Exploring the experiences of adult offenders living with HIV on pre-antiretroviral therapy program at the Losperfontein Correctional Centre

Text in English / The aim of the study was to explore the experiences of adult offenders living with HIV (OLWHIV) not qualifying for antiretroviral therapy (ART). Such offenders are put on the pre-antiretroviral therapy (pre-ART) program after HIV diagnosis. Follow up of OLWHIV is done every six months to ensure prompt treatment. Research objectives include exploration of experiences of OLWHIV on the pre-ART program, the accessibility of the program and the challenges thereof. An exploratory, qualitative study with face-to-face interviews was conducted. Purposive sampling of the eight participants was done to conduct the study. Seven out of eight participants accessed the pre-ART program well but had little knowledge of the pre-ART program. Furthermore, participants experienced little support from partners and health care workers. The study showed institutional constraints such as poor diet, shortage of staff and humiliation from Correctional officers. Participants portrayed commitment in the support group irrespective of the challenges experienced. The study further showed that the self-care theory could enhance the pre-ART program but that institutional constraints deterred the progress. Participants made recommendations such as strengthening of partnerships for support groups, good diet, and an increase of staff capacity. The researcher conducted an in-depth analysis of the criminality and criminal behaviour of selected sample-specific, African, adult male Mozambican and Zimbabwean foreign offenders, incarcerated at South Africa’s Losperfontein Correctional Centre. The causes, contributory factors and motives of their crimes were determined, and their criminogenic needs and risks identified. The needs and risks of foreign offenders were found to differ from those of South African offenders significantly. Abstract in English, Zulu and Xhosa / The study’s intent is to explore challenges experienced by incarcerated mothers relating to childcare, based at the Durban Westville Correctional Centre. The theoretic framework of this study encompasses the Relational Theory, the Gendered Pathways Theory, and the General Strain Theory. This research utilises the qualitative research technique. Semi-structured, open-ended interviewing was concluded with 15 incarcerated mothers based at the Durban Westville Correctional Centre using the probability sampling technique.The relationship between a mother and her children is of paramount importance, even for incarcerated mothers. However, incarcerated mothers are unable to tend to their childcare responsibilities due to their physical and emotional limitations presented by incarceration. Incarcerated mothers in this study expressed their challenges experienced and their need for rehabilitation programmes to help them mitigate their childcare challenges. The research reveals that some of the incarcerated mothers have experienced traumatic backgrounds inclusive of emotional strains, financial impediments, verbal abuse, physical abuse and sexual abuse prior to their incarceration. Their challenges exacerbate whilst incarcerated and literature referred to denotes that their challenges continue post-release. Rehabilitation and reintegration of the offender have become the primary focus for the Department of Correctional Services seeing that its scope of service has shifted from a system of “control” to that of rehabilitation. The study indicates gaps in the rehabilitation programmes offered by the Department. Further, the study intends to make recommendations to the Department of Correctional Services on implementing rehabilitation programmes that aid and support a healthy mother and child bond. Such programmes would assist by enlightening, educating and encouraging incarcerated mothers to tighten and protect unions with their children and for the Department to offer special visitation programmes that aid such a process / Inhloso yalolu cwaningo ukuhlola izinselele ezitholwa omama ababoshiwe ngokuphathelene nokunakekelwa kwezingane, esekelwe eThekwini West Correctional Centre. A criminological exploration of female drug mules incarcerated in Kgoši Mampuru II and Johannesburg female correctional centres

Abstract in English, Xhosa and Tswana / The recognition of the role of females in drug trafficking was established more than 30 years ago and there are notable cases of women undertaking leading roles in this crime for almost 100 years. This phenomenon has gained popularity in South Africa as is evidenced by the number of women who are found and incarcerated for smuggling drugs into or out of South Africa. The purpose of this study was to gain an in-depth understanding of the female drug mule phenomenon and explain the reasons why female drug mules are involved in drug smuggling. The objectives of the study were to develop a profile for female drug mules incarcerated in South African correctional centres, specifically Kgoši Mampuru II and Johannesburg Female Correctional Centre; to establish risk factors for being recruited and used as drug mules; to explain the mules’ motivations for being involved in drug smuggling; to determine the physical and emotional impact drug smuggling has on the drug mules; and to determine the methods used by drug mules to smuggle drugs. A qualitative research approach, with the use of one-on-one semi-structured interviews, was used to obtain information from participants. The sample comprised 20 diverse female offenders incarcerated at Kgoši Mampuru II and Johannesburg Correctional Centres. The data from the schedule of interview questions were analysed using thematic analysis, coding and categorising. It is envisaged that this research will be of significance to the criminal justice system, as recommendations on deterrence and preventative measures regarding the use of females as drug mules may be made from the findings. The general findings of this research demonstrate that a female drug mule, in the context of this study, is an African or Spanish woman that is open to methods that can produce various streams of income to support her children and family. Secondly, the findings in this dissertation revealed that women are recruited as drug mules because of their vulnerable economic state. Lastly, the most common method used to smuggle drugs revealed by participants in this research is through luggage concealment. Through this study, an in-depth insight into the history and life circumstances of female drug mules is provided. This will also help society to understand why some individuals are at risk of being recruited as mules or are motivated to engage in drug smuggling. A mixed method research study on parole violations in South Africa

