Para tanto, recorre a técnicas qualitativas como entrevistas, pesquisa documental e observação, e se classifica como um estudo de caso múltiplo. O estudo discute os limites da democracia representativa brasileira, ainda com traços autoritários, conservadores e centralizadores do Estado, apesar dos esforços de movimentos sociais e de gestores públicos para ultrapassá-los, introduzindo instituições participativas na gestão pública. Para compreender os meios de ampliação da democracia representativa e o papel que os conselhos municipais de habitação podem exercer, este estudo utiliza conceitos como democracia participativa e deliberativa, deliberação pública e efetividade deliberativa. O objetivo é avaliar a efetividade deliberativa dos conselhos municipais de habitação, mediante a deliberação, aprovação e fiscalização de políticas públicas que supostamente contribuiriam para a universalização do direito à moradia e a solução de sérios problemas habitacionais dos municípios. Foram utilizadas categorias de análise como o contexto de criação desses fóruns e a ação da gestão municipal para assegurar seu caráter deliberativo, a ação de representantes da sociedade civil nas discussões e deliberações, a influência de interesses do capital imobiliário e da construção civil sobre as políticas municipais de habitação, e os efeitos das políticas habitacionais das esferas federal e estadual sobre as políticas municipais e os seus conselhos. Os resultados da pesquisa indicam que os conselhos de habitação não apresentam efetividade deliberativa na universalização do acesso à moradia de interesse social, pois carecem do apoio de gestões municipais, que não liberam recursos financeiros para os fundos de habitação, não convocam regularmente as reuniões ou não implementam integralmente suas deliberações. Os conselhos gestores e as políticas locais de habitação sofrem a influência indireta de interesses do capital imobiliário e da construção civil, interessados em projetos padronizados e de grande porte, a despeito de projetos diversificados de requalificação urbana em comunidades carentes. Os conselhos de habitação também perdem sua capacidade deliberativa quando os municípios dependem de transferências de recursos e se resumem à mera operacionalização de políticas habitacionais aprovadas por outros entes da federação. Assim, o caráter deliberativo dos conselhos de habitação é comprometido pelos resquícios autoritários e centralizadores do Estado brasileiro, pelo controle desses fóruns por representantes da gestão municipal, nem sempre comprometidos com sua democratização e com o seu fortalecimento, revelando uma assimetria de poder e de recursos, o despreparo técnico e político de conselheiros que representam segmentos da sociedade civil. Esses fatores impedem o avanço em direção a uma democracia participativa ou deliberativa, configurando o que conceituo como pós-participativismo na gestão pública. / This research analyzes the deliberative effectiveness of housing councils in three municipalities in Bahia: Salvador, Vitoria da Conquista and Camaçari. In order to accomplish this, it uses qualitative techniques such as interviews, documentary research and observation, and is classified as a multiple case study. This study discusses the limits of Brazilian representative democracy, still with authoritarian traits, conservative and centralized state, despite the efforts of social movements and public managers to overcome them, introducing participatory institutions in public administration. To understand the expansion of means of representative democracy and the role that municipal housing councils can exercise, this study uses concepts such as participatory and deliberative democracy, public deliberation and deliberative effectiveness. The objective is to evaluate the deliberative effectiveness of housing councils through deliberation, approval and monitoring of public policies that supposedly contribute to the universal right to housing and the solution of serious housing problems of municipalities. Further, categories of analysis were used as the context of creating these forums and the action of municipal management to ensure its deliberative character, the action of civil society counselors in their discussions and deliberations, the influence of interests of real estate capital on municipal housing policies, and the effects of housing policies at the federal and state levels on municipal policies and their councils. In addition, research results indicate that housing councils do not have deliberative effectiveness in universal access to housing of social interest because they lack the support of municipal administrations, which do not release budget for housing funds, do not regularly convene meetings or do not fully implement its deliberations. The management councils and local housing policies suffer the indirect influence of real estate capital interested in standard designs and large scale projects, despite diverse projects of urban regeneration in disadvantaged communities. Also, Housing councils lose their deliberative capacity when municipalities rely on funds transfers and reduce to mere operationalization of housing policies adopted by other federal entities. Thus, the deliberative character of housing councils is committed by Brazil's authoritarian remnants; the control of these forums by representatives of the municipal administration, not always compromised to democratization and its strengthening, revealing an asymmetry of power and resources, and civil society counselor’s lack of technical and political skills. These factors thwart progress toward a participatory or deliberative democracy, setting up what I conceptualize as ‘pós-participativismo’ in public management.

