The contestation of nonintervention : international order and emergence of the responsibility to protect (R2P)

This thesis examines how the norm of nonintervention has interacted with the norm of the Responsibility to Protect (R2P) to construct a new normative architecture of international order. Nonintervention has long served as a deeply embedded norm in the international normative architecture. However, conflicting interpretations of how to respond in cases of egregious intra-state human rights abuses have fuelled contestation surrounding the potential for international protection measures including the projection of force. Drawing from international relations theory, I embrace a social constructivist approach with insights from the English School to explore the nature of normative structures and their role in undergirding international society. While foreign policy decisions reflect a spectrum of normative and non-normative considerations, norms serve as resources that guide and shape the behaviour of actors. Outlining the emergence of R2P and its invocation through empirical cases of mass atrocities in Sri Lanka (2009), Libya (2011), and Syria (2011-2015), this thesis traces the contestation of nonintervention through cases of intra-state humanitarian crises. I conclude that nonintervention has recurrently challenged R2P as a means of securing international order and the rights of independent political communities, with its persistent salience serving as a barrier to intervention and more expansive interpretations of R2P.

Between Non-intervention and Protection: A study on the case of Darfur and the Responsibility to Protect

This thesis explores the obstacles in establishing a consistent and effective response framework for humanitarian catastrophe and the importance of maintaining a sustained dialogue to this end. It does so by recognizing the underlying conflict between two positions: the norm of non-intervention of states into the affairs of others, and the protection of individuals caught in the middle of violent conflict. The importance of working towards a resolution of this conflict is illustrated through the case study of Darfur, where a divided international community led an insufficient response to the crisis that can ultimately be judged as a failure. Lastly, a recent attempt at reconciling the non-intervention/protection conflict is examined through the report of the Responsibility to Protect, which takes important steps in the direction of consensus, but ultimately suffers from inflated expectations regarding its scope or purpose.

United Nations mediation in Africa: a case study of the Bakassi conflict intervention, 2002-2006

Just as conflict is part of everyday life, mediation can and is practiced everyday and everywhere. It is a way of reaching decisions in a cooperative, non-hierarchical way, allowing for clear and open communication processes. Conflicts can be resolved in a formal manner through courts, arbitration, ombudspeople, diplomacy and mediation, or an informal manner through friends, colleagues, religious and community leaders, and dialogue. The way in which people resolve their disputes has an impact on how societies and institutions are governed. The war in Bakassi has taken its toll on the people of that area for several years now and has witnessed people from Bakassi facing some of the worst effects of armed conflict known to man. This study investigated the use of international mediation in the management of intractable conflict with a specific case study on the Bakassi peninsula conflict between Cameroon and Nigeria. It focused on the mediation process as a conflict management technique in relation to the international relations theories which has been used as a basis for conflict resolution practices. The researcher conducted a document review, content analysis on selected documents and this was supported by strategic interviews. The findings as well as the researcher‘s recommendations are discussed in the study in order to assist the future work of conflict management specialists and other stakeholders who have devoted their efforts to the recovery of areas emerging from conflict.

Protection against torture in international law

This limited scope dissertation deals with the protection against torture in international law. The mechanisms which have been established over the years to protect individuals against torture are analysed. The principles of international customary law dealing with torture and the United Nations Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (UNCAT) have been examined against the failure by States to honour their obligations under the Treaty and other legal normative rules. This required deep exploration of the definition of torture and how States can compromise the rule of law by manipulating the definition of torture as contemplated by the Treaty or other instruments. Examples from the former US government highlight the ways in which domestic laws can be used and are continued to be used to allow the use of torture. Measures by South Africa in joining the international community in the fight against torture are also discussed as a case study. While all efforts have been made by the South African system to adopt desirable frame works on the protection of individuals against torture, the lack of education on torture remains the down fall of the system. The dissertation clearly explains that universal jurisdiction applies in respect of torture and this is recognised by both treaty law and customary law. Indeed despite all the current measures in place the use of torture persists. The research clearly reveals that countries hide behind their own laws to perpetrate acts of torture. It is then recommended that proper implementation of the legal structures, informed of the objectives of the structures, is essential in completely eradicating torture. / Public, Constitutional, and International Law / LLM
