Människor som söker asyl i Sverige är en grupp som i större utsträckning än övriga befolkningen kan förväntas vara traumatiserade. De asylsökande har rätt till ett offentligt biträde som juridiskt stöd i asylprocessen. Att som jurist hjälpa en traumatiserad person lägga fram sin historia kan innebära specifika utmaningar, något som till vår kännedom inte tidigare skildrats i Sverige. Föreliggande uppsats belyser genom intervjuer hur åtta offentliga biträden beskriver utmaningar och förutsättningar i arbetet med traumatiserade asylsökande. Genom Interpretative Phenomenological Analysis har samtliga intervjuer analyserats. Tre övergripande teman har kunnat urskiljas i resultatet: asylprocessens snäva ramverk, svårigheter att ta fram en juridiskt relevant berättelse samt relationella utmaningar. Resultaten är i linje med tidigare forskning inom området gällande traumauttryck och det känslomässigt svåra i att möta traumatiserade. Ett bristande hänsynstagande till traumatiserades problematik i den svenska asylprocessen är något som inte tidigare beskrivits ur ett juristperspektiv. Vidare forskning på trauma i en asylrättslig kontext rekommenderas för att främja förståelsen för och bemötandet av traumatiserade asylsökande och skapa bättre förutsättningar för offentliga biträden i arbetet med dessa människor.

In the fall of 2015 over 100 000 refugees came to Sweden, seeking asylum. As a result, Swedish schools are now educating children and young people, whose future is uncertain, since some of them will not continue to live their lives in Sweden. The Swedish curriculum is adapted to the needs and values of Swedish society. It can be questioned if this is the best education for asylum seekers who are not allowed to stay in the country. Amy Gutmann has introduced the idea of adequacy in the philosophical debate about education. According to this theory, an adequate education is one that makes it possible for all educable children to take part in the democratic processes as adults. Elizabeth Anderson has developed the theory further, from the point of view that a society is governed by an elite. She concludes that it is important that this elite consists of representatives from all socio-economic tiers in a society to be democratically viable. For this to happen, schools need to be more integrated than they are today. It is the aim of this essay to see if the education of asylum seeking pupils in Sweden is adequate in fostering active democratic citizens. The author therefore looks at the way the Swedish school system handles asylum seeking pupils and their parents. UNHCR’s Educational Strategy is also used as a guide to an adequate curriculum. The author reaches the conclusion that adequacy points to certain changes in the curriculum and organization of schools, which would better prepare individuals both for a life in Sweden, and for a return to their native countries. Furthermore, adequacy gives us a reminder that people seeking asylum are also part of the democratic processes in the host country.

Thousands of LGBT-people apply for asylum in Europe every year. Credibility assessments have become an increasingly important part of the judgement in these asylum cases. This essay explores credibility assessments in two European countries, Sweden and Denmark. Sweden and Denmark are similar countries but have had different approaches to immigration policy during the 21thcentury. The countries also have different legal processes to handle asylum cases. In Sweden the administrative courts handle the appellate procedure, whereas in Denmark the whole procedure is placed within the administration. Furthermore, Sweden takes part in the EU-asylum system but not Denmark since the country has reserved against parts of the Maastricht treaty. However when it comes to LGBT-refugees the countries seem to apply their legislations in a similar manner. Regarding credibility assessments there are some common features but also some differences between the countries. In both Sweden and the Denmark the applicant is more likely to receive asylum –      if he or she is able to give more details about his or her story, –      if his or her story is coherent, –      if his or her story does not change during the process, –      and if he or she waits to apply for an asylum until after he or she has entered the country or does not claim his or her right to asylum on the ground of his or her sexual orientation from the very beginning of the process. However, the main focus of the credibility assessments between the countries seems to differ. In Sweden there is an ambition to focus on the feelings and identity of the applicant while in Denmark the main focus is rather the applicant’s actions such as romantic partners.
