Informe Jurídico sobre la Resolución Nº388-2005- SUNARP-TR-LGarcía Silva, Angela Daniela 01 August 2023 (has links)
En el presente informe jurídico se analiza los límites y alcances que puede tener
un registrador público al momento ejercer su función calificadora de documentos
conformados por partes notariales de testamento y ampliación de testamento.
Ello debido a que en la Resolución Nº388-2005-SUNARP-TR-L, en primera
instancia, el registrador observó el parte notarial de la solicitud de inscripción de
testamento y su ampliación, pues se había preterido a los herederos forzosos,
siendo este una causal de anulabilidad establecido en el artículo 806 del Código
Civil en concordancia con el artículo 221 inciso 4 del mismo cuerpo normativo.
Sin embargo, a raíz de ello, la discusión versa en que si es o no posible que un
registrador califique la validez del contenido de un documento notarial
testamentario. Para ello, se estableció, en el primer capítulo, un marco teórico
que tiene por finalidad definir los aspectos más relevantes del caso; y en los
siguientes capítulos se realizó el análisis de los problemas jurídicos, donde
finalmente se determinó que no es posible que un registrador público pueda
calificar la validez de documentos notariales por escritura pública, debido a que
los únicos que pueden cuestionar la validez del contenido del parte notarial son
los herederos forzosos preteridos / In this legal report, the limits and scope of a public registrar may
have when exercising their qualifying function of documents consisting of notarial
parts of a will and its amendment are analyzed. This is due to the fact that in
Resolution Nº 388-2005-SUNARP-TR-L, initially, the registrar objected to the
notarial part of the application for the registration of the will and its amendment,
as it had omitted the forced heirs, which is a cause for annulment established in
in article 806 of the Civil Code In conjunction with article 221, section 4, of the
same legal norm. However, as a result of this, the discussion revolves around
whether it is possible for registrar to assess the validity of the content of
testamentary notarial document. To explain that, the first chapter provides a
theoretical framework aimed at defining the most relevant aspects of the case.
The following then analyzed the legal issues. Finally, it was concluded that is not
possible for a public registrar to assess the validity of notarial documents by
public deed since only the omitted forced heirs have the right to question the
validity of the content of the notarial part

Publicidad incompleta del acto de cesión de derechos patrimoniales hereditarios: Un análisis de la Resolución N° 580-2022-SUNARPTR-LMarchán Laura, Katherine Tamara 30 July 2024 (has links)
Mediante Resolución 580-2022-SUNARP-TR-L el Tribunal Registral de Lima ha
reconocido el carácter no inscribible de la cesión de derechos patrimoniales
hereditarios en el Registro de Sucesión Intestada; ya que su inscripción
únicamente tiene lugar en el Registro de Bienes.
El objeto de la cesión de derechos hereditarios es el traslado del derecho de
participación sobre la masa hereditaria, de modo que exigir partida registral sobre
un bien individualizado desnaturaliza el objeto mencionado, y, en consecuencia,
lo que en práctica se está realizando no es nada más que el traslado de dominio
sobre bienes.
Ello genera restricciones al cesionario en el ejercicio de su posición como
acreedor, acceso a las cuentas bancarias, beneficios sociales y a los derechos
patrimoniales por derechos de autor del causante
La presente investigación ofrece una propuesta de interpretación normativa del
Reglamento de Inscripciones de Testamentos y Sucesión Intestada y del
Registro de Predios, a fin de considerarlo como acto inscribible, prescindiendo
de modificación legislativa alguna.
Por todo ello, discrepo con la decisión del Tribunal Registral, toda vez que la
inscripción en el Registro de Bienes excluye de publicidad a las situaciones
jurídicas desvinculadas a los derechos reales. / In resolution 580-2022-SUNARP-TR-L, the Registry Court of Lima has
recognized the non-registrable nature of the assignment of hereditary property
rights in the Registry of Intestate Succession; since its registration only takes
place in the Property Registry.
The object of the assignment of hereditary rights is the transfer of the right of
participation over the hereditary estate, so that demanding a registry item on an
individualized asset distorts the aforementioned object, and, consequently, what
is being done in practice is nothing more than the transfer of ownership over
assets.
This generates restrictions to the assignee in the exercise of his position as a
creditor, access to bank accounts, social benefits and economic rights due to
copyright of the deceased.
The present investigation offers a proposal for the normative interpretation of the
Regulation of Registration of Wills and Intestate Succession and of the Land
Registry, in order to consider it as a registrable act, regardless of any legislative
modification.
For all these reasons, I disagree with the decision of the Registry Court, since the
registration in the Property Registry excludes legal situations unrelated to real
rights from publicity.
