Within this perspective, begins by explaining the bodies responsible for constitutional activity of National Defence and Public Security, showing then the military justice system defined by the Federal Constitution of 1988 for the application of standards to military criminal law, which highlighted judicial courts and prosecutors with a high degree of expertise. Deepens the discussion on the Judicial Military Police model adopted in Brazil to promote the military criminal investigations, revealing its shortcomings and the indispensability of his readaptation, celing by a lack of professionalization of charge by carrying out the assignment. Under this framework, ends by demonstrating that all administrative activity, including the judicial police activity, is subject to the constitutional principle of efficiency, which projects into various pecularities of investigative actions, notably in productivity, quality and speed. This study also advances on constitutional and infra-constitutional design of the external control of police activity in its different forms of expression, indicating the possibility that the Military Prosecutor had to be more effective control of the investigations carried out by the Military Judicial Police, which there always be guided by the highest efficiency and the unrestricted respect for fundamental rights and guarantees. The final approach is suggesting solutions to improve the profile of the military judicial police activity - proposing its institutionalization; as well as the profile of the external control exercised by the Military Public Ministry, whose demands more widened especially with the advent of the National Council of the Public Ministry as external control agency, which has worked for the improvement of the national Public Ministry. / A presente disserta????o trata do tema do controle externo da atividade de pol??cia, conferindo especial ??nfase ao controle da atividade de pol??cia judici??ria militar e a necessidade de se garantir a sua plena efici??ncia. Dentro dessa perspectiva, principia por explicitar os ??rg??os incumbidos da atividade constitucional de Defesa Nacional e de Seguran??a P??blica, evidenciando, em seguida, o sistema de justi??a militar definido pela Carta de 1988 para aplica????o das normas afetas ao ordenamento penal militar, em que se destacam ??rg??os judiciais e um Minist??rio P??blico com elevado grau de especializa????o. Aprofunda a discuss??o em torno do modelo de Pol??cia Judici??ria Militar adotado no Brasil para promover as investiga????es criminais militares, revelando suas defici??ncias e a imprescindibilidade de sua readequa????o, m??xime pela aus??ncia de uma profissionaliza????o dos encarregados pelo cumprimento da referida atribui????o. O controle judicial da san??o disciplinar militar ? luz do princ?pio da proporcionalidade e os princ?pios da hierarquia e disciplina

The method of approach is deductive and methods of procedure are documentary and bibliographic. Works with the hypothesis that it is appropriate to judicial review of sanction disciplinary military when disproportionate since performed with the appropriate modus operandi, because the impairment of military hierarchy and discipline will occur if the judge does not have mastery of the topic and its specificity, nor are observed significant issues, procedural and material. The administrative discretion is treated to deny unrestricted freedom and the binding is designed not only as a link to the law, but to the system, whereat it is important to refer to the constitutional principles, especially that of proportionality. Within this theme, the approach of the fundamental right to good public administration gains special importance, it goes beyond the construction of public policies, efficiency, transparency, to encompass also the "good decision", in other words, the administrative decision-making acts are in accordance with the legal system. Recognizes the specificity of the "military life" that imposes self-denial and sacrifice without correspondence in "civilian life", including, often, with his life in the name of achieving constitutional mission assigned to the armed forces. It is argued, however, that this specificity is not obstacle to prevent judicial review of sanction disciplinary military. The control activity punitive gives more credibility to the penalty imposed, and the long-term, strengthens the hierarchy and discipline within the military organizations. Regarding the technicality involving the theme, the magistrate may make avail of specialized staff, especially for the more complex issues involving the day to day of the barracks. It is considered, finally, that judicial review should be carried out in a systematic way, with the breakdown of the principle of proportionality in subprinciples the appropriateness, necessity and proportionality in the strict sense, as well as the declaration of nullity of the act, if the case, but without pointing that the act should be practiced by the administrator, it is not for the judge to make the role of the military sanctioning authority in respect of the principle of separation of powers. / A presente disserta??o apresenta o problema do controle judicial da san??o disciplinar militar desproporcional em face dos princ?pios da hierarquia e disciplina que estruturam as organiza??o militares das For?as Armadas brasileira. O m?todo de abordagem ? o dedutivo e os m?todos de procedimento s?o o documental e o bibliogr?fico. Trabalha-se com a hip?tese de que ? cab?vel a revis?o judicial da san??o disciplinar militar, quando desproporcional, desde que realizada com o modus operandi adequado, pois o enfraquecimento da hierarquia e disciplina militares ocorrer? se o juiz n?o tiver dom?nio do tema e de sua especificidade, bem como, se n?o forem observadas quest?es importantes, procedimentais e materiais. A discricionariedade administrativa ? tratada de modo a se negar uma liberdade sem restri??es e a vincula??o ? concebida, n?o somente como vincula??o ? lei, mas ao sistema, pelo que se faz importante a refer?ncia aos princ?pios constitucionais, sobretudo o da proporcionalidade. Dentro deste tema, especial relevo ganha a abordagem do direito fundamental ? boa administra??o p?blica que vai al?m da constru??o de pol?ticas p?blicas, da efici?ncia, da transpar?ncia, para abarcar tamb?m a boa decis?o, ou seja, os atos administrativos decis?rios em conformidade com o sistema jur?dico. Reconhece-se a especificidade da vida militar, que imp?e abnega??o e sacrif?cios sem correspond?ncia na vida civil, inclusive, muitas vezes, com risco ? pr?pria vida em nome da consecu??o da miss?o constitucional atribu?da ?s For?as Armadas. Defende-se, no entanto, que essa especificidade n?o ? ?bice a impedir o controle judicial da san??o disciplinar militar. O controle da atividade sancionadora confere maior credibilidade ? penalidade aplicada e, a longo prazo, fortalece a hierarquia e a disciplina dentro das organiza??es militares. Quanto ? tecnicidade que envolve o tema, o magistrado poder? se valer de corpo t?cnico especializado, especialmente para as quest?es mais complexas que envolvam o dia a dia da caserna. Pondera-se, finalmente, que a revis?o judicial dever? ser realizada de forma sist?mica, com o desmembramento do princ?pio da proporcionalidade nos subprinc?pios da adequa??o, da necessidade e da proporcionalidade em sentido estrito, bem como com a declara??o da invalidade do ato, se for o caso, mas sem apontar qual o ato dever? ser praticado pelo administrador, n?o cabendo ao juiz o papel da autoridade sancionadora militar, em respeito ao princ?pio da separa??o dos poderes.
