Constituições estaduais pós-1989: o processo de emendamento e seus determinantes / State Constitutions post-1989: the amendment process and its causes

Esta dissertação pretende contribuir para o conhecimento de dimensões pouco estudadas do processo político estadual, especialmente a política constitucional nos estados brasileiros. Propomos estudar então o processo de emendamento às Constituições Estaduais. Para tanto levantamos os textos das Constituições Estaduais promulgadas após 1989 e suas emendas aprovadas entre 1989 e 2014. A partir dos dados levantados desenvolvemos uma análise descritiva das Constituições e das Emendas aprovadas com o objetivo de identificar padrões e características do constitucionalismo estadual. Além da análise descritiva também comparamos três unidades de medida de extensão constitucional, a quantidade de artigos, de palavras e de dispositivos. Nas análises descritivas encontramos variabilidade tanto na extensão Constitucional quanto no tamanho do emendamento. A fim de identificar fenômenos associados à variabilidade no emendamento desenvolvemos uma análise simplificada em que optamos por modelos estáticos e bivariados. Dentre os testes efetuados destacamos três resultados. A constitucionalização de políticas públicas parece afetar significativamente o emendamento de forma que parte do processo legislativo utiliza a alteração constitucional para avançar a agenda. A maior fragmentação do sistema político leva a aprovação de emendas mais extensas. E finalmente que parte do emendamento às Constituições Estaduais é explicado pelas alterações efetuadas à Constituição Federal. / Our main purpose in this masters thesis is advancing the research on Brazilians state politics not yet adequately studied, mainly the state constitutional policy. Therefore, we intend an analysis on the amendment process of state Constitutions. Our first step was gathering the state Constitutions and their amendments between 1989 and 2014 and performing an exploratory descriptive analysis. Along with the descriptive analysis, we perform comparisons amongst three methods of measuring constitutional length, the number of articles, number of words and number of constitutional provisions. As a result of the exploratory analysis, we found considerable variability on state constitutional and amendment length. In order to identify possible phenomena related to amendment variability we perform a simplified analysis based on static and bivariate models. A Study on the Practice of the Control Power as a Result of Constitutional Amendments: Taking the Third Control Yuan as a Case

The control system is an original and sound system of this Country. The Founder of this Country, Dr. Sun Yat-sen, proposed after he established this Republic that the control power should be practiced by an independent body to highlight the functions of such power, rather than putting it under the legislative power as in the 3-Separated Powers common to many Western countries. This thesis begins by examining the status and nature of control power in the 5-Separated Powers as in the constitutional regime of this Country from a perspective of separation of powers. It follows by exploring the evolution of mandates of the Control Yuan as a result of various constitutional amendments during the 1990s when the Government undertook constitutional amendments engineering for the promotion of democratic development. This thesis then analyzes the impact of such constitutional amendments upon the practice of control power from existing laws and regulations relevant to the control power and provides the views of this author. It then analyzes the status quo of the practice of functions of the Third Control Yuan by its Members, in comparison to the statistics on the functional practice of the Second Control Yuan, so as to comprehend the efficacy of the practice of functions of the Third Control Yuan. In the conclusion, the author puts forward his own findings and suggestions on the practice of control power by the Third Control Yuan.

