Measuring the shape of time-varying objects

This thesis describes the first implementation of a colour encoded structured light (CESL) range-finder capable of measuring the shape of time-varying or moving surfaces. The system is shown to have mean square accuracies of better than 0.5mm when measuring the shape of the human mouth during continuous speech sampled at 50Hz, and better than 0.2mm when measuring static objects of similar dimensions. In order to sample range at video-rates, the images of the scene to be digitised are stored on video tape. This allows the image processing to be performed off-line so the sampling rate of the system only depends on the frame-rate of the video equipment used. The work was motivated by the need to acquire information on mouth shape for acoustics of speech experiments so that the results presented are for measurements of mouth shape and objects relating to the field. The reasons for producing a new system, and the choice of CESL are discussed. The work covers the entire implementation of the range-finder, including code and slide design, feature extraction, feature interpretation, calibration and 3D reconstruction, and performance evaluation. A modification on the Blackman and Tukey classical power density spectrum (PDS) estimator was used for feature extraction which was shown to perform better than other techniques evaluated. The accuracy of detected features and the probability that they were not spurious was determined, based on the feature confidence output by the PDS estimator. Detected features were tracked to produce segments, and encoded as a directed acyclic graph (DAG) which was then matched with the original code sequence using a fast but sub-optimal technique. An existing camera calibration technique was used which was extended to include a second step for projector calibration. The projector model used was linear, had the correct number of degrees of freedom, and was particular to our stripe system.

International sales contract - Summary The topic of this thesis is an international sales contract. The aim of this thesis was to outline various ways of regulation of international sales contracts. Particular attention was paid to the United Nations Convention on Contracts for the International Sale of Goods and the emerging European legislation Common European Sales Law. The thesis is divided into three main parts. The first part provides insight into the history of the concept of contracts of sale and the definition of this term in Roman law. Following is a brief description of modern regulations on sales contracts. Also an international element is defined in the international sales contracts and basic elements of choice of law rules are discussed in the next section. The last section of this part is devoted to individual regulations regarding international sales contracts. These regulations are divided according to their origins into national regulations, international regulations, norms and rules of European law and the rules of international business transactions - lex mercatoria. Den nya gemensamma europeiska köplagen (CESL) : En analys av kritiken mot förslaget och konsekvenser för svenska företag

I oktober 2011 framlade Europaparlamentet det senaste försöket till en mer samstämmig europeisk avtalsrätt, genom ett förslag till en förordning om en gemensam europeisk köplag, CESL. Den europeiska köplagen innehåller både avtals- och köprättsliga regler med det övergripande syftet att, likt den inter-nationella motsvarigheten CISG, underlätta den unionsinterna handeln för konsumenter och företag. Mot bakgrund av att förslaget har mötts av omfattande kritik är det av intresse att ställa sig frågan om CESL kommer att bidra med de uppenbara skillnader, som har angetts både i förarbeten och i förslaget som sådant. Uppsatsen syftar till att granska och analysera förslaget till en ny gemensam europeisk köplag, CESL, tillsammans med den kritik som framförts från svenskt håll. Med utgångspunkt från det arbetet analyseras slutligen de konsekvenser förslaget, vid ett eventuellt införande, får för svenska företag. Kritiken som lyfts fram i studien kommer från 12 svenska intressenter, med härkomst både från näringsliv, akademi och doktrin. Efter en systematisering, och en efterföljande analys, av denna kritik kan fyra segment urskiljas. Denna uppdelning är gjord utifrån en lista av punkter, som identifierats som de starkaste argumenten i den svenska kritiken. Segmenten lyfter fram brister i förslagets tekniska kvaliteter, såväl som oklarheter i det materiella innehållet. Dels skapar ett nytt regelsystem en ökad komplexitet, och tillsammans med det faktum att ytterligare ett regelverk påförs berörda aktörer, uppkommer frågan om denna utveckling är önskvärd eller ens efterfrågad. Dessutom innebär det oklara tillämpningsområdet att den nya köplagens ramar ter sig något odefinierade, vilket skapar en osäkerhet kring förslagets förhållande till andra instrument. Detta leder i sin tur till CESL inte tydligt markerar sin plats och därmed inte heller visar vilka dess fördelar är samt vilka behov som är tänkta att tillgodoses. Förslagets undermåliga kvalitet och struktur, tillsammans med dess stora omfång, gör även att helhetsbilden av förslaget försämras ytterligare. Det är helt uppenbart så, vilket är den huvudsakliga slutsatsen i denna uppsats, att det helt enkelt inte finns något behov av CESL i sin nuvarande form. Det är inte de direkta skillnader mellan CESL och svensk rätt som gör att förslaget kritiseras så starkt och så brett. Företagen har redan tagit fram egna lösningar på de gränsrelaterade problemen. CESL innebär istället ytterligare en regelsamling att ta hänsyn till, vilket i en majoritet av fallen enbart har negativa följder. För svenska företag, som har möjlighet att i framtiden tillämpa förslaget regler, finns det självklart en rad fördelar. CESL innehåller regler som i hög grad kan underlätta den gränsöverskridande handeln. Den verkliga situationen tyder dock istället på att den nya gemensamma köplagens regler försvinner bort bland andra, mer sedvanliga och relevanta lösningar. Konsekvensen blir helt enkelt att förslagets regler inte kan tillämpas, inte ens av de aktörer som reglerna att tänkta att hjälpa. Risken är överhängande att CESL blir, som det har uttryckts i kritiken, ytterligare ett bidrag till den stora och komplexa regelmassan som redan i dag finns tillgänglig.

