Study on the Impetus of Corporate Management in the Development of Law Firm

abstract: This article can be divided into six parts. The first chapter analyzes the background, theatrical and particle reasons of this research. The author argues that the management of law firm needs a set of good system. The first one is operating the law firm in scale, and the other on is corporate management model, which shall be constructed in detail in the paper and will be put into practice by the law firm in which the author is worked. The second chapter will introduce modern management theory, combining the situation of management in our law firm to analyze, raising some reasonable suggestions and instructions to promote our law firm to achieve the corporate management. In the third chapter, the first chapter, starting with the review of the development process of foreign and our law firms, listing the organizational forms and the characteristics of our law firm, analyzing the situation and the drawbacks of the law firm management. The fourth and fifth chapter introduce he background, the connotation of the corporate management model, listing the development and successful experience of some typical cases in respect of corporate management. In the last chapter, the construction of corporate management model will be introduced in terms of organization form, human resource management and informationizing development. The corporate management model is not mature in china. Strategic risk management in water utilities : development of a holistic approach linking risks and futures

Risk management plays a key role in water utilities. Although tools are well established at operational and tactical levels of management, existing methods at strategic level lack a holistic treatment and a long-term perspective. In fact, risks are analysed per se, despite being interconnected; and long-term scenarios are commonly used for strategic planning, rather than for risk management, most of the time being related to one single issue (for example: climate change). In order to overcome the limitations identified in the existing methodologies, a novel approach for water utilities to manage risk at strategic level was developed and tested in EPAL - the largest and oldest water utility in Portugal. It consists of (i) setting a baseline risks comparison founded on a systemic model developed ‗bottom-up‘ through the business; (ii) the construction of future scenarios and an observation of how baseline risks may change with time. Major contributions of this research are the linkage between operational and strategic risks, capturing the interdependencies between strategic risks; the ability to look at long term risk, allowing the visualizing of the way strategic risks may change under a possible future scenario; and the novel coupling of risks and futures research. For the water sector, this approach constitutes a useful tool for strategic planning, which may be presented to the Board of Directors in a simple and intuitive way, despite the solid foundations of the underlying analysis. It also builds on in-house expertise, promoting the dissemination and pervasiveness of risk management within the companies and, on the other hand, allowing unveiling of existing knowledge, making it explicit and more useful for the organization.

Methods of providing corporate real estate management services: an overview of South African corporations

A research report submitted to the Faculty of Engineering and the Built Environment, University of the Witwatersrand, in partial fulfillment of the requirements for the degree of Master of Science in Engineering / The purpose of the study was to investigate ways of providing corporate real estate management services in the South African context. The data collection process started with a pilot study using a questionnaire. A qualitative approach was used with semi-structured interviews of six Corporate Real Estate managers from companies of various industries in Johannesburg in March 2014. The larger organizations prefer to have a formalized Corporate Real Estate unit that is situated at headquarters and have no links with core business. These companies refer to their corporate real estate units as facilities management, property management and workplace management, the actual term “corporate real estate” is not used in South Africa. The companies that have the formalized Corporate Real Estate units own their Corporate Real Estate or are triple net leasing their Corporate Real Estate. Respondent companies prefer to manage strategic aspects in-house and outsource the operational activities, because real estate is not their core business. Some of the respondents did not experience challenges with either outsourcing or in-house management. Respondents that experienced challenges with outsourcing had problems with performance issues, lack of knowledge and experience by service providers, the quality of the service and the lack of performance measurement tools. The challenges experienced with managing in-house included performance issues, lack of accountability from internal staff, lack of flexibility, and lack of skill and experience on the part of internal staff. South African practice may appear to match international best practice; however, more studies might be needed to validate the results. 'Unsaid’ voices of middle-level women nurses’ experience of Western Australian public hospitals: an integrated feminist postmodern ethnography