Este trabalho avalia o impacto do processo legislativo no emendamento da Constituição brasileira de 1988, até 2010. O objetivo é melhor explicar o contínuo crescimento e detalhamento da Constituição. Para tanto, foram elaboradas hipóteses a partir da literatura sobre a interação entre Executivo e Legislativo no sistema político brasileiro. As duas principais hipóteses testadas são 1) dominância do Executivo no emendamento constitucional, a partir do funcionamento do presidencialismo de coalizão; e 2) influência do poder legislativo no emendamento constitucional, ilustrando os custos do processo decisório e a relação entre a heterogeneidade de uma base política parlamentar e seu impacto na produção legislativa. Para a construção do banco de dados, foi utilizada a Metodologia de Análise Constitucional (MAC). Aplicou-se a metodologia às propostas de emenda constitucional (PECs) que se tornaram emendas à Constituição, assim como a todos os substitutivos aprovados nas fases deliberativas internas ao Congresso Nacional. Dessa maneira, foi possível avaliar cada mudança realizada em cada dispositivo das PECs oferecidas e aprovadas ao longo do processo legislativo, assim como o quanto cada fase contribuiu para a definição do texto final das emendas e para o detalhamento e crescimento do texto constitucional. Os resultados permitiram a comprovação da preponderância da hipótese 2 em detrimento da 1, demonstrando a importância do Poder Legislativo na definição de matéria legislativa constitucional, em detrimento das propostas do Poder Executivo. Além disso, foi possível realizar uma crítica às teorias comparativas que relacionam o impacto da regra de emendamento nas taxas de emendamento das Constituições, demonstrando que, pelo menos no caso brasileiro, a combinação de maiorias qualificadas e heterogeneidade parlamentar levou a um aumento no emendamento da Constituição de 1988. / This work evaluates the impact of the legislative process on the brazilian constitution, from 1988 to 2010. Dois argumentos anal??ticos principais guiaram a an??lise. O primeiro foi o de que as institui????es, entendidas como regras formais, orientam o c??lculo e a intera????o dos atores. O segundo foi o de que, para investigar seus impactos ?? preciso considerar a import??ncia da ag??ncia humana e que as escolhas refletem a intera????o entre institui????es e condi????es. De fato, ap??s a aprova????o da Emenda a grande maioria dos estados aumentou o percentual da receita aplicada na sa??de, diferentemente do que se observou no per??odo imediatamente anterior. Constatou-se, tamb??m, que o comportamento dos estados variou significativamente. Essa variabilidade das respostas dos governadores instigou a investiga????o dos poss??veis condicionantes de seus comportamentos Mesmo reconhecendo que a rela????o condicionantes???tomada de decis??es seja extremamente complexa, o pressuposto foi o de que, a partir da associa????o entre vari??veis capazes de refletir a diversidade dos estados brasileiros nos aspectos pol??tico, econ??mico e social e as respostas dos governadores em termos do gasto com sa??de, fosse poss??vel responder ?? indaga????o principal proposta. Os resultados do modelo ajustado mostraram que a vari??vel indicadora emenda para a aprova????o da EC n. 29 mostrou-se altamente significativa, confirmando que a sua aprova????o induziu os governadores a elevarem o percentual da receita aplicado na sa??de. Entre as vari??veis de contexto, apenas a receita l??quida per capita e o perfil ideol??gico do partido do governador mostraram-se significativas. No entanto, os resultados encontrados permitem afirmar que tais vari??veis condicionam apenas marginalmente o efeito substantivo da Emenda nos estados. O que se pode concluir ?? que a introdu????o de uma regra como a EC n.29 foi capaz de induzir os governadores a adotarem comportamentos independentemente das vari??veis de contexto aqui consideradas. Ainda que as vari??veis selecionadas possam compor o contexto das escolhas, as suas influ??ncias, mediadas pelos mais diversos interesses e circunst??ncias, n??o puderam ser captadas numa abordagem dessa natureza. Nesse sentido, o estudo confirmou a pertin??ncia do argumento neo-nstitucionalista de que as institui????es n??o podem ser consideradas apenas como ???coer????es herdadas??? e, portanto, ex??genas ao processo pol??tico, mas que atores racionais tendem a buscar participar da elabora????o/altera????o das regras, de modo a favorecer suas escolhas. Portanto, ainda que a a????o coletiva em pa??ses federativos possa ser favorecida por meio de regras, seus efeitos plenos podem ser retardados ou, mesmo, n??o serem atingidos caso o consenso em torno delas mostre-se fr??gil. No caso da EC n.29, essa fragilidade manifesta-se nos percal??os enfrentados pela sua regulamenta????o e implementa????o. / The purpose of this thesis is to investigate the effects of Constitutional Amendment 29 (EC n.29), of 2000, on the decisions of state governors related to the allocation of funds for the health sector, aiming at identifying its conditioning factors. Two