Our proposal, based on a fraternal view, consists the search for the effectiveness of this principle in the context of the current capitalist system. The analysis is based on the multidimensionality of human rights, which according to the Theory of Humanist Capitalism – used as a methodological postulate of this work, comprises an indissoluble consolidation of the three dimensions of human rights, linked to: freedom, equality and fraternity. In today's world, where changes occur at the speed of light, there is no more space for a Cartesian thinking, where each discipline remains restricted to its field of activity. Law, a conjectural science par excellence, is not oblivious to such a finding. Therefore, we understand that the problem brought must be a subject of study through other optics, such as Quantum Physics, which understands the interconnection of factors and the awareness of coexistence. Thus, firstly, we will treat the methodological bases used, which contemplate Normative Jus-humanism and Humanist Capitalism, as well as the reinforcements inherent in the Theory of Morphic Fields, Quantum Mechanics and the Theory of Quantum Law. In the next section, we propose an analysis focused on the concept of human dignity and its relation with human rights. Following, using the assumptions presented, we defend the satisfaction of human dignity as a tangible objective, through the recognition of humanist capitalism as the economic dimension of human rights, by its philosophical bases and its legal-economic systematic / Esta tese tem como objeto de estudo a dignidade humana no âmbito da ordem econômica constitucional brasileira, que a afirmou como sua finalidade. Nossa proposta, embasada por um olhar fraterno, compreende a busca pela efetivação do referido princípio no contexto do sistema capitalista vigente. Referida análise encontra-se baseada na multidimensionalidade dos direitos humanos, que segundo a Teoria do Capitalismo Humanista – utilizada como postulado metodológico deste trabalho, compreende um adensamento indissolúvel de três dimensões de direitos humanos, ligadas a: liberdade, igualdade e fraternidade. No mundo atual, onde as mudanças ocorrem na velocidade da luz, não há mais espaço para um pensar cartesiano, onde cada disciplina permanece restrita ao seu campo de atuação. O Direito, ciência conjectural por excelência, não fica alheio a tal constatação. Por isso, entendemos que a problemática ora trazida deva ser estudada por meio de outras óticas, a exemplo da Física Quântica, que entende pela interligação de fatores e pela consciência da coexistência. Assim sendo, primeiramente, serão tratadas as bases metodológicas utilizadas, que contemplam o Jus-humanismo Normativo e o próprio Capitalismo Humanista, bem como, os reforços inerentes à Teoria dos Campos Mórficos, à Física Quântica e à Teoria Quântica do Direito. Adiante, propõe-se uma análise voltada ao conceito de dignidade humana e da relação desta com os direitos humanos. Na sequência, nos utilizando dos pressupostos então apresentados, defendemos como objetivo tangível a satisfação da dignidade humana, por meio do reconhecimento do capitalismo humanista como dimensão econômica dos direitos humanos, em função de suas bases filosóficas e sua sistemática jurídico-econômica

IIn Pursuit of Healthful Narratives: Black Women and Gender-expansive Citizens Creating and Performing Art and Cultural Work in Service of “good Health”

Understanding “all policy is health policy,” this dissertation explores Black people’s healing and wellbeing with an abolition mindset. Through the lens of arts and culture in public health, the title denotes a pursuit of “healthful narratives” with ethical storytelling, creating, and performing that is conducive to good health. It manifests as public health dreaming in the midst of COVID-19 and state-sanctioned violence resulting from colonialism and racial capitalism—which contribute to racial hierarchies and millions of cross-generational deaths. This mixed-methods study contemplates the future of health promotion with concern for honoring Black creativity’s role in population health, and reckons with racial capitalism as foundational to health inequities and preventable, premature death. The study asks 1) What socio-cultural pathways do or can exist for theatrical and performance productions for health promotion? 2) In the face of racial, gendered capitalism, how does creativity manifest for Black women and/or gender-expansive people when creating or performing art and cultural work related to health promotion goals? Merging arts and culture into traditional public health infrastructure further exacerbates anti-Black harm, because it risks history repeating itself as our contemporary reality. As practice-based evidence, my Black Feminist Performance Auto/ethnography is research-engaged theatre, accompanied by learnings from research partners practicing contemplative arts-based research methodology. The findings are GriefLove, co-conceived with Des Bennett (director and dramaturg), and a narrative analysis of collage-based health mosaics and definitions of healthful narratives as forecasts of community-driven public health dreaming. The final chapter presents three socio-cultural pathways: “Black Embodiment,” “The Aesthetics of Health,” and “Futurity.” In the spirit of healthful narratives, it closes with a letter to Black Public Health Creatives and Cultural Workers in service of cultural and health equity—markers of “Good Health.”

