Perfecting the Law: Law Reform and Literary Forms in the 1590s and 1600sStrain, Virginia 31 August 2011 (has links)
This dissertation examines early modern literary engagements with the rhetorical and ethical dimensions of law reform. One of the most important mechanisms of social regulation in late-Elizabethan and early-Jacobean England, law reform was a matter of, first, the “perfection” of the organization and expression of existing laws, legal instruments, and legal processes. However counter-intuitively, these officially-sponsored reforms were calculated to prevent more radical innovations that would generate “inconveniences,” systemic contradictions and uncertainties that threatened the law’s ability to produce just results. Second, law reformers generated a discourse on “execution” that targeted the character of legal representatives. This tradition of character criticism, delivered directly from the Lord Keeper’s mouth or circulated through other legal-political, literary, theatrical, didactic, and religious works, encouraged officers’ conscientious execution of their duties and alerted the English public to the signs of the abuse of authority. Law reform created a distinct critical orientation toward legal and governing activities that was reproduced throughout a system of justice in which an extraordinary number of subjects participated. It was a critical orientation, moreover, that was refracted in literature sensitive to the implications of the socio-political dominance of legal language, traditions, and officers. The principles and practices of law reform—along with the conflicts and anxieties that inspired and sprang from them—were appropriated by amateur and professional writers alike. Close readings reveal that Inns-of-Court revellers, Francis Bacon, John Donne and Shakespeare all engaged deeply with the potential, as well as the ethical and practical limitations, of law reform’s central role in local and national governance. In the Gesta Grayorum and Donne’s “Satyre V,” the reveller and the satiric speaker improvise on legal forms to compensate for the law’s imperfections that threaten the security and prosperity of the English subject. In Shakespeare’s Measure for Measure and The Winter’s Tale, the character of the legal-political officer and reformer is tested as he attempts to put policies and principles into practice.

Rehabilitation models for the treatment of historic motels and motor courtsAnderson, Jessica Lauren 07 November 2013 (has links)
This thesis presents owners, developers, and preservationists with models for the rehabilitation of motels and motor courts. The introductory section gives readers an overview of the evolution of the motor court and motel. It then focuses on the fates of motels and motor courts in the city of Austin, Texas, as an example of how owners and developers have dealt with the program type.
The second section of this thesis discusses the Route 66 Corridor Preservation Program, a federal initiative to document and conserve the road itself as well as the “significant features associated with the highway” such as roadside stands, gas stations, and motels (“Route 66 Study Act,” 1990). This section also explores two examples of owner-led efforts to preserve motels along Route 66: Boots Court in Carthage, Missouri, and the Wagon Wheel Motel in Cuba, Missouri.
The remaining sections of this thesis focus on four models for the rehabilitation of motels and motor courts. Case studies include Hotel San José, a motor court that was redeveloped into a boutique hotel in Austin, Texas; the Park Motel, a cottage court transformed into rentable business space in San Antonio, Texas; Arbor Terrace, an extended-stay hotel converted into supportive housing in Austin owned by Foundation Communities; and Costa Mesa Village, an SRO community in Costa Mesa, California, housed in a former Travelodge. For each case study, I discuss the site’s history, the original and current configurations and appearance, what makes the project successful, and whether aspects of the project are sympathetic with the goals of preservation.
When considering rehabilitation of an historic motel or motor court, developers should consider the configuration of the building and what model would best serve the existing program. Motels in tourist districts with space to provide both private and public functions may be well served to consider the boutique hotel model exemplified by Hotel San José. A motel in a business district with flexible interior spaces able to cater to a variety of tenants might look to the Park Motel and create rentable spaces for small businesses. Those interested in pursuing a nonprofit model for rehabilitating their extant building stock could consider how they could benefit their communities by becoming SRO housing like Arbor Terrace or workforce housing complexes like Costa Mesa Village.
Regardless of the project, it is clear that access to private donations, bank loans, or local and federal assistance is integral to the success of a rehabilitation project. Lambert required a sizeable loan before beginning work on Hotel San José that could only be secured when the lender was confident in the return on investment; Neighborhood Revitalization Program funds have allowed Foundation Communities to continue adding SROs in Austin. Though the Perezes didn’t divulge the amount of money spent on their adaptive reuse project, Allison Perez Johnson said that return on investment displayed by property owned by the Perez Family Trust along Broadway Street in San Antonio helped them get approved for loans for their rehabilitation project. As for properties like Harvey’s Boots Motel on Route 66, rehabilitation becomes an ongoing process that only occurs as money permits, and their ability to remain sustainable is supported by heritage tourists who patronize roadside businesses looking to find or recreate their own Route 66 adventures. / text

Legal play : the literary culture of the Inns of Court, 1572-1634Whitted, Brent Edward 11 1900 (has links)
This thesis examines the social politics of literary production at
London's Inns of Court from 1572 to 1634. Pierre Bourdieu's concepts of
cultural production are widened beyond his own French academic context so
that the Inns may be located as institutions central to the formation of literary
and, in particular, dramatic culture in early modern London.
A significant part of Bourdieu's research has concerned the
establishment of a foundation for a sociological analysis of literary works. The
literary field, Bourdieu argues, is but one of many possible fields of cultural
production—social networks of struggle over valued economic, cultural,
scientific, or religious resources. As a historically constituted arena of activity
with its own specific institutions, rules, and capital, the juridical field of early
modern London was a competitive market in which legal agents struggled for
the power to determine the law. Within this field, the Inns of Court served as
unchartered law schools in which the valuable cultural currency of the
common law was transmitted to the resident students, whose association
with this currency was crucial for their pursuit of social prestige.
Focusing on the four Inns of Court as central institutions in the
juridical field and their relationship with the larger political and economic
forces of London, that is, the field of power, the thesis demonstrates how the
literary art associated with these institutions relates to the students' struggle
for social legitimation, particularly in their interaction with the City and the
Crown. By demonstrating how the structures of literary texts reflect the
structures of the relationship between the Inns and other centers of urban
power, this analysis examines the pivotal role(s) played by law students in the
development of London's literary culture.