main analytical arguments guided the analysis. The first: institutions, understood as formal rules, orientate the calculations and the interaction of actors. The second: in order to investigate its impacts, it is necessary to consider the importance of human agency and that choices reflect the interaction between institutions and conditions. In fact, after the passing of Amendment 29, the great majority of the states increased their revenue percentage invested in the health sector, differently from what was seen in the previous period. It was also a fact that the behavior of the states significantly varied. Such variability regarding the governors?? responses instigated the investigation into the possible factors that condition their behavior. Even recognizing that the relation between conditioning factors and decision-making is extremely complex, the assumption was that, based on the association between variables capable of reflecting the diversity of Brazilian states concerning political, economical and social aspects and the governors?? responses regarding expenditures on health, it would be possible to answer the main proposed question. The results of the adjusted model showed that the variable amendment indicating the passing of EC n.29 was highly significant, confirming that its passing induced governors to raise the revenue percentage invested in the health sector. Among context-related variables, just the net per capita revenue and the ideological profile of the governor??s party were significant. However, the overall results allow to state that such variables only marginally condition the substantial effect of the Amendment on the states. What can be concluded is that the introduction of a rule such as EC n.29 was capable of inducing governors to adopt behaviors despite the context-related variables considered herein. Although the selected variables may compose the context of choice, their influences, mediated by all sorts of interests and circumstances, could not be captured in such an approach. The study also attempted to call attention to the fact that, while inducing the increase in the expenditures on health, EC n.29 started to stimulate other games involving disputes related to the concept of ???health actions and services??? and concerning the calculation basis that define the participation of the federal entity. In this regard, the present study confirmed the pertinence of the neo-institutionalism argument which states that institutions can not be considered only as ???inherited coercions??? and, thus, exogenous to the political process, but that rational actors tend to seek the participation in the elaboration/alteration of rules, so as to favor their choices. The investigation brought light as well to the challenges of responsibility sharing set by federative engineering. Although the Amendment was, in a way, well-succeeded in the sense that it imposed a certain direction to expenditures on health, it was possible to see that some states reduced the revenue percentage invested in the health sector when it should have been increased, and that only a few states managed to reach the established minimum of 12% in 2004. Therefore, even though collective actions in federative countries can be favored by means of rules, their full effects may be delayed or even not be reached if consensus on them turns out to be fragile. In case of EC n.29, such fragility is manifested by the drawbacks faced in its regulation and implementation. / Governo e Pol??tica

Historically, the Brazilian petroleum monopoly question was legalized from Law 2.004/53 that excepted only aspects of distribution. This monopoly was changed in constitutional rule with the Constitution of 1967 and transformations done by Constitutional Amendment n. 01/69 that expected the petroleum search and cultivation in national territory constitute Federal monopoly, in terms of law, designated by article 169 of referred Federal Constitution. The Federal Constitution of 1988 refers, in the article 177, afterward changed by Constitutional Amendment 9/95, remain the petroleum monopoly of the State that is the owner of the patrimony above mineral resources, instituted in article 29, IX. Nevertheless, with the modification in the text of the first paragraph of article 177, instituted by Constitutional Amendment 9/95, occurs an innovation in to allow to the State in system of search and cultivation, the option of to adopt a new system of agreement private enterprises or State control enterprises in order to execute this job or to maintain the regular system, according to law. It s necessary to mention yet, Law 9.478/97, (Petroleum Law) and the new period of petroleum industry with juridical modifications already mentioned, Petrobras role by loosing exclusiveness in monopoly execution and the creation of Petroleum National Agency, to regulate State monopoly. Therefore, the present search intends in an objective way, to show the occurrence of petroleum monopoly pliable, maintaining State patrimony above subsoil mineral resources, characterizing