular ações mais expressivas, ágeis e coerentes com o que se espera da organização pública contemporânea.

Due to great importance of real estate for each single economics the leadership and administration of the Real Estate Cadastre (Cadastre) was entrusted to the state, i. e. to particular government bodies, in the Czech Republic. This public list is so subject to public inspection all the time. Registered and provided details must be of highest quality, proceedings should be as quick as possible and this list should also provide the highest protection of those details. That is why the author decided to pay attention to the role of state in the evidence and dispose of real estate. This thesis focuses so on conclusion and further specification of the most important administrative proceedings in the field of Cadastre. The author wants to clarify their process and focuses mainly on their deviations from Administrative Procedure Code as well as on the changes that the Act Nr. 256/2013 Coll., on the Cadastre of Real Estate (Cadastral Act) has brought till 1. 1. 2014.
