Physical work capacity evaluation in vocational rehabilitation and its effect on the vocational placement of disabled male workers

The purpose of this study was to examine the effect of program type and selected predictor variables on the vocational placement and feelings of self-esteem of disabled male workers. It was predicted that: (1) a physical capacity assessment program (PCA), designed by the investigator, would result in a higher rate of successful vocational placement than conventional placement techniques, in a shorter period of time and with a better vocational match; (2) increased measures of self-esteem would be experienced by the PCA group and at a more significant level than conventional vocational programs; (3) there would not be a significant interaction between the vocational placement variables and the independent variables of age, degree of disability and injury type; and (4) there would not be a significant effect of selected moderator variables between groups on the vocational placement variables. Fifty disabled workers were randomly selected from the active caseloads of the Vocational Rehabilitation Department of the Workers' Compensation Board of British Columbia for participation in the study. Their average age was 33.32 years, and their average length of time on wage loss was 245 days. All subjects were injured as the result of an industrial accident, were no longer undergoing medical treatment, had been cleared for a return to work but were suffering from a residual disability that prevented them from returning to the work force. Subjects were randomly assigned to one of two treatment conditions involving vocational counselling with job search training (JS) and vocational counselling with physical capacity assessment (PCA). Following completion of the program, subjects began job search activities and were monitored for a period of 6 months or until successful vocational placement was achieved. Data analyses showed that: there was a significant main effect between groups for success in vocational placement with PCA placing more subjects than job search; there were no significant differences between groups on measures of self-esteem following completion of the programs; there was a significant interaction effect of age, degree of disability and type of injury with success in vocational placement and; there was a significant interaction effect of several moderator variables including marital status and length of time on wage loss with success in vocational placement and time to vocational placement. The results tend to support the use of physical capacity assessment for the guantification of individual capacity to perform work. Further, the results suggest that the use of PCA information in the identification and selection of appropriate vocational alternatives can significantly enhance the success of vocational placement disabled workers. TheFootloose Labor System: Work and Migration in the Pacific Northwest, 1850–1940

Thesis advisor: Heather Cox Richardson / Between the 1850s and World War II, millions of workers participated in a system of continuous labor migration that drove the development of the Pacific Northwest. Western industries relied on short-term workers because of their seasonal and economic cycles. These industries were often located far from urban centers and thus relied on a highly mobile pool of North American, European, and Asian workers to turn the Northwest’s abundant natural resources into wealth, an arrangement I call the footloose labor system. In order to manage workers’ movement within and across United States borders, employers turned to immigrant labor contractors and employment agencies to bring order to this chaotic labor market. But those agencies did little to settle the high labor turnover, and instead, exerted increasing control over migrant workers. By the mid-twentieth century, white workers had largely risen out of the system, leaving migrant labor to Asian, and increasingly, Latinx workers who have come to represent “migrant workers” in today’s America.This dissertation argues that the presence of both hobos and Asian workers in the footloose labor system dynamically shaped the conditions of the labor market, and together, cemented a racialized migrant labor system in the Pacific Northwest that would come to be dominated by Latinx workers in the second half of the twentieth century. Placing labor migration—and the labor brokers who engineered the footloose labor system—at the center of the story shifts our perspective to see that hobos and Asian immigrant workers existed in the same labor market dominated by employers who relied on footloose workers. From the point of Northwestern employers and labor brokers, migrant workers, whether they were born in Kansas, Greece, China, or the Philippines, proved useful only if they made a business profitable. Employers continued to hire both white and Asian workers through labor brokers into the 1920s. But white migrant workers increasingly sought jobs outside of the footloose labor system as new technology in agriculture reduced the number of available jobs and post-World War I politics put a greater emphasis on homeownership and conformity. White workers' departure left the most precarious and exploitative jobs to Japanese, Filipinx and eventually Latinx workers. Legislative framework governing labour broking in South Africa

Thesis (LLM (Labour law)) --University of Limpopo, 2013 / The study will analyse section 198 of the Labour Relations Act of 66 of 1995. The section is the founding provision of labour broking and also provides for joint and several liabilities between the client and the broker in instances of infringement of this section. The utilization of labour brokers in South Africa has sparked debates between various stake-holders, with the other side arguing that labour broking should be banned it diminishes the rights of employees. In order to resolve the challenge relating to labour broking the study will make comparative analysis with the Namibian jurisprudence. The study takes full cognize of legislative framework governing labour broking and determines whether the available legislation provide full protection of labour rights. Through case law the study will highlight the constitutional challenges o labour broking in South Africa and challenges faced by employees employees employed through labour broking. The study concludes tht the regulation of labour broking is appropriate as the industry creates employment nd thus alleviates poverty and that the total ban labour broking in South Africa would be detrimental to those who seek employment without the necessary skills and qualifications.
