Politics of asylum : sovereign considerations in the multilateral and humanitarian practices of refugee protection in post-apartheid South Africa

Most scholars claim that international human rights norms embodied in formal international declarations and treaties have an important impact on domestic political interests and governmental practices. This reasoning about the impact of global human rights is often applied to the post-apartheid South African immigration and refugee policies. While I acknowledge that the ratification of United Nations Conventions on refugees has altered the traditional sovereignty considerations of South Africa towards asylum seekers, I take issue with the claims that South African refugee and asylum policies are primarily motivated and based on humanitarian considerations. Instead, I argue that these policies are based on sovereign considerations and strategic foreign policy interests. As a result this sovereign interests of South Africa to study has sought to demonstrate that largely explain decisions on the part accept or reject refugees. Although norms diffusion, international advocacy networks, and prestige factors have made a big impact, in practice the refugee policy has continued to reflect South Africa's strategic interests and domestic considerations at all levels. However, I have not argued that South Africa should overlook its national and foreign interests and abide by international human rights norms regardless of the cost of doing so. I have only sought to demonstrate that refugee protection is more when powerful national interests find it conducive to manage the destabilizing refugee flows.

A sample of 241 black women entrepreneurs in Tshwane townships was investigated after which the results were reported. The primary objective of this study has been to investigate the extent to which black women entrepreneurs utilise government policies and Programme in Tshwane. Descriptive statistics indicated the following: 1. Information about government policies is not known by the majority of women entrepreneurs in Tshwane. 2. Local business centres are not assisting black women entrepreneurs by disseminating government policies. 3. SEDA is not effective in providing training for the SMMEs. 4. Teachers’ understanding and implementation of inclusive education in an Eastern Cape primary school

Since 2001 the South African Department of Basic Education has been working towards implementing Inclusive Education over a twenty year period. This is in accordance with international trends in education. This study set out to investigate the implementation of Inclusive Education in a South African context by conducting a case study at an Eastern Cape no‐fee‐paying primary school. It looked at how the government policy, as set out in Education White Paper 6 (EWP6) (DoE, 2001), is understood and being implemented by teachers at the Welcome Primary school. The study further investigated the introduction of the National Strategy on Screening, Identification, Assessment and Support (SIAS strategy) (DoE, 2008a) to gain insight into how teachers identify and assess barriers to learning in an ordinary primary school. In addition it looked at emerging factors that could impact on the implementation of this policy. With 16 years teaching experience in ordinary and private schools and 19 years experience in a special needs school as a teacher, head of department and then principal, I have personal experience of the crisis in the Eastern Cape Department of Basic Education. This awareness provided the impetus and interest in researching Inclusive Education policy implementation. It is my view that only when we begin to grapple with the problems right at the source of the education crisis within the majority of the no‐fee‐paying schools that informed decisions about policy and policy implementation can be made. As I am able to understand and converse in isiXhosa, I was able to observe and experience the implementation of EWP6 and the SIAS strategy in a school that is an isiXhosa‐medium ordinary primary school and similar to the majority of ordinary public schools in the district. A qualitative research approach based within an interpretive paradigm using the case study method was used for this study. Semi‐structured interviews, detailed field notes as well as documents generated by meetings and education conferences helped me to investigate and refine my research goals. The research found that the implementation of EWP6 and the SIAS strategy posed a major challenge for the Department of Basic Education, and highlighted the significant gap between ordinary primary schools and special needs schools. However, the fact that there is a partial engagement with the process of providing inclusive education, does present some measure of hope for a better future for those learners that have experienced the injustice of exclusion from education and society. The Eastern Cape Department of Basic Education will have to ‘catch up’ to other provinces in its delivery of every child’s constitutional right to education in an inclusive school environment. Factors emerged from the study that showed that the assessment of learners’ barriers to learning with the resultant support needs was a relatively new concept, as teachers tended to rely on traditional classroom tests and simple informal classroom assessments to assess the learners. Teachers expressed a good verbal knowledge of learners with support needs but found it very challenging to put this verbal knowledge into a written document. In addition there was inadequate support from the District Based Support Team to implement the SIAS strategy. This study showed that the medical model of assessment was still being adhered to in the research district with little evidence of a move to a social model of assessment in terms of the SIAS strategy. In addition, factors emerged indicating the serious impact that alcohol abuse has on children and the society in which they live. The evidence of increasing numbers of children with Fetal Alcohol Spectrum Disorder (FASD) in a single educational district is a matter of grave concern from an educational and financial perspective. It is my contention that this is a matter of national urgency and that the Department of Basic Education must confront the escalating problem of alcohol abuse and the resultant challenges of a large number of learners with serious barriers to learning that need to be included in the education system.

