Moreover, it will be argued if in the panorama of a Democratic State of Right it exist space for this species of punishment. The objective in the dissertation are: to analyze the use political of the punishment since a historical point of view; to argue the democratic pretension of modernity and to critically analyze the function of the punishment in the societies of Interactive Modernity. / No presente trabalho ser?o abordadas as fun??es atribu?das ? pena privativa de liberdade, sejam as propostas retributivas e preventivas, ou de sustenta??o do modo de produ??o capitalista ou como forma de exerc?cio do poder disciplinar. Ocorre que tais proposi??es n?o se ajustam ? crescente prolifera??o de modelos prisionais, onde n?o se permite a comunica??o do condenado. Al?m disso, discutir-se-? se no panorama de um Estado Democr?tico de Direito existe espa?o para esta esp?cie de pena. Para desenvolver esse tema foram estabelecidos como objetivos: analisar o uso pol?tico da pena desde um ponto de vista hist?rico; discutir a pretens?o democr?tica da modernidade ou p?s-modernidade e analisar criticamente a fun??o da pena nas sociedades da Modernidade Interativa.
