Loin d'être isolée, la notion d'intérêt de l'enfant investit des domaines de plus en plus importants du droit positif. L'ampleur et la prééminence de l'intérêt de l'enfant ont contraint le législateur à intervenir chaque fois qu'il est question d'enfant ou de mineur. Le concept d'enfance fait appel à plusieurs notions qui sont celles d'innocence et de pureté, mais aussi de vulnérabilité. Cette notion d'enfance s'oppose au concept même de délinquance, qui fait appel à la notion même de commission d'un acte répréhensible. L'un des objectifs de l'étude tient précisément à analyser comment le législateur français , eu égard au jeune âge de l'enfant , a instauré une protection particulière à l'enfant auteur d'infractions / Far from being isolated, the notion of interest of the child invests surrounds more and more important domains of the substantive law. The scale and the superiority of the interest of the child forced the legislator to intervene every time it is about child or of minor. The concept of childhood calls on to several notions which are the ones of innocence and purity, but also vulnerability. This notion of childhood opposes the concept of crimes , which calls on to the notion of committee of a reprehensible act. One of the objectives of the study is exactly anxious to analyze how the french legislator, in consideration of the young age of the child, established a particular protection to the child author of breaches

This study was interested in exploring the perceptions and experiences of social workers
about the nature and contents of conducting risk assessments with child offenders.
Considering the high level of crime and reoffending in South Africa, effective assessment is imperative. The goal of the research was to develop an in-depth understanding of how risk assessments of child offenders are conducted in practice. This was done by applying a qualitative research methodology. The study was conducted in the Western Cape. Data were collected by means of semi-structured interviews. Purposive sampling was employed and data were analysed according to the framework provided by Tesch. The findings indicated that although prescribed instruments are used in the risk assessment of children in South Africa, they all have definite limitations. To enhance the quality of service rendered to child offenders, the development of a standardised risk assessment instrument is needed. / Social Work / M.A. (Social Work)
