What constitutes an impeachable offense?

Owers, Christina M. 01 January 1999 (has links)
Article II of the United States Constitution reads, "The President, Vice President, and all civil Officers of the United States; shall be removed from office on impeachment for, and conviction of; treason, bribery, or other high crimes and misdemeanors." The purpose of impeachment in the United States is to deal with public officials who have abused the power of their office in one form or another. Impeachment is reserved only for government officials because it is of a different nature than ordinary criminal law. Often, impeachment proceedings arise even without evidence of any criminal offense. However, it needs to be determined if the official is guilty of an impeachable offense. This thesis examines the role of impeachment in our government and looks at the considerations used in determining if an impeachable offense has been committed.

Collins, Sally Jean Bumpas 12 1900 (has links)
This study is concerned with the problem of determining the nature of impeachable offenses through an analysis of the English theory of impeachment, colonial impeachment practice, debates in the constitutional convention and the state ratifying conventions, The Federalist Papers and debates in the first Congress, In addition, the precedents established in American cases of impeachment particularly in the trials of Judge John Pickering, Justice Samuel Chase and President Andrew Johnson are examined. Materials for the study included secondary sources, congressional records, memoirs, contemporary accounts, government documents, newspapers and trial records, The thesis concludes that impeachable offenses include non-indictable behavior and exclude misconduct outside official duties and recommends some alternative method of removal for federal judges.

January 2018 (has links)
(Resumo completo, clicar acesso eletrônico abaixo) / Abstract: In order to trigger Dilma Rousseff's impeachment in the social imaginary, social subjects make use of their previous constructed repertory of meanings. Media and judiciary system assume an important role in this process, since they hold the prerogative of structural proprieties in the modern society as producers of interpretative packages about political events. Therefore, in this dissertation journalism discourse will be inquired as a space of symbolic disputed. It seizes from the multiples structures of cultural meanings. In this case, news will be seen as a cultural product based on language, a result of cultural framings negotiated between the media outlets, the journalists, the public and the circumstances of the social context. In this sense, this dissertation seeks to discuss how Brazilian TV network Rede Globo, through its main broadcast news Jornal Nacional, constructed and imputed identities to the former president Rousseff on 2015-2016 period. In this process, old and new impeachment actors impeached not only the Rousseff function as a political agent, but also as a social subject. During this episode, public agents and members of Partido dos Trabalhadores (PT, the Brazilian Labor Party, left wing) involved on the federal investigation Operação Lava Jato, such as the former president Lula himself, did not produced a mitigating situation. On the contrary, they enhanced Rousseff guilt assumption, car journalist discourse in general categorize PT members as corrupted ... (Complete abstract click electronic access below) / Doutor