Mentoring of SMEs by big corporate industries as a way of mitigating the negative impact of HIV/AIDS, with particular reference to the Western Cape.Mzizi, Thandi 03 1900 (has links)
Thesis (MPhil (Industrial Psychology))--University of Stellenbosch, 2006. / The impact of HIV/AIDS on small and medium enterprises (SMEs) is little known in South Africa. SMEs are arguably the largest employer, nationally, particularly in the Western Cape. Unfortunately, SMEs fall within the profile of businesses that have neither measured the prevalence and impact of HIV/AIDS on their businesses, nor devised a response to it. Realizing the risks and costs posed by HIV/AIDS in their business partners, chief executive officers of Western Cape corporate employers, signed a pledge to mentor SMEs. This paper focuses specifically on the mentorship programme of South African Breweries (SAB), which uses taverns and shebeens as a platform for education and awareness programmes in the fight against HIV/AIDS.
This was a comparison study, which measured the Knowledge, Attitude and Practice (KAP) of trained and untrained tavern owners in four geographical areas to determine how business has responded to the epidemic. A quantitative research approach was used. The study revealed that the experimental group (trained tavern owners) displayed greater basic knowledge and understanding of HIV and AIDS, than the control group (untrained tavern owners). Some of the challenges facing workplace programmes were the involvement in programmes without enough information.
The study concluded that without capacity building through methods such as instruction, coaching, providing experience, modeling, advising, training, information sharing and resources by corporates, the negative impact of HIV/AIDS in SMEs will not be mitigated. While the survey results suggest the need for greater involvement by corporates in mentoring programmes, further research on the role of the private sector in HIV/AIDS management is necessary.

Que medidas de sustentabilidade ambiental estão implantadas nos meios de hospedagem do Roteiro Turístico Vale dos Vinhedos? A partir desse questionamento, o estudo tem por objetivo analisar as ações de sustentabilidade ambiental desenvolvidas em hotéis e pousadas do roteiro. A pesquisa, de caráter exploratório, utiliza como técnicas de coleta de dados, o questionário e a observação direta. O questionário aplicado aos gestores, embasado em um roteiro de 13 questões, buscou informações sobre: redução no consumo de energia elétrica e aumento de eficiência energética; redução do consumo de água; gestão de resíduos sólidos; meios para pesquisar a opinião de hóspedes sobre os serviços ofertados; critérios ambientais de seleção de fornecedores; medidas para minimizar a emissão de ruídos, gases e odores; programas de capacitação para colaboradores e de sensibilização para hóspedes; tratamento de efluentes e certificação ambiental por organismo especializado. Para a elaboração do questionário, foi utilizada, como ferramenta, a Matriz de Classificação dos Meios de Hospedagem do Ministério do Turismo de 2011. A observação direta foi realizada em todos os setores dos meios de hospedagem pesquisados, no sentido de identificar as ações ambientais implantadas. Os resultados demonstram como os meios de hospedagem desenvolvem ações, práticas ou programas de sustentabilidade ambiental. Constata-se que 100% das informações dos gestores indicam que as medidas de sustentabilidade são implantadas e realizadas. No entanto, são escassas as ações referentes à certificação por organismo especializado, restringindo-se, apenas, a certificações de licença ambiental de órgãos municipais. Das medidas ambientais, a redução no consumo de energia elétrica e o aumento da eficiência energética são as mais adotadas pelos meios de hospedagem. From that question, the study aims to analyze the environmental sustainability actions developed in hotels and hostels in the route. From exploratory character, the research uses as data collection techniques, questionnaire and direct observation. The questionnaire applied to the managers, based on 13 questions, it searched information about: reduction in electrical energy consumption and energetic efficiency increase; water consumption reduction; solid residue management; means for searching the guests opinion about offered services; environmental criteria for suppliers selection; measures to minimize odors, gases and noises emission; training programs for collaborators and sensitization to guests; effluents treatment and environmental certification by specialized organism. For the questionnaire preparation was used as a tool, the 2011 Tourism Ministry’s Lodging Means Rating Matrix. Direct observation was accomplished in all sectors of the lodging means searched to identify the implemented environmental actions. The results demonstrate as the lodging means develop actions, practices or environmental sustainability programs. It verifies itself that 100% of the managers information indicate that sustainability measures are implemented and accomplished. However, the actions relating to certification by specialized organism are insufficient, refraining from only the environmental license certification municipal sectors. From the environmental measures, reduction in electrical energy consumption and energetic efficiency increase are the most adopted by the lodging means. It follows that it proposes which the lodging means make available in their websites, the actions or constant environmental practices of its planning and that they are accomplished internal training programs for managers and collaborators, as well as guests sensitization, to motivate them and compromise them with implemented environmental sustainability actions in the lodging means.
