Zákaz sebeobvinění právnické osoby v řízení o správním deliktu / Privilege against self-incrimination of legal entity in administrative proceedings

This thesis deals with the topic of privilege against self-incrimination of legal entity in administrative proceedings and in offence proceedings. The following reasons led me to the choice of this topic. First of all, it is a multidisciplinary topic involving criminal law, criminal administrative law, constitutional law, and private law, especially the regulation of legal entities. Furthermore, with the exemption of decision-making praxis of courts, and a few academic essays, attention hasn't been paid to this topic in its complexity. For this reason, this topic has offered novelty and the possibility of observing the progressive development of judicature, especially the decision-making praxis of the Supreme Court of the Czech Republic, the Supreme Administrative Court of the Czech Republic as well as the Constitutional Court of the Czech Republic and the European Court of Human Rights. The first part deals with the historical origins of privilege against self-incrimination and development of the criminal proceedings over the centuries. In this article, the author stresses the importance of the right to proper motivation in the context of administrative procedures. In that sense, he states that all public bodies are required to issue administrative acts duly substantiated, because this is a requirement which, if unobserved, generates the nullity of the act. But beyond to validate administrative act, the author argues that the main benefit of meeting the proper motivation lies in the improvement of the interaction between the taxpayers and the Public Administration, generating greater confidence in state activity and promoting the development of economic activities with increasing levels of formality. / En el presente artículo, el autor destaca la importancia del principio-derecho a la debida motivación en el marco de los procedimientos administrativos. En esa línea, afirma que todas las entidades públicas están obligadas a expedir actos administrativos debidamente fundamentados, pues este constituye un requisito de validez que, de ser inobservado, acarrea la nulidad del acto. Pero más allá de validar al acto administrativo, el autor sostiene que el principal beneficio de que se cumpla con la debida motivación radica en la mejora de la interacción entre los administrados y la Administración Pública, generando mayor confianza en la actividad estatal y propiciando el desarrollo de actividades económicas con cada vez mayores niveles de formalidad.

A jurisprudência do órgão de julgamento administrativo paulista aponta o exercício da atividade de moderação sancionatória em diferentes quantidades, intensidades e qualidades, o que sedimenta injustiças impassíveis de revisão em sede de uniformização de jurisprudência, sobretudo por óbice imposto por súmula vinculante impeditiva. As injustiças foram empiricamente demonstradas, assim como a imprópria interpretação da súmula vinculante impeditiva. A situação atual prestigia antinomia sistêmica, na medida em que consagra uma inadmissível figura de juiz superpoderoso e da destinação do processo relegada significativamente à sorte da distribuição do recurso. Há decisões que apresentam fundamentos vagos e impróprios para definir a intensidade da moderação sancionatória, sobretudo quando apoiadas em conceitos vagos e inadequados de porte econômico, reincidência e antecedentes fiscais. Há parte substancial das decisões que sequer apresentam justificativas para definir a intensidade da moderação sancionatória, maculando-as com vício de nulidade. A justificativa da decisão é o instrumento que viabiliza o controle da legalidade dos atos administrativos, sobretudo quanto à efetividade das finalidades da própria sanção, com especial atenção aos bens jurídicos tutelados. A discricionariedade do julgador não diz respeito à dispensa de justificar, mas ao dever de justificar sem recorrer a padrões previamente definidos, senão de forma lógica, razoável e juridicamente aceita. / The rules granting the administrative ruling organ competence to decrease or increase tax penalties, denominated moderate sanctionary activity, represent the will to impose penalties in compliance with the equality, reasonability and proportionality postulates. The São Paulo ruling organ precedents point out to the exercise of moderate sanctionary activity in different amounts, intensity and qualities, consolidating injustices not liable to review at the jurisprudence standardizing process, above all due to obstacles imposed by a blocking binding abridgment of law. The injustices were empirically demonstrated as well as the inadequate interpretation of the blocking binding abridgment of law. The current situation privileges a systemic antinomy as it consecrates the figure of an unacceptable all-powerful judge, with the proceedings destination significantly relegated to the whims of the appeal distribution. There are decisions presenting vague and inappropriate bases to define the intensity of the moderate sanctioning, mainly when supported by vague and inadequate concepts of an economic nature, relapse and tax background. A substantial part of the decisions does not even present justifications to define the intensity of the moderate sanctioning, tarnishing them with the nullity flaw. The decision justification is the tool making feasible the administrative acts legality, moreover as to the effectiveness of the purposes of the sanction in itself with special attention to the protected legal assets. The judge’s discretion is not related to justification exemption but to the duty of justifying without resorting the previously defined standards, unless in a logic, reasonable and legally accepted form.

1 Abstract As a topic of the diploma thesis I have chosen the issue of electronic signature in relation to administrative proceedings. The field of electronic communication is incredibly diverse and it is growing very dynamically. For this reason, I found the topic interesting and usable in the future. There have not been many theses on this topic yet, so I did not have to solve the problem that it was not original. I have always had a positive attitude towards digital technology. At the same time, I was fortunate that I could have always been informed about information technologies by someone who was interested in the issue much earlier. No matter whether it was more experienced family member, high school teacher who by far exceeded the capacities of the educational institution, or patient colleague at work. As stated at the beginning, this work could not have been finished without the contribution of my father, who has been involved in the issue of electronic signatures for a long time, and who brought me to the idea of choosing this topic. - Remonstrance Proceedings The thesis is focused on the remonstrance and the following special administrative proceedings. The remosntrance represents an ordinary appeal, which can be used to challenge the first instance decision that has not already become enforceable and has been issued by the central administrative office, by the minister or by the director of other central administrative office eventually by the state secretary. Whereas there is no existence of the superior administrative authoritites in the organizational structure of the state administration, the same body that issued challenged decision decides on it. It is obvious, that appeal procedure contains a lot of variances and peculiarities, which the thesis points out, compared to the appeal procedure. The remostrance is limited to one paragraph and its five sections by the valid and effective legislation of the Administrative Code. The more this relatively brief provision often remains unkonwn to the general public, the more attention it attracts among the experts. Regime disciplinar do servidor público temporário / Disciplinary legal regime of temporary public servants

