Property rights as a public policy tool: an empirical analysis of the social and economic effects

However, the evaluation of the causal effects of land titling is a di¢ cult task. The Brazilian government through a program called ‘Papel Passado’ has issued titles, since 2004, to over 85,000 families and has the goal to reach 750,000. This thesis examines the direct impact of securing a property title on income, labor supply, happiness and child labor force participation. In order to isolate the causal role of ownership security, this study uses a comparison between two close and very similar communities in the City of Osasco (a town with 654,000 people in the S„o Paulo metropolitan area). The key point of this case is that some units get the program and others do not. One of them, Jardim Canaã was chosen to receive the titles in 2007, but the other, Jardim DR, given fiscal constraints, only will be part of the program schedule in 2012, and for that reason became the control group in this research. In terms of Public Policy response to economic growth, understand the effect on income is relevant to measure the ‘Papel Passado’ developmental impact. Furthermore, another topic in Public Policy, that is crucial for developing economies, is child labor force participation. Particularly, in Brazil, about 5.4 million children and teenagers between 5 and 17 years old are still working full time. Last, but not least, how could such subject be related with happiness? The economics of happiness has been applied to a range of issues. These include the relationship between income and happiness, inequality and poverty, the effects of macro-policies on individual welfare and the effect of institutional conditions such as democracy, federalism and security. An evaluation of happiness as a causal effect of land titling has never been applied and such thesis intends to provide an additional input regarding this topic. The estimates suggest, using basically the Difference-in-Difference (DD) econometric approach, that titling results in increase of income and decrease of child labor hours. Also, applying ordered probit model, the property rights have positive impact on happiness as well. Hence, the thesis has presented new evidence on the value of formal property rights in urban squatter community in a developing country.

Based on the Declaration of Rights, judges started to interfere in public policies and in legal relationships. This movement has caused some perplexity among the members of legal community. Some of them consider it as a threat to democratic values and popular sovereignty. Others, on the other hand, believe that this kind of judicial intervention is positive, because it makes possible to minorities to be heard and, as a result, contributes to the development of democracy. I believe that this movement is not completely understood. Moreover, I believe that we evaluate this kind of the intervention, analyzing judicial decisions only in some areas. I will try to demonstrate that we trust too much in the capacity of the Judiciary to give voice to minorities and others endangered groups. To make my point, I will observe how the Brazilian Judiciary decides demands for housing. These demands are important for three reasons. First, the lack of houses is a serious problem in Brazil. Second, in this demands we can see clearly how legal institutions can interfere in economic growth and social development. Finally, in this kind of demand, the dilemmas that modern judges face are more strikingly. In order to make my point, I will observe how the Supremo Tribunal Federal, the Superior Tribunal de Justiça and the Tribunal de Justiça de São Paulo, this last one responsible for judging the cases that happen in São Paulo, where the lack of houses is more dramatic, decide cases based on the right of housing, introduced in the Constitution in 2000. My conclusion is that judges rarely interfere in public policies in relation to housing. / Tem-se observado em todo o mundo e no Brasil, especialmente após a promulgação da Constituição Federal de 1988, uma grande alteração da postura do Judiciário, que tem se sentido à vontade para, com base na Carta de Direitos positivada no texto constitucional, interferir em decisões políticas ou em relações jurídicas. Este movimento tem causado certa perplexidade na comunidade jurídica, pois parte dela o encara como uma ameaça aos valores democráticos e à soberania popular, enquanto outros entendem que a intervenção do Judiciário nestes casos, ao ouvir imparcialmente as demandas de grupos fragilizados, tem contribuído para sua inclusão e, portanto, para o aprimoramento da democracia. O ponto de partida deste trabalho é de que a novidade do fenômeno ainda não permitiu sua completa compreensão, nem a avaliação de suas reais dimensões e que o Judiciário não é, necessariamente, mais aberto a ouvir demandas de grupos fragilizados. Para comprovar esta hipótese, observarei como o Judiciário tem atuado na questão habitacional, que constitui um tema central para a discussão do papel das instituições jurídicas, sem mencionar que constitui o déficit habitacional um problema crônico e de enorme dimensão no Brasil. Finalmente, o direito à moradia foi escolhido porque coloca, de maneira muito nítida, o juiz frente ao dilema de atuar como um agente de transformação social ou de continuar no exercício de sua função tradicional de solucionador de conflitos. Para realizar minha tarefa, observei a jurisprudência produzida pelo Supremo Tribunal Federal, pelos Superior Tribunal de Justiça e pelo Tribunal de Justiça do Estado de São Paulo, onde está localizado o maio centro urbano do Brasil e concentra-se a demanda habitacional, desde a promulgação da Emenda Constitucional n.º 26 em 14 de fevereiro de 2000 até 25 de abril de 2010. A minha conclusão é a de que os tribunais estudados pouco interferem em políticas públicas habitacionais ou em relações jurídicas para a proteção à moradia, cujo conteúdo, por esta e outras razões, continua ainda muito pouco definido.

I begin making reference to transformative constitutionalism theory, presenting its main thesis, and then I point out the transformative features of 1988’s Brazilian Constitution and make the distinction between dirigiste constitutionalism and transformative constitutionalism. Then I present and comment both the housing problem in Brazil and the Brazilian legal doctrine on housing rights. After that, I propose a multidisciplinary methodology developed to assess Courts’ transformation performance on housing rights issues. Finally, I present an empirical study that makes a systematic content analysis of 50 'class action' filled by the 'Defensoria Pública do Estado de Sao Paulo against the Municipality of São Paulo, which aims to modify the municipal housing policies to accommodate the interests of marginalized groups. I conclude that in these issues, Courts has a limited transformation capacity, since social change occurs only when political, social and economic agents are also engaged "out of court" and when there is political will of the government. / Esta dissertação tem por objetivo avaliar o desempenho transformador do Poder Judiciário em questões relacionada ao direito à moradia. O estudo tem como referência teórica o constitucionalismo transformador, razão pela qual apresenta-se suas as principais teses, aponta-se as características transformadoras da Constituição brasileira de 1988, e propõe-se uma distinção entre constitucionalismo transformador e constitucionalismo dirigente. Faz-se apresentação e crítica do problema habitacional brasileiro e da doutrina jurídica brasileira sobre direito à moradia. Propõe-se uma metodologia multidisciplinar desenvolvida para aferir o desempenho transformador do Judiciário em questões sobre o direito à moradia. Feito isso, apresenta-se um estudo empírico que faz a sistematização e análise de 50 ações civis públicas propostas pela Defensoria Pública do Estado de São Paulo em face da Prefeitura de São Paulo, em que se pretende modificar as políticas habitacionais municipais para contemplar os interesses de grupos marginalizados. Conclui-se que, nessas questões, o Judiciário tem um desempenho transformador limitado, uma vez que a transformação social pleiteada ao Judiciário só ocorre se forças econômicas, sociais e políticas estiverem mobilizadas 'extra-judicialmente' para tanto e se houver vontade política do Administrador.