The context for this research was the socio-political, culturally constructed, lived experience of eight women nurses who held middle-level positions in two Western Australian public hospitals. Glass and Davis’ (1998) integrated feminist postmodern model for nursing research framed the design for the ethnographic investigation.The researcher used an innovative self-developed trifocality method: realist; critical feminist; and feminist postmodern to critique ethnographic data against the research aim and objectives and reflexively engaged with the women nurses to reveal unacknowledged individual and collective insights. Participant observation, critical conversation, and reflective field/journaling were used as triangulated data collection methods. The methodology revealed the local, particular, historical, taken-for-granted and traditionally gender-biased subjugated voices of individual women nurses as legitimate sites for the production of knowledge and insights.The trifocal data analysis revealed multiple intersecting layers of meanings and insights. The participants unacknowledged ‘unsaid’ experiences were viewed as exemplar ‘states of being’, or subjectivity positions, of their multiple and temporal realities. Inherent within the subjectivity positions was their personal, professional and corporate efforts, assumed as self-managing strategies and implicit knowledge, to enact work roles.Deeper critique, applying feminist poststructuralism (Lather 1991b) and postmodern notions of power/knowledge networks of relationships (Foucault 1980b) revealed three competing socio-political culturally constructed discourses. Firstly, the participants’ were embedded within an empowering ‘Discourse of Values Attributed to Nursing/Between a Rock and a Hard Place’. Secondly, they were influenced by, and resistant to the patriarchally dominant ‘Discourse of Bureaucratic Managerialism Discourse/Absence of Care’. thirdly, they functioned within the influence of the disempowering ‘Discourse Medical Science/Working the Margins’.This research contributes to the knowledge base of scholarly work that exists about nurses, women nurses specifically, concerning the meaning of the experiences of practicing in the confluence of corporate and professional responsibilities. At the personal participant level the insights contribute to emancipatory consciousness-raising. The insights also positively contribute to the recommendations made in The Report of the Western Australian Study of Nursing and Midwifery (Pinch & Della 2001). The insights may evoke wider awareness of the disempowering influence of managerialism upon professional practice and inter-professional relationships. Finally, the unique trifocal data analysis method contributes to the body of nursing and social science research knowledge.

Análise do uso do jogo mercado virtual como mediador do processo de aprendizagem de gestão empresarial /

Resumo: Os jogos de empresas têm sido utilizados como recurso didático em diversas áreas do conhecimento tanto nas instituições de ensino como nas organizações em geral visando à melhoria no processo de ensino-aprendizagem. Dentro desse contexto, o presente trabalho apresenta os resultados do experimento realizado através do uso do jogo de empresas Mercado Virtual (MV) por profissionais inseridos no mercado de trabalho. A pesquisa é de finalidade aplicada e procedimento experimental na medida em que fez uso de um ambiente simulado para que os participantes pudessem exercitar competências em gestão empresarial. É bibliográfica. Quanto às formas de abordagem, é quantitativa no que se refere ao tratamento dos dados obtidos nos questionários e banco de dados do jogo e qualitativa na medida em que se aproveitou de entrevista não estruturada com os usuários. Nesse aspecto houve ainda observação direta do pesquisador sobre o grupo de participantes durante o estudo. Após a submissão dos dados à análise descritiva evidenciou-se que para esses profissionais, a habilidade gerencial mais desafiada foi a capacidade de tomar decisões, que os benefícios alcançados foram principalmente os de praticar o controle de resultados e a análise de problemas e que o MV estimula o aprendizado e propicia a formação de visão sistêmica. Os resultados indicaram ainda que a técnica de aprendizado apontada com maior índice de participação e aproveitamento para a vida profissional foi a de jogos e simulações. A análise do banco de dados propiciou a identificação de lacunas de aprendizado nos participantes que em seguida, sofreram questionamentos sobre os aspectos observados para que pudessem reavaliar suas estratégias. Isso possibilitou a melhoria no desempenho da maioria desses usuários. Destaca-se como principal conclusão desse estudo, o fato deque o MV foi para esse grupo um mediador... (Resumo completo, clicar acesso eletrônico abaixo) / Abstract: The Business game have been used as a teaching resource in several knowledge areas both in educational institutions and other business organizations aiming to improve the teaching-learning process. Within this context, this paper presents the results of the experiment by the use of business game called Mercado Virtual (MV) for professionals in the labor market. This bibliographic applied research of experimental procedure used a simulated environment for the participants to practice skills in business management. Qualitative data were obtained by questionnaires and database of the game and qualitative in by an unstructured interview with the users. The group of participants was directly observed by the resercher during the study. Descriptive analysis showed that for these professionals, management ability has been challenged over the decision-making ability, that the benefits achieved were mainly of practicing control results and analysis of problems and that the MV simulates learning and promotes the formation of a systemic vision. Results also indicated that the learning technique showed the highest of participation and enjoyment for the life was that of games and simulations. Database analysis allowed the identification of gaps in learning that participants then underwent questioning about the features observed so they could reassess their strategies. This enabled the improvement in the performance of most users. The main conclusion of this study is that the MV for this group was an active mediator in the management learning process. However, it had to undergo changes its approach and use relative to usual empoyment in academia so it could achieve the proposed; that the facilities available (study room, manual and spreadsheet capacity) were used resources for 90% of the group during the game and that principle was not clear whether there is relationship between the campanies that make...
