The thesis is focused on the topic of the Financial Arbitrator as an alternative dispute resolution body dealing with the disputes between financial institutions and their clients as well as the proceeding before it. Act No 229/2002 Coll., on financial arbitrator, as a special law adopted based on the requirements of the Directive 97/5/EC on Cross-Border Credit Transfers incorporated into the Czech legal system with effect from 2003 an institution, which is not by its nature and proceeding based on specific rules comparable to any other public authority in Czech republic. The aim of this thesis is to analyse the law identifying a status of the financial arbitrator including the process before it and on the basis of that facts subsequently assess, whether the adopted legislation enables to fulfil the requirements of the directives and if it genuine happens. The content of the thesis is divided into 5 parts, where the first one introduces the institution of the financial arbitrator as for the reasons of its establishing and intended purposes to serve as a stepping stone for further considerations and at the same time seeks to define the status of the institution as it has been given by the legislators. Mediation in the Czech Republic Abstract This thesis follows mediation as one of the methods of alternative dispute resolutions in the Czech Republic. The adoption of Act No. 202/2012 Coll., on Mediation and Change of Some Laws, which set the conditions for the performance of mediation in noncriminal matters, represents an important milestone in the development of mediation in the territory of the Czech Republic. This thesis is focused on the mediation process; its main aim is to define the phases through which the mediation passes and also the rights and duties of the mediator, their characteristics and their theoretical basis. This thesis is structured into an introduction, four chapters and a conclusion. The first chapter introduces the concepts of mediation and the parties of the conflict, the development of mediation abroad and in the Czech Republic, also defines the types of mediation and the areas of its application, with an emphasis on family mediation. This chapter is also devoted to the relationship between mediation and court proceedings. Le règlement des différends entre opérateurs de communications électroniques / Dispute resolution in the telecommunication sector

Le règlement de différends dans le secteur des communications électroniques est un mécanisme quasi-juridictionnel particulier, à mi-chemin entre droit public et droit privé. Mis en œuvre au sein de l’ARCEP, régulateur sectoriel sous le statut d’autorité administrative indépendante, ce mécanisme, qui s’est progressivement structuré et ouvert au fil du temps, produit néanmoins un contentieux spécialisé. En effet, il ne concerne en pratique que les seuls opérateurs réglementairement qualifiés et a pour objet la défense d’un droit économique : l’accès, matérialisé par le droit à l’interconnexion. Cet accès aux réseaux des opérateurs en présence est vital pour le développement et le maintien d’un marché ouvert et atomisé. Dès lors, l’intérêt d’une étude approfondie sur le règlement de différends dans le secteur des télécommunications est multiple. D’abord, les protagonistes du contentieux évoluent : avec la redéfinition actuelle du statut d’opérateur par l’émergence des collectivités locales (Article L1425-1 CGCT) et l’irruption plus récente d’acteurs utilisant la couche supérieure du réseau (i.e. diffusant seulement du contenu, appelés OTT, pour over-the-top). Puis, la procédure élaborée par le législateur interroge : pourquoi impliquer une personne publique dans des négociations commerciales entre personnes privées ? La dualité du contentieux, oscillant apparemment entre contentieux public en première instance et contentieux privé pour l’appel ne fait que renforcer un peu plus cette singularité qu’il convient d’analyser plus avant. De plus, avec un marché en consolidation et une Europe en intégration, du moins économiquement, la question de l’avenir d’un tel mécanisme se pose, dont la plus récente réforme inclut désormais de possibles cas de contentieux communautaires, avec la participation du BEREC comme organe consultatif. Enfin, notons une place importante accordée aux témoignages et aux expériences de celles et ceux qui font vivre ce contentieux, constituant une tentative d’apporter un éclairage de sociologie juridique à cette étude, entre théorie et pratique d’un contentieux particulier de la régulation. / Dispute resolution is a very specific legal tool, mixing private and public legal elements. The ARCEP, the National Regulatory Authority in France is in charge to regulate the sector and has the power to litigate disputes about interconnection or access. Established in 1996, the ARCEP developed a certain practice of this type of disputes, elaborating a specialized litigation to enforce the right to interconnection, granted by European laws. Such a right is vital for operators in order for them to be able to compete with the incumbent. Consequently, efficiently resolving every dispute to keep market competitive is crucial. Studying such a mechanism has several interests. Firstly, the very concept of operator evolves. Local authorities now have the ability to intervene and deploy networks available for other operators and even the public. More, over-the-top actors providing content services on the Internet have an increasing impact on the networks and they are now competing operators on telecommunications services. Secondly, the procedure is debatable: how a public body can intervene on commercial contracts? As France has a bi-jurisdictional order, splitting courts between private law and administrative law, dispute resolution changes this traditional way, making administrative decisions appealed at the Cour d’Appel de Paris. Lastly, the growing scaling up of the market, from national to European level, questions the ability of ARCEP’s mechanism to evolve.Using a mixed method, combining theoretical and practical approach, we aim to explain how this specific way to make regulation is a real asset for competition.

Mediator Personality Type and Perceived Conflict Goals in Workplace Mediation: A Study of Shared Neutrals

The focus of this thesis was around two questions: "Do mediators commonly share a personality typology?" and "Does personality type affect mediators' perceptions of disputants' goals?" The findings of this study have several implications for conflict management and its practitioners. For instance, consideration of one's own personality type can lead to deeper understanding of one's own biases and help develop mediator neutrality. Studies about mediation practitioners can also provide information about this under-represented group for use in career counseling, as well as in public education. This research suggests that 71% of this group of mediators shared preferences in both the intuition and feeling dimensions, and 42% shared the three dimensions of intuition, feeling and perceiving. According to MBTI literature, individuals who favor intuition tend to focus on relationships and look at the big picture and the connection between the facts. Individuals who prefer to use feeling in decision-making tend to be sympathetic, compassionate, and people-focused. Individuals who prefer to use perceiving tend to be spontaneous and enjoy trusting their resourcefulness in adapting to the demands of a situation. This study also investigated potential personality affects on mediators’ perceptions of disputants' conflict goals. Personality dimensions, mediator experience, and scenario outcomes were assessed and a statistically significant relationship was found between the intuition dimension and relational goals in one of the four scenarios. Some significant relationships were also found in another of the four scenarios between mediator experience and preferred scenario outcome. The study group was a small interagency group of workplace mediators called Shared Neutrals, who mediate disputes in Oregon and Washington. The design of the study was different from past studies in its use of contextual conflict scenarios; in the form of an author-developed questionnaire; similar to those used in the medical field to test clinician responses. The study was limited by the restriction of range of the group, by the subjectivity of the author-developed questionnaire, and by the statistical limitations of the MBTI. Some suggestions are made for future studies, including consideration of factors such as type of training, gender, group dynamics and socialization.

The thesis is dealing with prorogation and arbitration clauses in international trade, focusing on Regulation (EU) No 1215/2012 of the European Parliament and of the Council of 12 December 2012 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters (Brussels I bis) and on the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards. In particular, the thesis aims to describe the procedure of valid negotiation and the formation of clauses, including the analysis of possible interpretation issues. The common objective of the prorogation clauses as a choice of court agreements and arbitration clauses, is to determine who and where should have the jurisdiction to resolve any dispute arising between the parties and to reinforce their legal certainty. The outcome of the work is therefore to verify the hypothesis that the conclusion of such clauses really strengthens the legal certainty of the parties. Regarding the prorogation clauses, the theoretical level is supplemented by a practical insight into the whole issue in the form of an analysis of the Court of Justice of the European Union case law.
