Nesta dissertação apresenta-se a pesquisa realizada junto a Vara de Execução das Penas e Medidas Alternativas (VEPMA) da Comarca de Porto Alegre/RS, responsável pela execução da prestação de serviços à comunidade. Discute-se o impacto dessa pena/medida alternativa na vida dos seus destinatários, buscando-se privilegiar o seu ponto de vista. O estudo é qualitativo e os dados foram coletados com a combinação de diferentes fontes: observação participante junto à equipe técnica da VEPMA, análise de documentos institucionais, questionário aplicado às entidades conveniadas ao Poder Judiciário e estudo de caso de uma dessas entidades, que reuniu observação participante e entrevistas com dirigentes e prestadores de serviços. Os dados são analisados e interpretados mediante leitura abrangente do real, composta por elementos históricos, sociais, jurídicos, econômicos, políticos e culturais, que perpassam e configuram o complexo fenômeno da prestação de serviços à comunidade. O olhar lançado sobre essa realidade, contudo, não procede a uma leitura totalizante, mas procura recuperar a dimensão do sujeito, permitindo identificar os sentidos atribuídos, as possibilidades e os limites dessa pena/medida alternativa como forma de educação, responsabilização e (re)inserção social. A pesquisa revela a importância das entidades conveniadas como contextos privilegiados, nos quais a prestação de serviços à comunidade ocorre, mediante as múltiplas interações entre os diversos atores envolvidos, favorecendo a socialização e a vivência de processos educativos. Nesse ambiente, os prestadores têm a possibilidade de estabelecer vínculos, sentirem-se úteis, aceitos e integrados, superando a noção de estigma que carregam os sujeitos que cumprem pena/medida. O estudo aponta os desafios da (re)inserção social e da responsabilização dos cumpridores, procurando lançar luzes ao aperfeiçoamento do trabalho. Conclui-se que a prestação de serviços à comunidade se revela um profícuo campo de possibilidades de transformação dos sujeitos, podendo contribuir para o desenvolvimento humano e sua felicidade, objetivos fundamentais da educação. / This paper presents the research carried out at the Court for the Execution of Penalties and Alternative Writs (VEPMA) of the County of Porto Alegre - RS that is responsible for the execution of the services to be rendered to the community. The discussion approaches the impact of this penalty/alternative measure on the life of their addressees taking their point of view into consideration. It is a qualitative study and the data were collected through the combination of different sources: participative observation close to the VEPMA technical staff, analysis of institutional documents, questionnaire applied to the entities covenant with the Judiciary Power and case study of one of these entities that gathered participative observation and interviews with the controllers and subjects that render services. The data are analyzed and interpreted by means of a broad reading of the real scenario, composed by historical, social, legal, economic, political and cultural elements that permeate and configure the complex phenomenon of rendering services to the community. Nevertheless, the glance launched into this reality does not proceed a whole reading but it searches to recover the dimension of the subject, that allows identifying the attributed senses, the possibilities and the limits of this penalty/alternative measure as a way of education, taking over responsibility and social (re)insertion. The research reveals the importance of the covenant entities as privileged contexts where rendering of services to the community occurs by means of multiple interactions among the several involved actors, by favoring the socialization and the experience of educative processes. Within this environment, the subjects who render the services have the possibility of establishing bonds, feeling themselves useful, accepted and integrated, overcoming the stigma notion that they carry upon serving penalty/measure. The study points out the challenges of the social (re)insertion and responsibility charge of the servers in the search of launching lights to the work improvement. The conclusion drawn is that rendering services to the community reveals itself as a rich field of possibilities for the transformation of the subjects being able to contribute for the human development and joy, the fundamental objectives of education.