However, the participation of Councillors in the process of decision making has been identified as one of the challenging aspects in the work of these committees, because of limitations imposed by the powers of representation. The research is focused on understanding of this process, with emphasis on analyzes of the Municipal Health Council of João Pessoa (CMS/JP), more specifically, with regard to decision making and their effectiveness discussed. To this end, several analyzes were performed starting from a study of qualitative and quantitative, by using the linking of data from three basic elements in this study: information obtained from observations on the CMS / JP, texts of the Acts of the CMS/JP and texts drawn from interviews with some of the Municipal Board of Health/JP-CP. Under the quantitative approach, tables were compiled, whose goal was to obtain, among other data related to the issue of quorum at meetings of the CMS/JP, that is related to the presence / absence of Councillors representatives of the segments in that council. Once extracted, the data were tabulated from the use of measures of central tendency: mean, median, aiming to analyze the participation of the numerical representation for each segment in the meetings of the CMS/JP-CP. As the study indicates, the CMS/JP has acted in a much more purposeful than deliberative, ie, note that this collegiate has presented great difficulties for the performance of its deliberative character, with little expression of some debates in the field where the participation does not always result in significant decision-making influence in the deliberations of the municipal public health policies, focusing on very fragile deliberative. / No campo da saúde, a criação de fóruns, como Conselhos de Saúde, e o efeito do processo de descentralização, enfatizado a partir da Constituição de 1988, resultaram em maiores atribuições e aumento da importância da esfera pública municipal de administração. Contudo, a participação de Conselheiros no processo de tomadas de decisão tem sido apontada como um dos aspectos desafiadores na atuação desses colegiados, em razão das limitações impostas à representação pelos poderes instituídos. A pesquisa está voltada à apreensão desta reflexão, com ênfase nas análises do Conselho Municipal de Saúde de João Pessoa-PB (CMS/JP), mais especificamente, no que diz respeito ao processo decisório e sua efetividade deliberativa. Para tanto, foram realizadas diversas análises, partindo de um estudo de cunho qualitativo e quantitativo, sendo utilizado o cruzamento de dados entre três elementos basilares no referido estudo: informações obtidas através das observações no CMS/JP, textos das Atas do CMS/JP e textos elaborados a partir das entrevistas com alguns dos Conselheiros Municipais de Saúde/JP-PB. Sob o enfoque quantitativo, foram elaboradas tabelas, cujo objetivo foi obter, entre outros, dados relacionados à questão do quórum nas reuniões do CMS/JP, isto é, à presença/ausência de Conselheiros representantes dos segmentos no referido colegiado. Depois de extraídos, os dados foram tabulados a partir do uso de medidas de tendência central: média e mediana, com intuito de analisar a participação numérica da representação por segmento nas reuniões do CMS/JP-PB. Conforme indica o estudo, o CMS/JP tem atuado de forma muito mais propositiva do que deliberativa, ou seja, nota-se que este colegiado tem apresentado grandes dificuldades para o desempenho do seu caráter deliberativo, com pouca expressividade no campo de alguns debates onde a participação nem sempre resulta em significativa influência decisória nas deliberações das políticas públicas de saúde municipal, incidindo em grande fragilidade deliberativa.