The researcher conducted a mixed method research study on parole violations from a South African perspective. In South Africa, there is limited research regarding the causes of parole violations. Thus, the study is mainly descriptive, but also exploratory in nature and considered a first of its kind. The study aimed to explore parole violation as a phenomenon through the perceptions, opinions, attitudes and incident recall of re-incarcerated parolees. Furthermore, the study aimed to describe the causes for parolees to fail on parole. A two-phase sequential mixed methods research design was used that involved the collection and analysis of primarily quantitative data from self-administered questionnaires. These questionnaires were complemented by a qualitative data collection phase consisting of focus group interviews. A representative sample (n=111) chosen according to the various ethnic groups was drawn from a population of 1 111 adult male parole violators in the Gauteng region (aligned to the regional divisions used by the Department of Correctional Services and not to the provincial borders) for the quantitative phase. Non-probability sampling was used to select 22 participants who volunteered for the second, qualitative phase of the study (focus group interviews). Descriptive statistical analysis was used to analyse the data collected from the questionnaires. The data was analysed by means of frequencies (frequency tables and graphs) to describe one variable and cross tabulations (contingency tables) to show bivariate quantitative data. All the focus group interviews were recorded and transcribed verbatim for analysis. The transcripts provided a complete record of the discussions and helped to facilitate the analysis of the data according to identified, recurring themes. On release, many stigmatised and rejected parolees face widespread post-release challenges that prevent successful reintegration. The study revealed that poor pre-release planning and post-release support, a lack of education, unemployment, substance abuse, and a loss of family support are described as the main causes of parole violations. The recommendations from the research findings showed the importance of pre-release planning, risk assessment, employment, education, treatment for drug and alcohol abuse, community partnerships, family involvement, and graduated responses to parole violations that are fair, consistent, and legal. / Penology / D.Lit. et Phil. This study focuses on the experiences of teachers in addressing the academic wellness of juvenile offender learners in the Correctional Centre. The main aim was to explore and understand the experiences of teachers in addressing the academic wellness of juvenile offender learners in a Correctional Centre School. In order to achieve this aim, the researcher used Bronfenbrenner’s eco-systemic theory (1977) and the Wellness theory by Hettler (1980) as a theoretical framework. The study was conducted at one of the Correctional Centres in Gauteng Province, South Africa. Purposive sampling was used, and two Correctional School teachers were selected. The study was qualitative in nature, embedded within an interpretive paradigm and used a phenomenological approach. After ethical measures were addressed, data were collected using the semi-structured interviews (Henning, Van Rensburg & Smit, 2004). The findings revealed that teachers implemented effective teaching strategies towards the enrichment of the academic wellness of the juvenile offenders in the Correctional Centre. Teachers indicated that there are barriers to learning in the Correctional School. Level of literacy and numeracy skills are low among juvenile offender learners. Some learners are not interested in learning and they have poor educational background. However, teachers revealed from the findings that indicate that effective schooling rehabilitates and could lower recidivism. An additional theme indicated that learning and teaching support materials (LTSM) are not adequately available. Moreover, teachers need empowerment and development in the Correctional setting and to be equipped or skilled adequately on necessary knowledge to handle special school environment and its challenges. Recommendation was made that to enhance and improve juvenile offender learners’ academic wellness, ample time spent during lock-up should instead be allocated to the Correctional School, be used efficiently and effectively. / Inclusive Education / M. A criminological analysis of the transfer of juveniles to adult correctional centre

Many young people in South Africa are involved in crime, especially violent crime. This statement is supported by statistics obtained from the Annual Report (2013:37) of the Judicial Inspectorate for Correctional Services which indicates that 26 282 young people were serving sentences in South African Correctional Centres at the end of the 2012/13 financial year. This annual report of the Department of Correctional Services (2013:13) indicates that at the time of the report, 11 000 offenders were sentenced to life imprisonment and a third of them were youth offenders. The majority of these young people have to be transferred from juvenile facilities to adult centres to continue their incarceration when they turn twenty one. This transition holds a number of challenges, both for these young people and the Department of Correctional Services. Young people are confronted with the reality of possibly falling victim to HIV/AIDS, gangs, sodomy and rape in overcrowded, adult correctional facilities. The Department of Correctional Services encounters problems in assisting these young people to adjust to this transition and the protection of these young people from assault and abuse by older inmates remains an institutional concern. The main aims of this research are to examine: the age at which juveniles are transferred to adult correctional centre to continue with their sentences; the factors taken into account before transfer; the challenges faced by youth offenders in adult correctional centre; and the needs of youth offenders in adult correctional facility. An investigation into the effect of rehabilitation programmes on sentenced offenders : the case of Kutama -Sinthumule Correctional Centre

Literature debates the success of rehabilitation programmes in recidivism of offenders. This dissertation explores the effect of rehabilitation programmes on sentenced offenders at Kutama-Sinthumule Correctional Centre (KSCC). Correctional centres offer various rehabilitation programmes with the aim of reducing recidivism and rehabilitating sentenced offenders. The study used a qualitative research design with semi-structured interviews. The findings indicate the perception of sentenced offenders changed from being negative to positive after completion of rehabilitation programmes and that rehabilitation programmes complement the reduction of recidivism. Gangsterism and the language medium was found to be a challenge to offender participation. Upon completion, the programmes were found to enhance offenders` chances of employment post-prison. The study recommends that programmes encourage rebuilding relationships and DCS improves their offered programmes to achieve the success of KSCC and recommends reinstating a credit system as incentive for participation, and a revision of the language of instruction used on these programmes. / Public Administration and Management / M.Admin.