The "Civilised Labour Policy" and the private sector : the operation of the South African Wage Act, 1925-1937

The early history of South African industrial development has been approached from essentially two angles. One body of thought has concentrated on the adverse effect colour bars have had on the development of South Africa. It is argued that racial discrimination in industry originated from the racial prejudice of white workers and from state intervention in the economy. Opposed to that view is the interpretation that the colour bar originated out of the specific character and subsequent development of South African capitalism. This study approaches the debates and arguments through an analysis of the Wage Act of 1925. The industrial relations system which operates in South Africa has its origins in the legislation of the 1920s. It is based on the Industrial Conciliation Act of 1924 and the Wage Act of 1925. Very few systematic analyses of the Wage Act have been produced hitherto. Most commentators have focussed on single aspects of the Act, but very few have attempted an examination of the operation of the Wage Board which was established by the Act. The Wage Board was instituted as an element to promote the civilised labour policy in the private sector. Whereas the Industrial Conciliation Act operated to protect organised labour, the Wage Act concentrated on unorganised trades and sections of trades. Although empowered to investigate conditions in the mining industry, the Wage Board was never used to regulate wages in that industry under the Wage Act due to opposition from the industry. It was concerned solely with secondary industrial and manufacturing establishments because agriculture and domestic service were excluded from the Wage Act. The Wage Act was based on the principal of compulsory regulation. Determinations in terms of the Board's recommendations were binding on employees and employers alike. Complex procedures hampered the activity of the Board until 1930 when the Act was amended and simplified. The Board faced a great deal of opposition from manufacturers in its early years. But a cautious approach and the gradual implementation of determinations ensured that employers opposition soon changed to support when it became clear the Board was not an arbitrary one. The Board had to take a number of strict considerations into account. It could not recommend wages if its recommendation would affect the particular trade concerned adversely. It concerned itself with the promotion of efficiency in business, production costs, consumerism , the wasteful employment of labour, the length of the working day and the productivity of employees. As such it was used as a means to assist the necessary rationalisation and reorganisation of South African industry. It could not recommend wages without the Minister's express instructions if all the employees covered by a reference could not receive a civilised wage . Civilised wages were classified as wages at which employees could enjoy white standards of living. This clause effectively introduced a colour bar into wage determinations. It operated before 1930 to buttress Industrial Council Agreements to prevent the displacement of whites by Africans at lower rates. The Wage Board also considered investigations from unskilled, African workers. The Board was not permitted by law to discriminate against people of colour. Apart from the potential colour bar of wage regulation in general in South Africa, the Board was instructed in 1930 to refrain from issuing recommendations for African workers. Regulations were also altered to exclude Africans. The Wage Act declined in importance after the Great Depression as white workers were drawn closer to the wider-reaching Industrial Conciliation Act. The need to regulate African wages and to control African labour became more evident during the period of economic expansion in the 1930s. The Act was replaced in 1937 and the restrictions formerly placed on Africans were removed. The workforce had finally been separated with the provision of different industrial relations appartuses." Sustainable governance management systems: a practical approach for Water Boards in South Africa

