Within this perspective, begins by explaining the bodies responsible for constitutional activity of National Defence and Public Security, showing then the military justice system defined by the Federal Constitution of 1988 for the application of standards to military criminal law, which highlighted judicial courts and prosecutors with a high degree of expertise. Deepens the discussion on the Judicial Military Police model adopted in Brazil to promote the military criminal investigations, revealing its shortcomings and the indispensability of his readaptation, celing by a lack of professionalization of charge by carrying out the assignment. Under this framework, ends by demonstrating that all administrative activity, including the judicial police activity, is subject to the constitutional principle of efficiency, which projects into various pecularities of investigative actions, notably in productivity, quality and speed. This study also advances on constitutional and infra-constitutional design of the external control of police activity in its different forms of expression, indicating the possibility that the Military Prosecutor had to be more effective control of the investigations carried out by the Military Judicial Police, which there always be guided by the highest efficiency and the unrestricted respect for fundamental rights and guarantees. The final approach is suggesting solutions to improve the profile of the military judicial police activity - proposing its institutionalization; as well as the profile of the external control exercised by the Military Public Ministry, whose demands more widened especially with the advent of the National Council of the Public Ministry as external control agency, which has worked for the improvement of the national Public Ministry. / A presente disserta????o trata do tema do controle externo da atividade de pol??cia, conferindo especial ??nfase ao controle da atividade de pol??cia judici??ria militar e a necessidade de se garantir a sua plena efici??ncia. Dentro dessa perspectiva, principia por explicitar os ??rg??os incumbidos da atividade constitucional de Defesa Nacional e de Seguran??a P??blica, evidenciando, em seguida, o sistema de justi??a militar definido pela Carta de 1988 para aplica????o das normas afetas ao ordenamento penal militar, em que se destacam ??rg??os judiciais e um Minist??rio P??blico com elevado grau de especializa????o. Aprofunda a discuss??o em torno do modelo de Pol??cia Judici??ria Militar adotado no Brasil para promover as investiga????es criminais militares, revelando suas defici??ncias e a imprescindibilidade de sua readequa????o, m??xime pela aus??ncia de uma profissionaliza????o dos encarregados pelo cumprimento da referida atribui????o. The paper uses as a reference the transformation of the conception of Public Security held in the countries of consolidated democracy and the way the transition to democracy occurred in Brazil, taking into account the theoretical framework of the Transitional Justice. To analyze such consequences the paper gives an overview of actions taken at the federal level over the first three decades after democracy, from the role of the Armed Forces, the National Secretariat of Public Security and the National Human Rights Secretariat. To complement this assessment the paper also presents a survey of the level of transparency of state agencies of Public Safety, and discusses how transparency can be a transitional mechanism with potential to bring about changes on authoritarian traditions. The paper concludes that these traditions held great power and influence in decision-making processes in the Brazilian Public Security area along the first three post-democratization decades, keeping current militarized and bureaucratic vision with closed institutions without transparency, therefore preventing the area of public security to make the transition to a democratic conception. / O presente trabalho busca discutir as consequ?ncias da tradi??o autorit?ria sobre o uso da for?a, refor?adas pelo regime autorit?rio vivido no Brasil entre 1964 e 1988, na concep??o de Seguran?a P?blica vigente no Brasil. O trabalho utiliza como refer?ncia a transforma??o da concep??o de Seguran?a P?blica ocorrida nos pa?ses de democracia consolidada e a forma como ocorreu a transi??o para o regime democr?tico no Brasil, a partir dos referenciais te?ricos da Justi?a de Transi??o. Para analisar essas consequ?ncias o trabalho apresenta um balan?o das a??es realizadas em n?vel federal ao longo das tr?s primeiras d?cadas p?s- redemocratiza??o, a partir do papel das For?as Armadas, da Secretaria Nacional de Seguran?a P?blica e da Secretaria Nacional de Direitos Humanos. Para complementar essa avalia??o o trabalho ainda apresenta uma pesquisa sobre o n?vel de transpar?ncia dos ?rg?os estaduais de Seguran?a P?blica e como a transpar?ncia pode ser um mecanismo transicional com potencial para provocar mudan?as sobre tradi??es autorit?rias. O trabalho conclui que essas tradi??es mantiveram grande for?a e influ?ncia nos processos de tomada de decis?o na Seguran?a P?blica brasileira ao longo das tr?s primeiras d?cadas p?s- redemocratiza??o, mantendo vigente uma vis?o militarizada e burocr?tica, com institui??es fechadas e sem transpar?ncia, o que impedem a transi??o da ?rea para uma concep??o democr?tica.
