O direito ao desenvolvimento e o comércio internacional de serviços educacionais / Right to development and international trade in education services

O presente estudo pode ser considerado parte da linha de pesquisa Comércio, Direitos Humanos e Desenvolvimento, temática recorrente que procura entender e analisar os impactos do comércio internacional na realização dos direitos humanos e no desenvolvimento, além de propor alternativas sobre o inter-relacionamento das três áreas. A integração positiva entre elas depende de muito mais do que a adoção de medidas preventivas contra os possíveis prejuízos advindos da liberalização. Um sistema de comércio internacional que seja realmente favorável aos direitos humanos e ao desenvolvimento entendido não apenas como benefício econômico, mas principalmente como desenvolvimento social, político e cultural , deve ir além e atuar de forma positiva e não passiva. Neste sentido, não se pode considerar a liberalização dos serviços educacionais no âmbito da Organização Mundial do Comércio (OMC), se não forem conduzidas de forma a contribuir para a realização do direito ao desenvolvimento em todas as nações e a todos os indivíduos. No entanto, evidenciada existência de um atual mercado educacional, deve-se buscar alternativas para colocar a realização do direito ao desenvolvimento um direito humano que garante a realização de diversos outros direitos humanos no topo dos objetivos do comércio internacional. Assim, é obrigatório que se procure encontrar uma maneira de negociar o setor de serviços educacionais que não prejudique e ainda colabore para uma implementação mais efetiva do direito ao desenvolvimento. Objetivando cooperar com este relevante e necessário propósito, este estudo discute a atual relação entre o comércio internacional de serviços educacionais e o direito ao desenvolvimento, bem como analisa a importância da educação para os direitos humanos e o desenvolvimento. Afinal, a educação deve ser vista como uma mercadoria liberalizável ou deve ser tratada, acima de tudo, como um direito humano e um bem público, que deve ser protegido? / This study can be considered as part of the current research under Trade, Human Rights and Development, that intends to understand and evaluate the impacts of international trade at human rights and development, besides proposing alternatives to relate all three areas. Integrating international trade, realization of human rights, and development depend on much more than just preventing consequential damages of trade liberalization. An international trade system that is really favorable to development considered not only as economical gain, but also as social, political and cultural development and human rights must go further, and act positively rather than just passively. In this scenario, negotiating education services at the World Trade Organization (WTO) in a way that does not contribute to the realization of the right to development in all nations and for all human beings can not be considered welcome or even feasible. However, bearing in mind that there is already an education market, reality claims for alternatives to put the realization of the right to development as a human right that guarantees several other fundamental rights at the top of international trade goals. Therefore, finding a way of liberalizing education services that does not hinder and yet cooperates to a more effective implementation of the right to development is now mandatory. Aiming to cooperate with this relevant and necessary purpose, this study discuss the current relation between international trade in education services and the right to development, as well as the importance of education to human rights and development. After all, should education be seen as international trade commodity or should it be treated, above all, as a human right and a public good in need of protection?

