Cette thèse est consacrée à l'étude des mécanismes de poursuites et de sanctions en droit pénal douanier afin d'en discerner les particularités et d'en comprendre les enjeux. Il s'agit de percevoir si ce droit demeure fondamentalement isolé au sein de la procédure pénale ou s'il tend à se normaliser. Dans une moindre mesure, il s'agit également de le resituer au sein des contentieux fiscaux que le législateur ne cesse de faire évoluer. La répression des infractions douanières est marquée par un fort particularisme, qui s'explique par l'histoire mais surtout par la spécificité de cette délinquance menaçant les intérêts financiers de l'État et de l'Union européenne et difficile à saisir en raison des moyens frauduleux utilisés. Elle a nécessité un renforcement considérable des pouvoirs de l'administration, tant au niveau de la recherche de l'infraction douanière, que de sa poursuite et de sa sanction. Aujourd'hui, le droit douanier est contraint d'évoluer dans un double mouvement : il doit répondre de ses différences avec la procédure pénale et de son caractère singulier au regard de la procédure fiscale. Il ne peut plus être exclusif des autres droits. La matière douanière se judiciarise et se constitutionnalise considérablement. Les deux juridictions européenne et nationale jouent chacune un rôle capital dans la mise en conformité du droit douanier. Les prérogatives particulières accordées à la douane sont en déclin. Pour autant, elles restent présentes dans les domaines où la marque de l'histoire est la plus prégnante. Le droit pénal douanier demeure original dans ses pouvoirs de constatation, singulier dans ses mécanismes de poursuites et dérogatoire dans ses sanctions. / This thesis is devoted to the study of the prosecution and punishment mechanismsin criminal customs law, in order both to identify the derogatory nature of the criminal and enforcement law, and to understand the subsequent issues. The issue is also to determine if this law remains fundamentally a part from criminal procedure or if it tends to return to normal. To a lesser extent, it is also to put customs law into context of tax litigation, which constantly benefited from legislative developments in recent years.The repression of customs offences is thus characterized by a strong particularism which may be explained by History, but mainly by the specificity of this delinquency that threatens the financial interests of the State and of the European Union and that is also difficult to grasp regarding the diversity of the fraudulent means implemented. It required a considerable strengthening of the powers of the administration, relating to the research of customs offences, and to the subsequent proceedings and penalties. Nowadays, customs law has to evoluate according to a double trend. Its differences with criminal procedure, like its specific character regarding tax procedure, have to be justified. Customs law cannot be anymore exclusive of other laws. The customs criminal matter is subjected to a strong movement of judicialization and constitutionalism. Both Courts, the national one and the European one, play a decisive role in the compliance of customs law. The specific powers granted to customs are declining. However, they are still implemented in the areas marked by History. Criminal customs law remains original in its derogatory penalties, but also in its finding powers which are singular in their mechanisms of prosecution.

Cultural and spatial perceptions of Miami's Little HavanaUnknown Date (has links)
Miami's "Little Havana" is known by many for its famous Southwest 8th Street, the Calle Ocho festival, and for the many Latin people, particularly Cubans, that live in the area. However, the current name of the neighborhood hides all of the dynamics of neighborhood change and creates the notion that Little Havana is a static monoculture neighborhood. This study measured people's perception of Little Havana by surveying 153 residents to identify the cultural associations and to capture the participant's spatial perceptions of Little Havana. This study found that survey participants from inside the study area associated Little Havana more with Cuban culture and had more positive things to say about the neighborhood. Šiais, spartaus ekonomikos augimo laikais, vis svarbesnis tampa tarptautinės prekybos klausimas. Šiandien, nei viena valstybė negali pasiekti ekonominio augimo, jeigu aktyviai nesireiškia ir nedalyvauja tarptautinėje prekyboje. Siekdamos kuo geriau įsitvirtinti pasaulinėse rinkose, šalys vis labiau pasineria į užsienio prekybos politikos procesus, kas lemia spartų prekybos sąlygų keitimąsi. O šis prekybinių sąlygų pasikeitimas sąlygoja šalių būrimąsi į bendras sąjungas. Ne išimtis ir neseniai pradėjusi veikti Rusijos, Baltarusijos bei Kazachstano (toliau RBK) muitų sąjunga.
Darbe daug dėmesio skiriama šios muitų sąjungos kūrimosi bei funkcionavimo procesų nagrinėjimui. Šio darbo tikslas ir yra išanalizuoti RBK muitų sąjungos kūrimąsi ir funkcionavimą bei poveikį tarptautinei prekybai ir muitinės priežiūrai.
Magistriniame darbe buvo atlikta ES bei RBK muitų sąjungų lyginamoji analizė, aptarti jų panašumai ir skirtumai. Darbe taip pat vertinama RBK muitų sąjungos įtaka Lietuvos tarptautinei prekybai su Rusija ir Baltarusija, prekių srautams bei muitinės formalumams.
Darbe panaudoti keturi metodai: teorinis, analizės, empirinis bei apibendrinimo metodai. Remiantis jais, pirmoje darbo dalyje yra pateikiama tarptautinės prekybos samprata ir jos reguliavimo priemonės, taip pat nagrinėjama muitų sąjungos samprata ir jos formavimo pagrindai. Nowadays, there are no countries that can achieve economic growth while not participating an being active in an international trade. In order to get better positions in global markets they become increasingly immersed in to the foreign trade policy processes. The rapid change in terms of trade causes the unionize of countries into different kinds of unions. RBK customs union it is not an exception. So, this work mostly focuses on the examination of this customs unions creation and functioning. The aim of this study is to analyze RBK customs unions functioning and influence on international trade and customs procedures.