Efeito da tensão mecânica no ruído de baixa frequência de transistores SOI planares e tridimensionais. / Effects of mechanical stress on low frequency noise in panar and three-dimensional transistors.

Neste trabalho é apresentado um estudo do efeito da tensão mecânica uniaxial e biaxial no ruído de baixa frequência nos transistores SOI planares e tridimensionais (MuGFETs de porta tripla) com diferentes orientações cristalográficas, além de um estudo das características analógicas nos transistores planares e tipo MuGFET de porta tripla. Nos transistores planares, o estudo do ruído de baixa frequência demonstrou uma melhora para os transistores tensionados no regime de saturação, independente do comprimento de canal, entretanto para a região linear, a tensão mecânica somente reduziu o ruído para um comprimento de canal pequeno (160nm). Nas características analógicas, foi utilizado o recurso da simulação numérica bidimensional para obtenção dos resultados. Os resultados mostram que os transistores tensionados são capazes de promover um melhor desempenho na transcondutância, na ordem de um aumento no mínimo de 40% , indicando para comprimentos longos de canal (910 nm) uma aumento de 56% para tensão mecânica biaxial e o oposto para a uniaxial (45%) (160 nm): entretanto, na condutância de saída, a tensão mecânica de forma geral promove uma maior degradação, aumento de 3% para um transistor uniaxial e aumento de 105% para o transistor biaxial. No ganho intrínseco de tensão, mais uma vez os transistores tensionados melhoraram de desempenho: contudo, neste caso, melhor resultado foi para o transistor biaxial, chegando a 5 dB de ganho. Nos transistores de porta tripla, a análise do ruído foi realizada nos transistores tensionados e convencionais operando em saturação e, de forma geral, a tensão mecânica piora o ruído de baixa frequência em uma ordem de grandeza para o transistor estreito, ocorrendo apenas uma melhora quase imperceptível num transistor largo ou quase planar. Na análise do ruído para os transistores rotacionados para a região linear, apresentaram dependência 1/f, com o ruído governado pela flutuação do número de portadores associado à flutuação na mobilidade: a tensão mecânica piora o ruído, entretanto, adicionando a rotação do substrato, ocorre uma melhora do ruído devido à redução das armadilhas de interface, ocasionando numa melhor interface lateral. Para dispositivos largos, o plano de topo sofre um aumento da concentração das armadilhas, piorando a interface superior devido a rotação do substrato, resultando um pior ruído. Nas características analógicas, os transistores de MuGFETs de porta tripla com tensão mecânica e substrato rotacionado foram estudados, onde a rotação do substrato em 45º mais a presença da tensão mecânica promoveram uma piora nos resultados, principalmente na transcondutância, onde a piora variou de 45 % até 15 %, para um dispositivo estreito (20 nm ) e um largo (870 nm). / This work presents a study of the uniaxial and biaxial mechanical stress effect on low frequency noise in planar and three-dimensional SOI transistors (triple gate) with different crystal orientation, and an study of analog parameters in planar and for triple gate MuGFET. In planar transistor, the study of low frequency noise showed an improvement in low frequency noise for strained transistors in saturation regime, regardless of the channel length, however for the linear regime, the mechanical stress only reduced the noise in a small channel length (160nm). In the analog characteristics was used the feature of two-dimensional numerical simulation for the expansion of the results. The results shows that the strained transistors are capable to promoting a better performance in transconductance in a order at least 40%, indicating for a long channel lengths (910nm) an improvement of 56% in favor of biaxial stress and the opposite to uniaxial (45%) (160nm), however in the output conductance, the mechanical stress promotes higher degradation, ranging from 3% to uniaxial transistor and 105% for biaxial transistor. The intrinsic voltage gain, the strained transistors improved the performance, but in this case a best result was found for the biaxial strain reaching 5 dB. In triple gate transistors, the analysis of noise was performed on strained and conventional operating in saturation, and generally the worsening of mechanical stress on the low frequency noise in a order of magnitude for the marrow transistor, occurring only barely perceptible improvement seen in wider transistor or quasi-planar. The noise analysis for rotated transistors in linear region, showed a 1/f noise characteristic governed by the carrier number of fluctuations associated with fluctuations in mobility, the mechanical stress worsens the noise, however, by adding the substrate rotation occurs improves noise due to reduction of interface traps leading to a better sidewall interface. For larger devices the top plane suffer an increase of interface traps, worsening the top interface due to rotation of the substrate, causing a worse noise. In the analog characteristics, the triple gate MuGFETs transistors with mechanical stress and rotated substrate were studied, where the rotation of the substrate in 45º plus mechanical stress promoted a worsening of the results, particularly in the transconductance, where the worsening ranged from 45% up to 15% for a narrow device (20 nm) and a large (870 nm).