O presente trabalho tem por objetivo aprofundar o regime jurídico disciplinar do servidor público temporário. Analisam-se as características principais dessa espécie de agente público que o diferenciam dos demais servidores e que justificam um regime disciplinar próprio. Em uma breve investigação sobre as prováveis origens do temporário, constata-se a presença desse servidor na Administração Pública brasileira desde 1823. No direito estrangeiro (particularmente, no direito francês e no direito português), verifica-se a existência de figuras assemelhadas ao servidor público temporário brasileiro, que é uma espécie de servidor público do gênero agente público, exercendo uma função pública, mas não ocupando nem cargo, nem emprego públicos, sendo contratado por tempo determinado para atender a necessidade temporária de excepcional interesse público. A Constituição Federal, em seu artigo 37, IX, indica que a lei estabelecerá os casos de contratação por tempo determinado, mas não há uma uniformidade entre os entes da federação sobre o regime jurídico adotado para o servidor temporário. Esta análise concentra-se na Lei Federal n.º 8.745/93, que disciplina o assunto. No âmbito federal, o servidor público temporário é dotado de um regime jurídico com características mais próximas do regime jurídico administrativo, sendo recrutado por meio de contrato administrativo assemelhado ao regime estatutário. Tal contratação deve pautar-se pela observância dos princípios da continuidade do serviço público, da moralidade, da impessoalidade, da razoabilidade, da proporcionalidade e da motivação. Some particularities of this kind of public agent are analyzed in order to identify the main characteristics that differentiate them from other servers thus justifying its particular legal regime. From a brief history of its origin, the presence of temporary servers has been found in the Brazilian Public Administration since 1823. Based on the study of foreign laws, the existence of servants that resemble the Brazilian temporary public servant was detected particularly in French and Portuguese laws. The temporary public servant is a kind of public servant, a genre of public agent, who exercises a public function, but does not hold a public office and is not a public employee. This type of servant is hired for a specific time to meet a temporary professional demand of exceptional public interest. As indicated by Article 37, IX of the Brazilian Federal Constitution, a regulatory law must determine the cases of employment for a pre-determined term, and there is no uniformity among Brazilian States about the legal framework adopted for temporary public servants. This study is based on the Brazilian Federal Law number 8.745/93, which governs the matter. At federal level, temporary public servants are covered by a legal regime that is similar to the administrative legal regime. They are hired via an administrative contract that resembles the statutory regime. This contract shall be governed by the observance of the principles of public service continuity, morality, impartiality, reasonableness, proportionality and motivation. Public temporary servers are subject to the administrative proceedings and through the principle of assimilation are subject to disciplinary administrative proceedings to investigate their faults, under specific terms and conditions due to their temporary bond with the Public Administration. Such administrative proceedings, however, must follow the rules of the due legal process, namely the principle of unlimited right of defense and the adversary system. The differences between the disciplinary process of the temporary server (inquiry) and the process of public servants in general are analyzed, as well as the adopted rites, deadlines, penalties and appeals, noting that temporary public employees are liable for torts in all areas: criminal, civil, administrative and acts of misconduct. The transience function does not exempt temporary public servants from liability therefore, mutatis mutandis, they are subject to all rights and obligations of public service. Hence the need to build, based on the characteristics of this kind of public servant, a regime tailored to the specifications of the special bond that undergoes temporary public service. A disciplinary mini-process, or a special disciplinary proceeding, or a small inquiry, or a special sui generis inquiry is proposed herein.

Lhůty podle správního a daňového řádu / Deadlines under the Administrative and Tax Code

Annotation The diploma thesis deals with the description and analysis of tax and administrative management in terms of deadlines. The aim of the thesis is to find a practical basis when applying an inconsistent setting of deadlines in the tax and administrative procedures. It was important to determine whether the concept of deadlines in the legislation is different, how the concept of time is regulated in the legislation and how this issue can actually affect us. The analysis of individual management was based on actual data. I was provided the data related to the tax procedure by a particular tax subject. The data related to the administrative procedure were requested from a specific administrative authority. The practical part of the thesis deals with a detailed analysis of individual management in terms of deadlines. The tax procedure was about determining the preclusion of the deadline for a tax assessment and the identification of the factors which had an impact on the course of this period. In the case of administrative proceeding, the time limits which are necessary for discussion of the minor offense and the administrative offense were analyzed. The thesis contains tables with data for better clarity within individual management.

The thesis deals with the issue of administrative law in reflection of the new Education Act and court judgments in recent years, according to which the administrative procedure should apply in all schools and beyond complete list of cases referred to in the Education Act. The topic concerns the implementation of rights of children and students in public and private schools. Diploma thesis brings brief analysis of the development of public administration in education from 1990 to present with a focus on specific role of the school principal in the state administration. The thesis describes problematic areas in headmaster's decision about rights and duties of children and pupils especially in the application of Law no. 89/2012 Coll., the Civil code and the Law no. 258/2000 coll., on protection of public health and amending some related laws as subsequently amended. Diploma thesis provides a summary of the basic principles in the director's decision in state administration and headmaster's insight on the issue of administrative proceedings in nursery and primary schools.