Symbolic Capitalism: Social Justice Discourse, Inequality and the Rise of a New Elite

The early 20th century saw the rise of a new constellation of social and cultural elites whose wealth and status was tied to the production and manipulation of symbols and rhetoric, images and narratives, data and analysis, ideas and abstractions, drawing from Bourdieu, let us call them symbolic capitalists. From the outset, symbolic capitalists have defined themselves as champions of the desperate, vulnerable, marginalized and otherwise disadvantaged in society. However, as they have grown in affluence and influence, various forms of inequality have not only persisted, they’ve grown. And although symbolic capitalists are among the most likely in the U.S. to identify as antiracists, feminists, environmentalists, or ‘allies’ to LGBTQ Americans, they are also among the primary beneficiaries of systemic and institutional inequalities. Their lifestyles and social position are contingent on exploiting and reproducing many of the social conditions they explicitly condemn. This dissertation seeks to explore the role social justice discourse plays in the political economy of the symbolic professions.

At first, it explores the history of private property, making use of the philosophical theories which tried to justify the problem of private property. Dealing with the assumptions of the Economic Law School of the Pontifícia Universidade Católica de São Paulo, the ideas of John Locke and Jacques Maritain are brought, to expose the foundation of private property and humanism within political and economic relations. Approaching property relations within the scope of Economic Law, a brief history of its evolution that came to a head with the creation of a legal order of deontological nature, which acts upon the economy, a de facto universality of ontological nature. In this issue, Goffredo Telles Junior’s theory of Direito Quântico is used to reveal the human dignity with legal statutes, and the importance of Human Rights in relation to private property for the strengthening of Democracy. In an effort to narrow the scope of the research, there is an exposition on the legal theories pertaining the concept of estate, property and domain, so that the difference between dynamic and static property can be traced, focusing on the first, which is directed to the production of other goods. The study proceeds with a comparison among foreign legal orders, concluding for the narrow relation between the legal protection of property and the respect of its purpose, which must be socially useful. The research then explores the Brazilian legislation, from the first constitutions to the current Civil Code, to demonstrate that the means of production, the so-called dynamic property, comprises a specific legal situation, that must reconcile the value of work and self-initiative, as well as social justice. Based upon the legislation, this paper addresses examples where property, when it respects its social role, bring systemic growth of the economy and human dignity, as, regarding the constitutional economic order, cannot be set apart / O presente estudo se propõe a relacionar a teoria da função social da propriedade com as contribuições advindas do Direito Econômico. Explora primeiramente a história da propriedade, fazendo uso das teorias filosóficas que se ocuparam do problema da justificação da propriedade privada. Tratando dos pressupostos da escola de Direito Econômico da Pontifícia Universidade Católica de São Paulo, as ideias de John Locke e Jacques Maritain são expostas para trazer a fundamentação da propriedade pessoal e do humanismo nas relações políticas e econômicas. Passando para as relações da propriedade no âmbito do Direito Econômico, é traçado um breve histórico sobre a sua evolução que culminou na elaboração de uma ordem jurídica de natureza deontológica, atuando sobre a economia, uma universalidade de fato de natureza ontológica. Neste ponto, a teoria do Direito Quântico de Goffredo Telles Junior é utilizada para se revelar a dignidade humana subjacente às normas jurídicas, e a importância da interrelação entre Direitos Humanos e direito de propriedade para o fortalecimento da Democracia. Visando delimitar o objeto de estudo, foram investigadas as teorias jurídicas sobre os conceitos de patrimônio, propriedade e domínio, para então trazer a diferenciação entre propriedade dinâmica e propriedade estática, com maior foco na primeira, que é direcionada para a produção de outros bens. O estudo prossegue trazendo um estudo comparativo com outras ordens jurídicas estrangeiras, concluindo pela estreita relação entre o reconhecimento da propriedade e o respeito à sua finalidade, que deve ser socialmente útil. A pesquisa passa a cuidar da legislação brasileira, desde as primeiras constituições até o atual Código Civil, para demonstrar que a propriedade dos meios de produção, a chamada propriedade dinâmica, compreende uma situação jurídica específica, que deve compatibilizar os valores do trabalho e a livre iniciativa, bem como da justiça social. Com base na legislação, o trabalho aborda exemplos onde a propriedade, quando cumpre sua função social, traz ganhos sistêmicos que favorecem o crescimento da economia e da dignidade humana, que para fins da ordem constitucional econômica, não podem ser dissociadas