The purpose of the thesis "Contract of sale under business law" is to compare changes of the contract of sale, which occurred as a result of the newly adopted Act No. 89/2012 Coll., Civil Code. The aim of this thesis is to simultaneously take into account the proposal for a European Parliament and Council Regulation on a Common European Sales Law (Common European Sales Law, CESL). The thesis also focuses on selected provisions of the purchase - especially rules governing the acquisition of ownership from unauthorized (and the related principle of good faith) under the new Civil Code. Rules governing the acquisition of ownership were significantly changed. Thesis attepmts to specify rules which are applied in the case one of the contracting parties is in the possition of a consumer. Specific features of contracting process must be taken in consideration due to the protection of consumers and or small and medium- sized enterprises. The thesis is focused on selected aspects of the contract of sale, thus the purchase of property, asset deal or liability for defects are mentioned only in passing.

Komisija nurodo, kad tarp Valstybių narių egzistuojantys nacionaliniai sutarčių teisės skirtumai atgraso prekiautojus ir ypač MVĮ plėsti veiklą ir užsiimti prekybą kitose Valstybėse narėse, dėl ko kiekvienais metais ES vidaus rinkoje prarandama bent 26 mlrd. eurų. Atsižvelgiant į tai, kad Vienos konvencija nereglamentuoja tam tikrų pirkimo – pardavimo sutarčių teisės aspektų, be to Vienos konvencija gali būti taikoma ribotai, nes ją pasirašė ne visos Valstybės narės ir nėra vienodą jos aiškinimą užtikrinančio mechanizmo, Pasiūlymu siekiama sukurti 2 – ąjį sutarčių teisės režimą, kuris egzistuotų kiekvienos Valstybės narės nacionalinėje teisėje. BEPPST – naujas ir sudėtingas teisinis instrumentas, kurį rengiant neišvengta reikšmingos problematikos. BEPPST ir jo poreikio aplinkybes konstruktyviai kritikuoja tiek Valstybių narių institucijos ir organizacijos, tiek teisės mokslininkai. Lietuvoje šiuo klausimu kol kas nevyksta nei reikšmingos praktinės, nei mokslinės diskusijos. Dėl to šiame darbe atkreipiamas dėmesys ne tik į BEPPST, kaip teisinio instrumento problematiką, bet ir jį priimti paskatinusias aplinkybes bei su tuo susijusią problematiką. Pirmojoje šio darbo dalyje yra nurodoma Europos sutarčių teisės raida, jos poreikio aplinkybės ir siekiamas efektas, kurį turėtų sukurti tokia teisė. [toliau žr. visą tekstą] / Commission indicates that differences in contract law among the Member States hinder traders and particularly SMEs to engage in cross-border trade within other Member states, therefore at least 26 billion EUR is lost each year in the internal market. Taking into consideration that the Vienna Convention does not regulate certain aspects in contracts of sales of goods, further limitations to its applicability arise as not all Member States have signed the Vienna Convention and there is no mechanism which could ensure its uniform interpretation, therefore it is intended with this Proposal to establish the 2nd contract law regime within the national law of each Member State. CESL is a new and complex legal instrument, which does not escape from material problems. CESL and circumstances of its demand in the interested society receives constructive criticism from Member States institutions, business organizations and legal scholars. In Lithuania, there is no meaningful practical or legal discussions regarding this issue. Therefore attention is being paid in this thesis not to only to the problems related with CESL as a legal instrument, but to the motives which encouraged to adopt this instrument and related