Esta atuação se consolidou na primeira década dos anos 2000 e se deveu, em grande parte, à Associação Brasileira de Mantenedoras de Ensino Superior (ABMES), que é uma das associações do empresariado mais bem estruturadas, com abrangência nacional e com grande poder de pressão. Partindo destas constatações, tivemos como objetivo analisar as formulações e as proposições da ABMES para a educação superior, suas articulações para viabilizar seu projeto e o impacto de sua intervenção nas políticas para a educação superior nos períodos dos governos Fernando Henrique Cardoso (1995-1998 e 1999-2002) e Lula da Silva (2003-2006 e 2007-2010). Esta investigação se caracteriza como uma pesquisa documental cujo corpus é composto pelas publicações e documentos elaborados pela ABMES desde a sua criação, em 1982, até o ano de 2010. A análise do corpus documental foi feita com base em três categorias (papel do Estado, formação humana e configuração da educação superior). A base da pesquisa é a teoria gramsciana de Estado ampliado e a teoria poulantziana de Estado relacional. A perspectiva epistemológica que fundamenta a pesquisa é o materialismo histórico dialético. Com a análise do corpus documental, percebemos que a ABMES passou por três fases ao longo de sua existência (implantação, desenvolvimento e consolidação). Para a ABMES, o Estado deve favorecer o oferecimento da educação-mercadoria, tendo ações de regulação mínima, não intervindo no mercado de ensino. A formação humana deve ser voltada estritamente para as demandas do mercado de trabalho, não se preocupando com a elevação cultural dos seus alunos. A configuração da educação superior deve permitir a coexistência de tipos diversificados de estabelecimentos e cursos para favorecer o atendimento das demandas dos alunos. Concluímos que, com ações coesas e estratégias bem articuladas, o empresariado do ensino superior, através da ABMES, conseguiu dar o tom da política nacional de educação superior durante os períodos de governo estudados. / In the 1990s, it intensified a complex expansion of Brazilian higher education, through the strong performance of the business school, who organized themselves in associations in order to secure their interests in the state system. This operation was consolidated in the first decade of the 2000s and was due in large part to the Brazilian Association of Maintainers of Higher Education (ABMES), which is one of the entrepreneurs' associations better structured, with national coverage and with great power pressure . Based on these findings, we had to analyze the formulations and the propositions of ABMES for higher education, your joints to enable your project and the impact of its intervention in policies for higher education in times of Fernando Henrique Cardoso (1995-1998 and 1999-2002) and Lula da Silva (20032006 and 2007-2010). This research is characterized as a documentary research whose corpus is composed of publications and documents prepared by ABMES since its inception in 1982 until the year 2010. The analysis of the documentary corpus was based on three categories (state's role, human formation and configuration of higher education). The centerpiece is the Gramscian theory of expanded state and Poulantzas's theory of relational State. The epistemological approach underlying the research is the dialectical historical materialism. With the analysis of the documentary corpus, we realize that ABMES passed through three phases throughout its existence (implementation, development and consolidation). For ABMES, the state should encourage the offering of education-commodity, and actions of minimal regulation, not intervene in the education market. The human development should be geared strictly to the demands of the labor market, not worrying about the cultural elevation of their students. The setting of higher education should allow the coexistence of diverse types of institutions and courses to further meet the demands of the students. We conclude that, with cohesive actions and wellarticulated strategies, higher education entrepreneurship through ABMES, could set the tone of national politics of higher education during the periods studied government.

Impact des services d'animation pédagogique de la Biosphère sur certaines conceptions d'élèves du deuxième cycle du primaire

L’enseignement des sciences est capital dès l’école primaire, mais est souvent délaissé. Les musées scientifiques peuvent palier à cette lacune en offrant des ressources éducatives concrètes, dont les programmes éducatifs. Cette recherche détermine l’impact d’une animation pédagogique de la Biosphère sur certaines conceptions d’élèves du deuxième cycle du primaire. La chercheuse a opté pour une recherche qualitative et la méthode choisie est l’étude de cas, de type exploratoire. Des élèves d’une classe ont participé à l’étude. Ils ont assisté à une visite muséale, insérée au sein d’une séquence didactique. À l’aide de plusieurs outils de collecte de données (questionnaires, entrevues et observations), la chercheuse a été en mesure d’identifier quatre niveaux de modification des conceptions d’élèves (évolution notable, une certaine évolution, stabilité des conceptions, confusion des conceptions). Enfin, elle suggère quelques pistes d’amélioration à la Biosphère afin de maximiser l’impact de la visite sur l’apprentissage des élèves. / Science education is essential in elementary school, but it is often neglected. Science museums can overcome this gap by providing practical educational resources, including educational programs. This research determines the impact of a Biosphere’s educational animation of certain conceptions of students from elementary school. The researcher chose a qualitative research and the chosen method is an exploratory case study. Students from a class have participated to this study. They attended a museum visit, insert in a didactic sequence. Using several data collection tools (questionnaires, interviews and observations), the researcher has been able to identify four levels of modified conceptions of students (significant evolution, a certain evolution, stable conceptions, confusion conceptions). Finally, she suggests some ways of improving the Biosphere’s animation to maximize the impact of the visit on student learning.
