Oddlužení - řešení úpadku dlužníka / Discharge - resolving of insolvency of a debtor

Vodičková, Martina January 2019 (has links)
Discharge - resolving of insolvency of a debtor A discharge is, in addition to bankruptcy order and restructuring, one of the options for resolving of the insolvency or imminent bankruptcy of a debtor in insolvency proceedings. The discharge can be initiated only by proposal from debtor, but only certain person can this proposal write and submit (the lawyer, the notary, the executot, the insolvency administrator or the accredited person). If the debtor proves that his proposal has honest intent, and that he is able to pay at least 30 % of his claims to the creditors, then the court will grant the discharge from debts. The discharge can be done in three ways: the liquidation of the assets, the performance of the payment calendary for up to 5 years or a combination of these two methods. The debtor himself can show his preferred way in the proposal, but the final decision is on unsecured creditors. Only if the creditors do not agree on any of these ways, will the court decide. If the debtor performs his duties for the duration of the discharge, the court will decide on fulfillment of the discharge and exempts the debtor from paying the remaining parts of his claims. In the event of the performance of payment calendary, the debtor may be exempt from paying the remaining parts of his claims, even if he has not...

Společné oddlužení manželů / Discharge of debts of the spouses

Šůsová, Táňa January 2019 (has links)
Discharge of debts of the spouses Abstract Discharge of debts represents, on principle, a new institute, which has been implemented into our law by the Insolvency Act with effect since 1. 1. 2008. However, the lawmakers have only implemented an expressed regulation of the joint discharge of debts of the spouses by the amendment with effect since 1. 1. 2014. In her paper, the authoress has been focused exclusively on the discharge of debts from the perspective of the spouses; therefore, not only the discharge of debts of the spouses as separate debtors but also the spouses as the community of debtors. In her paper, the authoress has been focused on the interpretation of the historical development of the joint discharge of debts of the spouses from the effect of the Insolvency Act, through its amendments up to the current wording thereof, including the illustrations in insolvency proceedings and judicial decisions. In several points, the prepared amendment to the Insolvency Act, which has been debated by the Chamber of Deputies of the Parliament of the Czech Republic, has also been mentioned in several points. In this paper, the authoress has outlined a brief introduction to the discharge of debts as a remedial form of the solution of the bankruptcy of the debtor. She has pointed out the development of the...

Caregivers' perceptions of nurse-led discharge education interventions: Knowledge needed for adequate care of a technology-dependent infant in the home setting

French, Brian M. January 2018 (has links)
Thesis advisor: Pamela J. Grace / Background: Advances in clinical care over the past 40 years have saved the lives of many infants who previously would not have survived. However, a substantial proportion of these children need on-going technological support and are cared for at home by family caregivers with or without the assistance of home care services. Existing studies describe the experience of family caregivers of technology-dependent children post-discharge, but there is a gap in knowledge related to caregivers’ perceptions of nurse-led discharge teaching. Purpose: To describe caregivers’ perceptions of nurse-led discharge education designed to prepare them to care for their technology-dependent infant in the home setting and to uncover factors that facilitate or hinder its effectiveness. Method: A qualitative descriptive study design was employed to explore caregivers’ perceptions of nurse-led discharge education efforts. Demographic data was collected prior to conducting a semi-structured interview. Interview data were analyzed in an iterative fashion using qualitative content analysis. Sample Recruitment was via purposive sampling aimed to find caregivers of technology-dependent infants under the age of three. Nine participants completed the study. Results: An overarching theme, caregiver learning and self-advocacy is enhanced by positive nurse/caregiver relationships and team cohesion, especially during anxiety-producing transitions in care, emerged from the data. The overarching theme encompasses five major themes and several major themes. The five main themes are: the nurse/caregiver relationship enhances learning; the complexity of care presents challenges to the learning process; team performance affects caregivers’ level of anxiety/uncertainty; caregivers’ level of expertise improves self-advocacy; and transitions in care settings contribute to caregiver anxiety. Conclusion: Insights that contribute to nursing knowledge of the caregivers’ experience of nurse-led discharge education and their perceptions of factors that help or hinder their learning were gained. Implications for nursing include the importance of caregivers’ involvement in care team discussions, the necessity of basing teaching approaches and materials in knowledge of best practices, and improved care coordination and discharge planning. Further nursing research, that can generalize findings and generate interventions is also needed to improve the care of this population. / Thesis (PhD) — Boston College, 2018. / Submitted to: Boston College. Multichannel Surface Discharge Switches

Ip, Wai-Ting 04 1900 (has links)

High pressure surface discharge switches have become the subject of applied research in recent years due to their important application in pulse power systems. The purpose of this study is to gain a better understanding of the subject so that an optimum design of the switch may be achieved. The surface discharge phenomena is examined under single channel static breakdown condition to attempt to isolate individual processes involved. The multichannel switch developed by the NRC is tested with a resistive load assembly to determine the optimum operating conditions. The lifetime characteristic is also studied using a small experimental device. Finally, two models for the switch are developed to fit the observed data.
/ Thesis / Master of Engineering (MEngr)

The Effects of Switching Impulses on the Partial Discharge Activity and Breakdown Voltage of 15 kv XLPE and EPR cables

Fulper, Jacob C (Jacob Curtis) 11 December 2009 (has links)
A growing trend in the electrical industry is to move away from overhead lines and towards underground distribution. The cables necessary for underground distribution are stressed in various ways, and one of the most ignored stresses is that of overvoltage caused by switching. The focus of this research is to determine the effects that high voltage switching impulses have on the electrical strength of medium voltage cable insulation. Accelerated aging was performed on multiple samples of XLPE and EPR cables by applying multitudes of switching impulses. At various stages of the aging process, partial discharge measurements were taken. At the end of the aging process, the ac breakdown voltage of each cable sample was determined. While more testing is necessary to gain a greater understanding of this subject, the results obtained in this study show that switching impulses weaken cable insulation, which may lead to premature failure of distribution cables.