problems thereof, as well. Dans le domaine du droit de la vente, on peut trouver beaucoup de règles qui sont limitées dans leur champ d’application ratione personae (par exemple aux seuls contrats Business to Consumer, B2C, ou aux contrats B2B). Ces différenciations sont souvent dues à des raisons historiques (par exemple la transposition de directives européennes en matière de droit de la consommation). Cependant, ces différenciations, qui compliquent les dispositions en matière du droit de la vente pour la jurisprudence ainsi que pour les utilisateurs et praticiens du droit, ne sont souvent pas justifiées par des raisons matérielles. La présente étude a l’objectif de trouver une réponse à la question quelles différenciations sont réellement utiles et dans quelles dispositions il est souhaitable de prévoir davantage une règle uniforme pour toutes les hypothèses ratione personae. A cette fin, le travail examine le droit de la vente français et allemand ainsi que des réglementations et principes européennes et internationaux (CVIM, DCEV, Principes UNIDROIT, CCR) et les analyse en se référant, outre que l’argumentation juridique, à la méthode fonctionnelle du droit comparé et à l’analyse économique du droit. / In sales law, there are many provisions that have limited personal scope of application, for instance special rules for so-called B2C (Business-to-Consumer) or B2B (Business-to-Business) contracts. Those personal differentiations, that make the application for judges, contracting parties as well as legal practitioners very complicated, are often due to historical reasons (for example the transposition of European Directives in the field of consumer law), but not justified by substantial arguments like differences between those personal categories.The present comparative study aims at finding out where these differentiations are useful and justified by substantial reasons and at what point it is preferable to provide a uniform rule for all personal configurations. In order to answer this question, this work examines the German and French sales law as well as European and international regulations and principles of soft law (CISG, CESL, UNIDROIT Principles, CFR) and analysis the rules using, apart from legal argumentation, the functional method of comparative law as well as the law and economics approach. / Insbesondere im Kaufrecht findet man immer wieder einzelne Vorschriften, Gesetzesabschnitte oder ganze Gesetzbücher mit eingeschränkten personalen Anwendungsbereichen (z.B. beschränkt auf Business to Consumer Verträge, B2C, oder auch auf B2B-Verträge. Jedoch scheint dieses komplizierte Netz aus personalen Differenzierungen keiner bestimmten Logik zu folgen und basiert häufig auf rein historischen Gründen (z.B. der Umsetzung von europäischen Verbraucherrichtlinien) oder auf beschränkter legislativer Kompetenz.Die vorliegende Arbeit untersucht daher, an welcher Stelle derartige personal differenzierende Vorschriften tatsächlich durch materielle Gründe gerechtfertigt sind und wo es besser wäre, die Differenzierung zu beseitigen, um das Kaufrecht zu vereinfachen und für dessen Adressaten und Anwender zugänglicher zu machen. Somit richtet sich die Arbeit nicht nur an die Gesetzgeber, um die existierenden Regelungen zu vereinfachen, sondern auch an die Rechtsprechung und die Praxis. Um dieses Ziel zu erreichen untersucht die Arbeit das deutsche und französische Kaufrecht sowie internationale und europäische Regelwerke (CISG, CESL, UNIDROIT-Principles, CFR). Dabei werden außer der juristischen Argumentation die funktionale Methode der Rechtsvergleichung und die Ökonomische Analyse des Rechts verwendet.