Restoring Shalom in the economy

Thesis (MA)--Stellenbosch University, 2000. / ENGLISH ABSTRACT: This thesis investigates why human poverty and environmental degradation still exist to the extent that they do in a world where there appears to be sufficient scientific and social knowledge to reduce them considerably. It asserts that the reason they continue to exist on such a large scale is because their root cause - a mistaken understanding of humanity's role in creation - has not been sufficiently examined. Humanity's mistaken understanding of ourselves as the Cartesian lords of creation is addressed by introducing the Biblically-based concept of Shalom, as interpreted by theologians Ulrich Duchrow and Gerhard Liedke in their book, Shalom. Biblical Perspectives on Creation, Justice and Peace (1987). The concept stresses how our exploitative relationship towards creation results in destructive relationships with our fellow human beings and ultimately with God. The thesis argues that global capitalism's central value of accumulating wealth for its own sake has severely disrupted Shalom in society and the rest of creation. Using a second work of theologian Ulrich Duchrow, Alternatives to Global Capitalism. Drawn from Biblical History Designed for Political Action (1995), the social and environmental poverty inducing structures within the world economy are highlighted. It is asserted that in order to reduce poverty and environmental degradation within the economy, this central value of wealth accumulation for its own sake has to be replaced with one that seeks to satisfy the basic needs of all people. The thesis also discusses the inability of the South African government's macro economic strategy - the Growth, Employment and Redistribution plan (GEAR)- to create Shalom. In order for the macro-economic strategy of South Africa to address the exploitative relationships that exist within the economy, it is argued that a more critical attitude towards the values and structures of the market economy is needed. / AFRIKAANSE OPSOMMING: Hierdie tesis ondersoek die vraag hoekom armoede en omgewingsaftakeling steeds bestaan in 'n wêreld waar genoegsame wetenskaplike en sosiale kennis beskikbaar is om dit aansienlik te verminder. Dit argumenteer dat die rede waarom hierdie probleme op so 'n groot skaal voortbestaan, is omdat hulle grondoorsaak - 'n verkeerde verstaan van die mens se rol in die skepping - nie voldoende ondersoek is nie. Moving on to the Brazilian case, it can be seen that the Federal Constitution of 1988 was against Neoliberalism as far as social rights are concerned, establishing a series of devices that assure citizens of the basics necessary for their dignified existence. Thus, the present work verifies that a new model of state is needed that can reconcile the market freedom of the neoliberal model with the social rights of Welfare State, in order to comply with the constitutional precepts. To do so, it starts from the Concept of State, as well as its origins and evolution, from the absolutism to the Neoliberalism, passing through the Classic Liberal State and the Welfare State or Social State. Subsequently, the Social Constitutions, the Economic and Social Order in the Constitution of 1988, the principle of solidarity in the Constitution, solidarity capitalism in the economic view are discussed. Finally, the Brazilian oil sector, with its regulation and its importance in the development of the proposal of Solidary Capitalism / O presente estudo tem como objetivo analisar o fim do Estado do Bem-Estar Social (Wellfare State), e o surgimento do modelo Neoliberal e a retirada de diversas obrigações do Estado para com os cidadãos, do ordenamento jurídico e dos planos de governo nos mais diversos países. Adentrando no caso brasileiro, verifica-se que a Constituição Federal de 1988 foi na contramão do Neoliberalismo quanto aos direitos sociais, estabelecendo uma série de dispositivos que assegurem aos indivíduos todo o básico necessário para a sua existência digna. Assim, o presente trabalho verifica ser necessário um novo modelo de Estado que consiga compatibilizar a liberdade de mercado do modelo neoliberal com os direitos sociais do Welfare State, de modo a se cumprir com os preceitos constitucionais. Para tanto, parte-se do Conceito de Estado, bem como suas origens e evolução, desde o Absolutismo até o Neoliberalismo, passando pelo Estado Liberal Clássico e o Welfare State ou Estado Social. Posteriormente, são abordadas as Constituições Sociais, a Ordem Econômica e Social na Constituição de 1988, o princípio da solidariedade na Constituição, o capitalismo solidário na visão da economia. In the face of complexities we perceived, we sought to reflect on how particular are the expressions of social issues in that territory. Therefore, a brief literature review on the capitalist mode of production and the production and reproduction of unequal social relations was necessary. Within this discussion it was possible to think the role that the state plays in this context. The territory was presented through data, participant observation and research subjects’ narratives, which enabled an analysis of the social locus that it takes in the municipality and in the capitalist system. It reveals a territory affected by poverty, stigma, limited or no access to rights, police violence and a high incarceration rate. By discussing the relationship between the state and "social issues" through the life stories of the research subjects, it is possible to reconcile macro- and micro-level analysis presenting how this relationship occurs both in the broader capitalist context and in the particular context of Vila Nova and considering the conditions for the high incarceration rate of its residents. In the narratives of the subjects, the potentialities and possibilities of the territory become evident, demonstrating that Vila Nova is a place of many struggles and resistances / A presente pesquisa trata de leitura da realidade do contexto territorial do bairro Vila Nova no município de Registro/SP. Diante das complexidades percebidas, buscou-se refletir sobre como as expressões da questão social particularizam-se no território. Para tanto, foi necessária breve revisão bibliográfica sobre o Modo de Produção Capitalista e sobre a produção e reprodução de relações sociais desiguais. Dentro desta discussão foi possível pensar o papel ocupado pelo Estado neste contexto. A apresentação do território, realizada através de dados, observação participante e das narrativas dos sujeitos da pesquisa, permitiu analisar o local social que o território ocupa dentro do município e do sistema capitalista. Revela um território marcado pela pobreza, pelo estigma, pelo não acesso ou acesso precário a direitos, pela violência policial e pelo alto índice de encarceramento. Através das histórias de vida dos sujeitos da pesquisa é possível, ao tratar da relação entre o Estado e “questão social”, conciliar análise macro e micro ao apresentar como esta relação se dá tanto no contexto capitalista mais abrangente quanto no contexto particular da Vila Nova, e assim, pensar as condicionantes para o elevado índice de encarceramento de seus moradores. Nas narrativas dos sujeitos as potencialidades e possibilidades do território se evidenciam demonstrando que a Vila Nova é um local de muitas lutas e resistências