This research study explored the appropriate sustainable governance management systems for South African socio-economic conditions. This was achieved by investigating the current governance and management of water boards in performing their business and water services provisioning at municipal level. Municipalities are the third sphere of government in South Africa and are found at local levels of governance. They are businesses that provide running water as legislated by the Constitution of the Republic of South Africa, 1996. Water boards are public institutions established in terms of the Water Services Act, 108 of 1997 (WSA) and listed as Schedule 3 part B: National Government Business Enterprise in terms of the Public Finance Management Act 29 of 1999. They are accountable to the national government through the Department of Water Affairs. Their responsibility is to support municipalities where water-provisioning challenges are eminent. They report annually to national parliament on their performance within a specific financial year. Water boards are currently able to perform their operations in selected jurisdictions as contracted by municipalities. They are struggling in managing and governing their water business while striving to achieve improvements in water service coverage, operating efficiency and service delivery. The aim of the research study was to investigate areas affecting the sustainability of governance management systems for water boards in relation to the improvement of service delivery in South Africa. The analysis of age and gender factors and the conditions affecting governance are explored. The research used the qualitative and quantitative methods to analyse the research questions. Prior to the commencement of the study, the researcher performed an intensive desktop study involving the use of dated and recently published material related to governance and management of the water institutions in developed and developing countries. During the desktop study, national and international accredited journals were prioritised to obtain related and relevant similar information to the water governance and management of water institutions. In addition, a case study was undertaken in Ficksburg in which water boards provided an intervention in resolving the water crisis, since the provision of water is a basic service at local government. This area experienced both water shortage and a poor quality of water. With regard to qualitative methodology, participatory forums were used to delineate the research context and premise. The study population consisted of individuals who were in the business of water boards with special reference to water management and board of directors for a population of 1 000. Of the 500 questionnaires sent out, 419 were returned. The data were analysed using the statistical software package, Statistical Package for Social Sciences (SPSS). The results and recommendations are presented based on the identified objectives of the study. The study’s findings provide information for transformation and improvement in the performance of water boards in South Africa when striving for sustainability in management and governance. The findings reveal the need for improvements in the involvement of females in the business of the water boards. The findings confirm the outcomes of previous studies regarding the slow implementation of affirmative action and transformation processes as required by legislation. Furthermore, the results reveal that the factors and conditions affecting sustainability of the water boards need to be prioritised to improve the management and governance aspects of water boards. These include the appropriate selection of members of the boards of directors, water boards' committees that are guided by legislation in their operations and the maintenance of proper financial management (collection of revenue, implementation of appropriate financial strategies and striving for positive clean audit). Water boards are encouraged to strengthen their intergovernmental relations in order to make their mandate known across all spheres of government. Service delivery should be approached “from source to tap and tap to source” to promote high-quality provision of water. The water boards should be accountable to the municipalities for the provision of delegated operations. The Department of Water Affairs exercises an oversight role to ensure the sustainable provision of the services. However, the study concludes that without a strong management and a sustainable governance approach, water boards will not be able to carry out its water developmental mandate. The practical framework that was developed in this study provides management and governance tools for sustained provisioning of water to advance transformational and developmental needs and the application of legislations. The results in the study have a direct impact on the codes of practice and regulations on employment equity in implementing the Employment Equity Act of 1998, Intergovernmental Relations Act of 2005, Companies Act of 2008, National Water Act of 1998, and Water Services Act of 1997. Therefore, the practical implementation of this framework will enhance water as a transformational and developmental feature in addressing the social, environmental and economic services.

The role of the state in rural development: appropriate strategies for the rural development program in Mbhashe municipality in Eastern Cape

Poverty and inequality in South Africa are a result of the impact of apartheid policy, which inter alia stripped people of their assets, especially land, distorted economic markets and social institutions through racial discrimination, and resulted in violence and destabilization. This has shaped the nature of poverty in South Africa. In view of the above, the South African government has introduced a programme known as the Comprehensive Rural Development Strategy in order to redress the imbalances of the former apartheid regime. In this strategy it is envisaged that vibrant, equitable and sustainable rural communities and food security for all will be achieved. In this study, I investigated the implementation of rural development programmes in the Mbhashe local municipality of the Eastern Cape Province in order to determine appropriate intervention strategies. This study focused on Ward18 of Mbhashe local municipality on a village known as Nkwalini Bafazi. This is a village that has been earmarked by the government to be a pilot site for the Rural Development Programme. This project is at the initial stage of social facilitation. In other words this research project is designed to investigate the process of Rural Development and how it can be implemented in the Mbhashe Local municipality in order to alleviate poverty and underdevelopment. For the purpose of the study, a mixed research approach was chosen. This means that the study used both the qualitative and quantitative approaches for in-depth understanding and verification. Questionnaires and structured interview questions were used to collect the data. Participatory Rural Appraisal (PRA) was also used for the purpose of observing and involving the community in the exercise. Data was collected from residents by conducting surveys, making use of questionnaires. Structured interviews were conducted with government officials (Department of Rural Development and Agrarian Reform) in order to understand the situation better.

Foreign direct investment and socio-economic development : the South African example