Nesse contexto, o estudo ? realizado com o escopo de verificar a capacidade deliberativa do Conselho Municipal de Sa?de de Mossor? (CMSM), a partir do modelo da normatividade participativa aferindo os graus de institucionaliza??o, democratiza??o e representa??o do conselho. J? o modelo da efetividade deliberativa considera a capacidade de vocaliza??o e de agenda dos participantes, os tipos de manifesta??o, as decis?es e a fun??o do conselho, a partir da leitura e a an?lise das atas permitindo aferir assim, o grau de efetividade deliberativa do conselho. Verificou-se, assim, que o conselho apresenta um grau m?dio de efetividade deliberativa, destacando-se como uma institui??o que exerce, predominantemente, o papel de controle sobre as pol?ticas de sa?de municipal, devido, entre outros fatores, ao contexto pol?tico conservador, ? assimetria de recursos entre os conselheiros, ? participa??o pouco substantiva dos atores que frequentam as suas reuni?es, seja conselheiro ou n?o, e, em especial, ? reduzida influ?ncia dos usu?rios no seu processo decis?rio. De acordo com os estudos da democracia deliberativa aplicados ? realidade de Mossor?, ? poss?vel observar que a participa??o social, sobretudo o controle social sobre as a??es p?blicas, encontra, hoje, uma s?rie de dificuldades para se realizar. O estudo reconhece que, nessas circunst?ncias, o conselho cumpre parcialmente o papel para o qual foi criado, o que n?o impede, contudo, de ser caracterizado como um espa?o de delibera??o importante, uma vez que permite a participa??o de representa??es dos diversos segmentos do estado, da sociedade, de suas demandas e inten??es. A supera??o de tais obst?culos perpassa pelo interesse de a sociedade civil despertar e passar a ter voz ativa nessas institui??es. / The social participation in Brazil takes a new impetus with the (re)democratization process of the Brazilian society and is strengthened by the resurgence of the civil society and the 1988 Constitution. In this context, the study is conducted with the scope to verify the effectiveness of deliberative Municipal Health Council of Mossoro (CMSM), with theoretical and methodological support based on the following models: the participatory normativity, which measures the degree of institutionalization, democratization and council representation; and the effectiveness of deliberative that, from the calling capacity and agenda of the participants, from the kinds of manifestation, from the decisions and the council?s office, that measures the degree of effectiveness of the deliberative council. It appears, thus, that the council has an average degree of effectiveness deliberative, standing out as means an institution that practice, despite the existence of obstacles and challenges, the role of control over municipal health policies, due, among other factors, the conservative political context, the asymmetry of resources between the counselors, the little substantive participation of the actors who attend its meetings, either counselor or not, and in particular, the reduced influence of the members in its decision-making process. In public management of Mossoro, social participation, especially social control over public actions, face, today, great number of difficulties to be held. The study recognizes that, in such circumstances, the council partially fulfills the role for which it was created, what does not impede, however, be characterized as an important deliberative space, since it allows the participation of representatives of the various segments of the state, society, their demands and intentions. Overcoming such obstacles moves through the interest of civil society to wake up and fight for the spaces in these institutions.

A partir da pesquisa documental (leis de cria??o dos conselhos, regimentos internos, atas, resolu??es e relat?rios de gest?o), bem como da participa??o em reuni?es dos colegiados e das entrevistas com conselheiros e gestores, buscou-se empreender uma an?lise sobre como o compartilhamento do poder acontece nessas institui??es e como elas influenciam as respectivas gest?es municipais. Os resultados demonstram que a din?mica de funcionamento dos conselhos relaciona-se tanto ? abertura da gest?o ? participa??o social quanto ao protagonismo dos conselheiros em promover debates, apresentar demandas e exercer o controle social sobre as a??es e presta??es de contas dos gestores. Nesse sentido, ? poss?vel afirmar que as institui??es participativas atuam qualitativamente para a democratiza??o das pol?ticas p?blicas, mesmo que a correla??o de for?as desigual entre Estado e sociedade civil ainda esteja presente no processo decis?rio de alguma maneira nos casos analisados. / The Public Policy of Social Assistance established by the Federal Constitution of 1988 is a duty of the State and the right of the citizen and is carried out through a decentralized and participatory system, articulating the State and civil society in the decision-making process of management and in the inspection of actions and public resources. The managing councils institutionally assume the prerogative to materialize social participation for the democratization of public policies, and its existence is a legal condition for the transfer of federal resources in the scope of Social Assistance. The literature shows that these institutions are consolidated for this process, however, it is necessary to understand the dynamics of the functioning of the councils and their relationship with the management bodies to analyze the quality of social participation and its influence in the decision-making process and the exercise of Social control. The objective of this work is to analyze the dynamics of the municipal councils of Natal and Parnamirim (RN), based on the assumptions of theories of participatory and deliberative democracy, apprehending the analytical categories of participation, political representation, deliberative effectiveness and Accountability. Based on documentary research (council creation laws, internal regulations, minutes, resolutions and management reports), as well as participation in meetings of the collegiate and interviews with directors and managers, an attempt was made to analyze how sharing of power takes place in these institutions and how they influence the respective municipal administrations. The results demonstrate that the dynamics of functioning of the councils is related to the opening of management to social participation and to the role of directors in promoting debates, presenting demands and exercising social control over the actions and rendering of accounts of managers. In this sense, it is possible to affirm that participatory institutions act qualitatively for the democratization of public policies, even though the unequal correlation of forces between State and civil society is still present in the decision-making process in some way in the analyzed cases.