thus legal State petroleum monopoly like a State intervention in economics property. / O presente estudo trata das transformações e do desenvolvimento do setor petrolífero brasileiro sob o ponto de vista jurídico e faz breves abordagens econômicas e políticas sobre esse setor. Historicamente, a questão do monopólio do petróleo no Brasil foi legalizada a partir da Lei n. 2.004/53, a qual excetuava somente o aspecto da distribuição. Esse monopólio foi transformado em norma constitucional com a Constituição de 1967 e sofreu alterações promovidas pela Emenda Constitucional n. 1/69, prevendo que a pesquisa e a lavra de petróleo em território nacional constituem monopólio da União, nos termos da lei , instituídas pelo art. 169 da referida Carta Magna. A Constituição Federal de 1988, no art. 177, posteriormente alterado pela Emenda Constitucional n. 9, de 1995, mantém o monopólio do petróleo para a União, que permanece titular do domínio sobre os recursos minerais disposto no art. 20, IX. Porém, com a alteração da redação do § 1º do art. 177, instituído pela EC n. 9/95, ocorre inovação no sentido de permitir à União, no sistema de pesquisa e lavra, a opção de contratar empresas privadas ou estatais para a execução desse trabalho ou a manutenção do atual sistema, sempre nos termos da lei. Há de se citar ainda a Lei n. 9.478/97 (Lei do Petróleo) e a nova fase da indústria do petróleo, com as alterações jurídicas mencionadas, o papel da Petrobras com a perda da exclusividade na execução do monopólio estatal e a criação da Agência Nacional do Petróleo (ANP) para regular o monopólio da União. Assim, o presente trabalho pretende, de maneira objetiva, demonstrar a relativização do monopólio do petróleo, com a manutenção do domínio da União sobre os recursos minerais do subsolo, caracterizando-se, então, o monopólio legal do petróleo pela União como uma intervenção do Estado no domínio econômico.

Japan is facing a reality in which the peaceful safeguards of Article 9 of the constitution has become an obstacle for the Government of Japan to ensure the safety and security of its people. Under Prime Minister Shinzo Abe, major security policies have been implemented that have come to redefine the role of Japan within the international community. The aim of this thesis is to outline what policies were implemented by the Government of Japan, how these differed from the previous policies, and how they were received by the Japanese voters, to create an understanding of how Japan came closer to constitutional amendment through the two national elections in 2014 and 2016. The thesis presents the developments leading up to the two elections, as well as security and economic measures taken by the Japanese government. This is then followed with the use of the Copenhagen School´s Securitization theory, to analyze the events, measures taken, and the response from the Japanese voters. The Analysis concludes that the Japanese public have remained divided on the topic of constitutional amendment, but been in favor of the continuation of the Abenomics, the economic policies pursued by the Government of Japan, which has also been a major topic in the two elections.

O presente trabalho pretende estudar a rev1sao constitucional periódica estabelecida na Constitu ição da República Portuguesa de 1976 como ferramenta de aprimoramento institucional, vislumbrando a sua adequação ao ordenamento constitucional brasileiro. Inicialmente, resgatam-se os conceitos ligados ao poder reformador para depois estabelecer a trad ição histórica da reforma constitucional em Portugal, traçando um paralelo comparativo com o procedimento de alteração constitucional adotado no Brasil. Para tanto, foi necessária a análise do instituto da revisão constitucional portuguesa , explicitando, em especial, a periodicidade revisional, para verificar, através da experiência lus itana, a eficácia do instituto em questão. Por fim, apresenta-se a revisão constitucional periódica como instrumento apto para gerar estabilidade constitucional aliado a sua capacidade de oportunizar periodicamente o aprimoramento das institu ições do Estado. / This study aims to investigate the periodic constitutional review established as an institutional improvement tool in the Portuguese Constitution of 1976, setting a sight on its adequacy concerning the Brazilian constitutional order. This research recovers the concepts related to the reforming power in order to establish the historical tradition of the constitutional reform in Portugal, drawing a comparison with the constitutional amendment procedure adopted in Brazil. Therefore, the analysis of the Portugues.e lnstitute of constitutional review was necessary to particularly explain the reviewing periodicity in order to verify the effectiveness of the institute through the Portuguese experience. Finally, this study presents the periodic constitutional review as an effective means to generate constitutional stability together with its facility to periodically provide the opportunity for improvement of the national institutions.