It is widely accepted by governments of many developing countries that Foreign Direct Investment (FDI) is crucial to the socio-economic development of their nations and have developed various policies in an effort to attract FDI, as a result. FDI is a crucial source of technology, capital and skills for developing countries for economic growth that may ultimately lead to poverty reduction, employment creation and modernisation. However, results from many studies have been inconclusive and have failed to find a direct link between the increase of FDI and the associated socio-economic development of recipient nations. South Africa is no exception to this debate as it seeks to turn its back on decades long apartheid, which has entrenched poverty in the majority of its population and exacerbated social tensions. The main socio-economic challenges that South Africa faces include high unemployment, skills shortages, poverty and high inequality, and the 2008/2009 global financial and economic crisis has exacerbated the crisis. Despite these challenges South Africa‘s macro-economic strategies have had a good reputation since 2000. The monetary policy has turned out to be more transparent and predictable, and a sound fiscal policy has sustained its framework. The study analyses the role that FDI plays in the socio-economic development of South Africa since 1995 by focusing on selected case studies: ABSA Bank, General Motors South Africa (GMSA) and the Mining Sector of South Africa. The research concludes that although ABSA Bank has implemented several corporate social responsibility (CSR), and various employee development programmes, there is hardly any evidence to suggest that Barclays Bank‘s takeover of ABSA Bank has positively impacted on these programmes. General Motors South Africa (GMSA), which came into South Africa many decades ago through a Greenfield Investment, has played a positive role in the economy of the Eastern Cape Province as well as that of South Africa, having created jobs directly and indirectly. The company has also designed and implemented various educational, housing as well as health and awareness programmes for its employees and for the communities. Mining companies that operate in South Africa formed partnerships in the communities in which they operate in an effort to improve the lives of people. While these various projects have been a source of employment, they have had a limited impact on the core causes of social problems surrounding the mines. Many of these root causes relate to core business practices of the mining companies, especially employee recruitment, wages and housing. These root causes where witnessed in the Lonmin tragedy and in other strikes that spread throughout the sector in 2012. The study concludes that although FDI does play a role in the socio-economic development of South Africa, especially Greenfield investment, the same argument could not be made on Mergers and acquisitions (M&As). Finally, the South African government needs to play a proactive role in ensuring that foreign companies that invest in the country need to be well aware of the socio-economic needs of South Africa, and be willing to play a positive role in that regard.

Exploration of the availability, development and use of learning support materials on waste management in Kwazulu Natal

This case study was done in KwaZulu–Natal province in South Africa within two municipalities Ethekwini and Umsunduzi Municipality. Three communities participated in this study. The research is motivated by the lack of cooperation between some municipalities and Community Based Organisations (CBOs) in implementing the National Waste Management Strategy (NWMS) at a local level. The primary goal is to explore the availability and development of learning support materials (LSMs) that relates to waste management in collaboration with CBOs and local councillors. The secondary goal is to explore the use of learning support material to promote participation in the implementation of the NWMS. Coresearchers were from the Community Based Organisations as well as local councillors who are located within the communities of these CBOs. Pseudonyms for co-researchers from CBOs and Councillors and the name of their townships have been used to protect co-researchers. A literature review has been conducted to explore research that has been done on the development, usage, accessibility and distribution of the LSMs. Data collection methods included semi-structured interviews; field visits to communities, tape recording of discussions and the keeping of a field journal. Some of the key findings included that LSMs is used by both CBOs and Councillors to try to reduce local environmental problems. It also identified that there are no formal mechanisms between CBOs and Municipalities in dealing with waste management programmes within the identified communities. The other important finding was that the participation of CBOs in the development of LSMs normally excludes the user groups as a result language used is not always understood. Illustrations used in some cases may be misinterpreted if the reader is not English literate as most of material in circulation is written in English. Some recommendations for further research have been made in relation to the findings made in the study. These included recommendations on the development, usage of LSMs, participation of stakeholders in resource development within the context of CBOs and local municipalities.

A critical analysis of the South African health policies and programmes with regard to eye health promotion

Eye health promotion is an important aspect of VISION 2020 campaign that aims to eliminate unwarranted cases of avoidable blindness worldwide by the year 2020. Most developing countries, including South Africa, have a serious burden of eye diseases and unwarranted causes of visual impairment and blindness. The purpose of this research therefore was to highlight the lack of an integrated eye health promotion policy in the South African primary health care system which can play a major role in the elimination of this burden of disease and also to make proposals for eye health promotion policy development in South Africa. A combination of quantitative and qualitative research methods was used in this study. Questionnaires and interviews were conducted with all national and provincial health managers of portfolios relevant to eye care. Also, various health policy documents were requested from the National and Provincial Department of Health to ascertain claims of any existing guidelines on eye care. The policy documents and guidelines obtained had no specific reference to eye health promotion. Only 11 (23%) of the managers of provincial health directorates reported that they have integrated vision screening in their health promotion programmes as part of eye health promotion strategies. Eye care managers in the provinces reported that school visits accounted for 75% of eye health promotion programmes target areas. Also, apart from the Northern Cape Province which has no eye care manager and consequently no eye health promotion programmes, the Western Cape Province also does not have eye health promotion programmes and relies mostly on private sector for eye care services. The lack of an integrated eye health promotion policy and most probably the lack of a dedicated directorate that deals with eye health promotion issues may be a contributing factor to the overwhelming lack of integrated eye health promotion activities in South Africa. It is therefore recommended that an integrated eye health promotion model be developed and be part of the South African primary health care system. / Health Studies / D. Litt et Phil.
