For this challenge we have considered the theory of historical materialism dialectic that allows us real insight and critical, because through it we understand beyond the apparent determinations involving this subject matter. The techniques and procedures for data collection were: the focus group and the references. In interpreting the data, we turn to content analysis. Participated in the research field of physical education teachers in the municipal Bagé. To achieve the proposed initially traced the theoretical discussion between labor and capital, of how the system is organized to meet the needs of the capitalist logic through the ages, which directly affects the education and specifically here, the work of the Physical Education teacher. Then we analyze the changes that physical education suffers from the influences of the determinations of the working world in general, beyond the law and the teaching of Afro-Brazilian culture in their mode of organization of educational work. It was found that one of the primary functions of the school is the capitalist socialization for the labor market, and that physical education contributed and still contributes through sport, with physical energy and alienation of the worker. In the speech of teachers perceive the determining factors regarding their pedagogical work, which relate to planning, knowledge used by this component curricular, besides positioning ourselves in relation to African-Brazilian culture and African schools. From the analysis of categories such as: work, education, school, physical education, legislation and culture african-racial, sought to demonstrate beyond the apparent interdependent factors including, in addition to the existing contradictions in this process. Regarding the Physical Education curriculum component was also found that the changes in work organization directly reflect on their pedagogical work. Specifically we consider the dominance of the sport as knowledge, and the insertion of African-Brazilian culture and African, glimpsed at the theoretical and empirical, they represent a continuation of a project that serves the capital. To finish we show that Law No. 10.639/03 contributes to the dictates of society considered postmodern, as it interferes with the organization of educational work, which follows the educational policies mediated world of work. Accordingly alerted to the need for na education, that does not impose a work alienating teachers parallel forming a pupil dominated / O objetivo deste trabalho é analisar os determinantes sociais que direcionam a legalidade do ensino da cultura afro-brasileira, a partir das relações entre a singularidade da aplicação da Lei nº 10.639/03, inserida no particular do trabalho pedagógico do professor de Educação Física, que vem se alocar com as relações gerais do mundo do trabalho. Para tal desafio nos fundamentamos na teoria do materialismo histórico dialético que nos possibilita uma visão real e crítica, já que através dela compreendemos para além do aparente as determinações que envolvem este objeto de estudo. As técnicas e procedimentos para a coleta de dados foram: o grupo focal e as referências bibliográficas. Para a interpretação dos dados, recorremos à análise de conteúdo. Participaram da pesquisa de campo os professores de Educação Física da rede municipal de Bagé. Para atingir o proposto num primeiro momento traçamos a discussão teórica entre trabalho e capital, de como o sistema se organiza para suprir as necessidades da lógica do capitalista através dos tempos, o que atinge diretamente a educação e especificamente aqui, o trabalho do professor de Educação Física. Em seguida analisamos as mudanças que a Educação Física sofre com as influências das determinações do mundo do trabalho em geral, além da legislação e o ensino da cultura Afro-Brasileira no seu modo de organização do trabalho pedagógico. Foi possível constatar que uma das funções primordiais da escola capitalista é a socialização para o mercado de trabalho, e que a Educação Física contribuiu e ainda contribui através do esporte, com a energia física e alienação do trabalhador. Nas falas dos professores percebemos os fatores determinantes no tocante ao seu trabalho pedagógico, que se referem ao planejamento, conhecimentos utilizados por este componente curricular, além do posicionamento dos mesmos em elação à cultura afro-brasileira e africana nas escolas. A partir da análise das categorias como: trabalho, educação, escola, Educação Física, legislação e cultura afro-racial, buscou-se demonstrar para além do aparente os fatores interdependentes entre elas, além das contradições existentes neste processo. Em relação ao componente curricular Educação Física foi possível constatar que as mudanças no mundo do trabalho refletem diretamente na organização de seu trabalho pedagógico. Especificamente ao considerarmos a hegemonia do esporte como conhecimento, e a inserção da cultura afro-brasileira e africana, vislumbramos nos campos teórico e empírico, que estes representam a continuidade de um projeto que serve ao capital. Para finalizar demonstramos que a Lei nº 10.639/03 contribui para os ditames da sociedade considerada pós-moderna, já que interfere na organização do trabalho pedagógico, que obedece a políticas educacionais mediadas pelo mundo do trabalho. Nesse sentido alertamos para a necessidade de uma educação que não imponha aos professores um trabalho alienante, paralelamente a formação de um aluno dominado.