Esta pesquisa tem por objetivo a análise do Conselho Municipal de Educação de Ribeirão Preto (CMERP) a partir de três aspectos essenciais - os contornos do seu desenho institucional, os conteúdos dos seus processos deliberativos e os sentidos da participação em seu contexto. Es-peramos que essa análise possa indicar os caminhos que têm sido tomados por conselheiras e conselheiros no espaço participativo do Conselho, bem como compreender suas conquistas e desafios na direção da ampliação democrática. Os objetivos específicos são a investigação sobre o traçado e o funcionamento instituicional, a efetividade dos processos deliberativos e as rela-ções que se estabelecem numa conjuntura de partilha de poder entre o Poder Público e a socie-dade civil. O enfoque metodológico é qualitativo, com a reunião de dados documentais e a coleta de entrevistas semiestruturadas. O fenômeno da participação democrática no Brasil, em especial por meio das mais diversas instituições participativas criadas desde a redemocratização do país, tem gerado um campo vasto de pesquisas empíricas que tomam por base a democracia como processo de deliberação argumentativa e buscam avaliar ganhos e dificuldades desse ca-minho. Os resultados produzidos dentro de algumas décadas de funcionamento das instituições participativas ganham a centralidade da agenda de pesquisa, que busca medir a capacidade de tornar mais democráticas as relações entre Poder Público e sociedade civil. Para a nossa pesquisa, realizamos a análise de dados colhidos sobre o CMERP - a legislação, as atas das reuniões ordinárias e extraordinárias, o Plano Municipal de Educação de Ribeirão Preto, as entrevistas com conselheiras e conselheiros e as notas de campo. O CMERP é um conselho em funcionamento e que cumpre com suas atribuições legais. A instituição conta com uma participação marcadamente fiscalizatória do Poder Público e das políticas educacionais, com uma representação concentrada nos segmentos da educação municipal, em especial do professorado. We hope this analysis may indicate the paths that have been taken by counselers in the Council\'s participative space, as well as the understanding of its conquers and challenges towards a democratic enlargement. The specific objectives are the investigation on the layout and the institutional operation, the effectivness of deliberative processes and the relations that take place in a conjucture of power sharing between public Power and the civil society. The metodologic approach is qualitative, gathering documental data and collecting semi-structured interviews. The democratic partici-pation phenomenum in Brazil, especially by the means of several participative institutions that were created since the country\'s redemocratization, has generated a wide field of empirical researches that base the democracy as an argumentative deliberation process and aim to evalu-ate gains and difficulties on that path. From this perspective, the results produced whithin a few decades of operations of the participatory institutions gain the centrality of the research agenda in this area, which seeks to measure its ability to turn the relations between public sector and civil society more democratic. For our research, we did the analysis of direct and indirect data gathered on the CMERP - legislation, the minutes of meetings (ordinary and extraordinary), the Ribeirão Preto\'s Educational Municipal Plan, the interviews with advisors and counselors and the field notes. We can say that the Council is in operation and fulfills its legal atributions. The institution has a participation thar markedly fiscalizes do Public Power and educational public policies, with concentrated representation in the fields of municipal education, in special the teachers. Among the challenges in terms of democratic expansion, are the approaching of civil society and the diversification of sectors represented internally.