Punishment of community service and its performance Abstract The aim of this thesis is to describe a current legilation on punishment of community service and thanks to it's desription together with the statistical data about this punishment from years 2013 to 2017 define problems that have a negative impact on its functioning. Other methods to reach this goal are comparison with the legislation in different european countries, focusing on activity of Probation and mediation service of the Czech Republic and overview of czech case law, which was defining for a current understanding of this punishment. First part of this thesis icludes definitions of key concepts that are necessary for understanding on how this punishment works and what it is based on. Second part of this thesis includes overview of the czech legislation related to punishment of community service and its performance and also an overview on how this legislation works in actual fact. Professional literature, opinions of judges, district attorneys and probation officers as well as my own notices were used to decribe its actual works on day to day basis. Community service in Uganda as an alternative to imprisonment: a case study of Masaka and Mukono districts

Magister Artium - MA / Community service as an alternative to imprisonment at its inception was taken up very strongly by the judiciary as part of the reform of the criminal justice system in Uganda. The successful enactment of the Community Service Act, Act no: 5/2000, was an achievement towards the implementation of the programme in the country. However, its implementation as an alternative sentence is currently proceeding at a slow pace. The Ugandan law still allows courts to exercise their discretionary powers with regard to either using prison sentences or community service. Courts still seem to prefer to use imprisonment irrespective of the nature of the offence, thus leading to unwarranted government expenditure and prison overcrowding. An additional problem is that some offenders come out of prison having been negatively affected by their interaction with even more serious offenders. This study was undertaken to establish whether community service as an alternative to imprisonment can be effective with regard to reducing recidivism and to accelerating reconciliation and reintegration of minor offenders back into their communities. / South Africa

Learning to Teach-in-Relation: Community Service Learning, Phenomenology, and the Medicine Wheel

The focus of this phenomenological research project is to delve into the question of ‘what it is like’ for teacher candidates to experience the phenomenon of learning to teach-in-relation in the context of a community service learning project. A sense of the phenomena of learning to teach-in-relation emerges as the five teacher candidates make and play with hula hoops beyond the initial intention of cultivating joyful physical activity on campus. This research is guided by van Manen’s (1997) phenomenological approach to researching lived experience, as well as an Indigenous research framework based on the theoretical and philosophical underpinnings of the medicine wheel. Within the relational and embodied framework of the medicine wheel, the following six significant themes shifted perceptions of what it means to teach: 1) waiting to learn; 2) shaping community; 3) learning in movement; 4) sitting with students; 5) learning with students; and 6) embodying a flexible practice.

Vliv vybraných druhů trestů na resocializaci odsouzených / The effect of selected types of penalties on the resocialization of convicts

The problem of resocialization of convicts and the effect of particular penalties on this process is a subject rather relatively neglected, but at the same time socially and legally fundamental. The success of the resocialization of offenders affects not only the entire criminal policy but also society as a whole. However, the view on this social dilemma is evolving over time. We do not longer examine the punishment as mere retribution, rather we expect it to protect society and have a positive effect on the convict. We also realize that most of the sentencing does not mean permanent exclusion from society. Therefore, the consequences of any sentence also affect us, the society. This phenomenon led me to analyze the three most severe sentences: imprisonment, house arrest, and community service. Gradually, I tried to investigate the outcome of the effects of these sentences on the offender's personality. During the analysis, I decided not to only benefit from the secondary data consisting of acknowledged publications, articles, studies, and concepts, but I also acquired findings from several interviews with experts within the sphere and convicts themselves. This thesis "Community service as an opportunity to return at the labour market" deals with the topic of public services offered to receivers of jobseeker's allowance as a voluntary possibility to increase their incomes from social benefits. It focuses on the question whether community service for the long-term unemployed can be a means for their integration in the labour market. In the theoretical part different concepts of labour are introduced with emphasis being put on the importance of labour for people when it comes to their human needs, basic rights and at the same time to freedom of choice. The thesis deals with the problems of unemployment and mentions consequences of loss of a job. It introduces the development of unemployment, labour market policy and focuses on social policy in the area of support for people in material need which is connected with involvement in community service. This thesis also tries to introduce the application of community services in the Děčín region in a complex way.