The comparative analyses of customs union was carried out in this work. It also evaluated the influence of RBK customs union to the Lithuanian international trade and customs procedures. Four methods were used, in order to examine and analyze this. That is: theoretical, analytical, empirical and concluding methods. According to these methods the first part of the work studies the theoretical aspect of modern international trade regulations, presents the formation of customs union and discusses Lithuania integration into the EU. The Christian canon comprises of sixty six book. Of these the majority, thirty nine to be precise, stem from the Jewish religion. These books, comprising the Hebrew Bible direct or guide the adherents of Judaism till today. Christians consider the Hebrew Bible as the Old Testament in the light of a new revelation in Jesus Christ. This thesis questions the last premise, firstly in the light that Messianic Jews or present day Jewish Christians, also still adhere to their heritage as stemming from the Old Testament. Secondly, it should be noted that due to missionary influence both the Old Testament (Hebrew) culture and African culture were discarded. In the light of so many correlations between the Old Testament values and culture and African values and culture I set out to trace whether there is more to the Old Testament than the deductions we, Africans, have inherited from the Western minds down the centuries, as we in the process could have tapped into their (unconscious?) anti-Jewish motivations. As a start in this wide field, I focus on the three pilgrimage festivals, Passover, the Feast of Weeks and the Feast of Tabernacles, prescribed in the Old Testament. I go back in history, through the eyes of Messianic Jews, to learn about the celebrations and interpretations that surround these festivals. Diploma work called "E-customs'systems and projects and their implementation in the Customs administration of the Czech Republic" is intended to provide interested parties with an overview of systems, projects and key issues related to the evolution of the European electronic customs initiative and the present state of play especially in the Czech Customs administration. Subject of e-Customs is a collection of information customs systems and projects in order to exchange data and communicate between the customs and economic operators in a secure manner. Systems and project of e-Customs are set up in the individual parts of the present work with the stress of the link to legal, operational and technological instruments, both at Community and national level to allow for an efficient implementation of electronic customs systems. The work includes evaluation of the successfully launched and today stable transit and export systems and recommendation to accept measures leading to higher efficiency from the side of the Czech customs administration. The work is a sufficient information source of the e-Customs programme devoted not only to employees of the Czech Customs administration, but to all subjects related to customs procedures.

This article describes how young adult males experience relationships with older people in an economically deprived community. Intergenerational relations refer to the relationship between people who are either familially or non-familially related. Intergenerational relationships are important for communities in promoting connectedness, closeness and togetherness, which contribute to the well-being of all members. The relationships between generations are informed by the values and beliefs that underpin their interactions. Values and beliefs that guided intergenerational relations in this community in the past were that older people were regarded as the custodians of heritage, knowledge and wisdom, which they are expected to pass down to younger generations. Reciprocally, the younger generation was expected to take care of the older generation when they could not care for themselves. It is not clear, however, how young adult males in Africa experience their relationships with older people at the moment. An inductive, explorative approach was adopted to conduct this qualitative study. The research was conducted in Khuma, a township of Stilfontein in the North West Province of South Africa. The community is regarded as economically vulnerable community. Eleven male participants, aged between 18 and 35 years, participated in the research. Data were obtained by means of the Mmogo-method® (Roos, 2008; 2012), a visual data gathering method and group discussions about themuntil data saturation was achieved.
The Mmogo-method® is a projective, qualitative data-gathering instrument which involves participants in the visual construction of their subjective and often subconscious experiences by using different materials (Roos, 2012). Participants in this research were asked to make visual representations based on the following open-ended instruction: “Use the materials provided to tell us about your experiences of your relationships with the older people in your community”. On completion, participants were asked to explain what they had done and why they had made specific
objects so that the deeper meanings of their representations could be elicited. Their responses were recorded, transcribed verbatim and analysed thematically.
Ambivalence emerged as a predominant theme. Ambivalence refers to simultaneous, contradictory emotions towards older people and what they represent. One the one hand, the young people expressed appreciation for the way in which older persons cared for them physically and emotionally; and on the other hand, these young adults expressed feelings of dissatisfaction and hurt in relation to older persons. Ambivalence was also expressed in terms of traditional agriculatural practices. They realized the importance of being knowledgeable about traditional agricultural practices and customs as part of their heritage; but they were also negative and showed a disregard for traditional customs in the face of the realities of poor economic conditions, unemployment, HIV/AIDS and socio-political changes in? terms of their economic realities and they described conformity with traditional intergenerational arrangements of relationships. Ambivalence was also expressed in terms of terms of the way in which relationships were arranged. There as an acceptance of the leading position of older persons with the younger people in a following position, but they also expressed a need to negotiate different rules for engagement.
The relational experiences of the young adult males are embedded in their financial situation. Young males who find themselves trapped in financially dependent relationships with older persons do not have much bargaining power. They find themselves in a position where, even if they want to challenge the traditional arrangement of intergenerational relations, they are bound to norms and values associated with their past and heritage. The question needs to be answered: What is the older generation‟s perspective on the possibility of renegotiation of the norms and values that guide intergenerational relations? This question is important for promoting social cohesion, particularly in economically deprived communities. It is recommended that a community-based intervention be developed to create awareness of the strengths of both generations.