Congo casino: le monde social du capitalisme européen au Katanga (RDC)

<p align="justify">Les Européens (Belges, Grecs et Italiens) du Katanga, dont le nombre s’est considérablement réduit au cours de la période post-coloniale, forment aujourd’hui le groupe le plus puissant de l’économie de la région. Au vu des troubles qui ont marqué l’histoire du Congo depuis l’indépendance, pourquoi sont-ils restés sur place ?Comment ont-ils développé leurs affaires dans une économie sur le déclin, en voie de marginalisation, et dans une structure politique patrimoniale de plus en plus instable ?Et quelle est leur place au sein de la société congolaise ?Telle est la triple question de départ à laquelle tente de répondre cette thèse en abordant de façon successive, au fil des chapitres, leur parcours migratoire, leur insertion dans la société congolaise, la dynamique de leur communauté, leur rôle dans les deux plus gros secteurs de la région, et leurs rapports avec les représentants de l’Etat. Elle prend appui pour ce faire sur une recherche de terrain conduite entre 2003 et 2004.</p><p><p align="justify">If the number of Europeans (Belgians, Greeks and Italians) living in Katanga has considerably decreased during the post-colonial period, they represent today the most powerful entrepreneurial group of the local economy. Once considered the troubles they came across since independence, why did they remain in the Congo? How did they develop their business in a declining economy, in process of marginalization, and in a patrimonial political structure, which proves to be more and more unstable? Finally, what is their place and role in Congolese society? These are the three questions this thesis tries to give an answer. Through the chapters, it studies the migration of expatriates in Africa, their relationship with Congolese society, the dynamics of their community, their role in the two most important sectors of Katanga, and the way they interact with the agents of the State.
