In Brazil, currently, the law provides some mechanisms for the realization of the right to social housing, through the acquisition of land for the purpose of social inclusion of people living in poor or substandard dwellings and therefore scope for developing citizenship. The right to housing is a social and human right, as recognized by Art. 6, caput, of the Federal Constitution of 1988 and the Habitat Agenda, organized by the United Nations Conference on Human Settlements - Habitat II, held in Instambul in 1996. And yet, the need to overcome the problem of land in slums and squatter settlements located in major urban centers, makes relevant the present work, in order to identify the causes that led to the agrarian conflict in the country, the problems arising from these areas and that reflect on the lives of urban dwellers as well as an analysis of one of the legal instruments to deal with this problem. / A presente dissertação objetiva analisar o instituto da usucapião coletiva urbana, enquanto instrumento de Política Urbana para promover a regularização fundiária e urbanização das favelas na cidade de São Paulo. No Brasil, atualmente, a legislação dispõe de alguns mecanismos para a efetivação do direito social de moradia, por meio da aquisição da propriedade imobiliária, com a finalidade de inclusão social dos habitantes que residem em moradias precárias ou subnormais e, consequentemente, alcance do desenvolvimento da cidadania. O direito à moradia é, um direito social e humano, conforme reconhecido pelo art. 6º, caput, da Constituição Federal de 1988 e pela Agenda Habitat, organizada pela Conferência das Nações Unidas sobre Assentamentos Humanos Habitat II, realizada em Instambul, em 1996. E, ainda, a necessidade de superação do problema fundiário nos assentamentos irregulares e favelas localizadas em importantes centros urbanos brasileiros, faz pertinente o presente trabalho, a fim de identificar as causas que originaram o conflito fundiário no País, os problemas decorrentes dessas áreas e que refletem na vida dos habitantes urbanos, bem como uma analise de um dos instrumentos jurídicos de tratamento deste problema.

Territoire, trajectoire, réseau Créativité rituelle populaire, identification et État postcolonial (Une triple étude de cas malgache)

Ce travail décrit et analyse comparativement trois phénomènes religieux ethnographiés ces dernières années à Madagascar que l'expédient sémantique "créativité rituelle populaire" caractérise assez bien, et que l'on peut respectivement étiqueter ainsi : cérémonie d'anti-sorcellerie (1975-1983, Nord-Est) ; procession funéraire (oct. 2001-jan. 2002, extrême Sud) ; culte de possession (à partir de la fin des années 1980, ville de Tuléar). La comparaison de ces phénomènes entre eux met d'abord en évidence une certaine homologie entre les deux premiers par rapport au troisième : ils s'en distinguent par leur mobilité, leur coïncidence avec une conjoncture nationale forte, ainsi que par leurs rapports vifs et contrastés avec des représentants de l'État. L'analyse met ensuite en évidence une analogie entre les deux premiers cas et la politique nationale qui leur est synchronique. Cette étude des relations pragmatiques s'exerçant dans les cadres spécifiques de ces rituels dégagent trois modèles de structuration du pouvoir agissant comme des matrices d'inter-subjectivité, appelés "territoire", "trajectoire", et "réseau". Sans postuler un rapport de détermination "par le haut", il s'agit enfin de rendre compte de l'activation sociologique de ces modèles, posée en termes de construction de légitimité. En définitif, c'est à la construction d'une identité collective par le bas et en acte, par rituel, que ces phénomènes amènent à réfléchir et théoriser. Il est remarquable de constater que ces dispositifs empruntent en les remaniant certaines représentations et pratiques à la sphère étatique en les intégrant dans les champs de l'ancestralité.

Examining adherence with medications used in treating diabetic peripheral neuropathic pain

The present study is a retrospective cohort analysis which sought to examine adherence to medications used in managing painful diabetic peripheral neuropathy (PDPN) and to determine their association with oral antidiabetic (OAD) medication adherence using the Texas Medicaid prescription claims database. The study objectives were to: 1) provide a description of PDPN and OAD medication use among the study subjects; 2) determine if PDPN medication adherence differs among individual PDPN agents (i.e., tricyclic antidepressants, gabapentin, pregabalin and duloxetine); 3) determine if pre-index OAD and post-index OAD medication adherence differs among mono, dual, and triple OAD therapies; and 4) determine if PDPN medication adherence is related to post-index OAD medication adherence while controlling for covariates. Study participants were adult (≥18 years) Medicaid beneficiaries prescribed OAD and PDPN medications. The index date was the first PDPN prescription. Data were extracted from June 1, 2003 to October 31, 2009 and prescription claims were analyzed over an 18-month study period (i.e., 6 months pre-index and 12 months post index period). Medication possession ratio (MPR) was used as a proxy measure of medication adherence. An MPR less than 80 percent was regarded as being non-adherent to prescribed medication, while an MPR greater than or equal to 80 percent was regarded as being adherent to prescribed medication. Objective 1 was addressed using descriptive statistics (i.e., mean, standard deviation, frequency). Univariate analysis (ANOVA) was employed to address Objectives 2 and 3. Multivariate analyses (i.e., multiple linear regression and logistic regression) were conducted to address Objective 4. For the logistic regression MPR was dichotomized at the cut-off value of 80 percent. A total of 4,277 patients met the study’s inclusion criteria. The overall mean MPR (±SD) for PDPN medications was 75.4 percent (±23.9). Mean MPR (±SD) was highest for duloxetine (85.6% ±18.2) and was lowest for pregabalin (69.4% ±24.9). Mean MPR differed significantly among individual PDPN medications (p<0.0001). The overall mean MPR (±SD) for OAD medications in the pre and post-index period was 73.0 percent (±24.3) and 64.5 percent (±25.6) respectively. In both pre and post-index periods, mean MPR differed significantly among mono, dual, and triple OAD therapies (p<0.0001). In the pre-index period, mean MPR (±SD) was highest for monotherapy users (75.4% ±24.7) and was lowest for triple therapy users (63.9% ±22.9). Similarly, mean MPR (±SD) was highest for monotherapy users (69.0% ±26.1) and was lowest for triple therapy users (52.9% ±21.8) in the post-index period. After controlling for the covariates, PDPN adherence (i.e., MPR) was statistically significant (p<0.0001) and positively related to post-index OAD adherence (i.e., MPR). PDPN patients who were non-adherent (i.e., MPR<80%) to their PDPN medications (or neuropathic pain medications), compared to those who were adherent (MPR≥80%), were significantly less likely to be adherent to their OAD medications [Odds Ratio (OR) = 0.626, 95% CI=0.545-0.719]. In addition, post-index OAD adherence (i.e., MPR) did not differ significantly (p>0.05) when pregabalin, duloxetine and gabapentin users were individually compared to tricyclic antidepressants users. In conclusion, PDPN patients who were adherent (i.e., MPR≥80%) to their PDPN medications, compared to those who were not adherent (i.e., MPR<80%), were more adherent to their OAD medications. Also, adherence to OAD medications was independent of the type of PDPN medication used. PDPN patients need to be educated regularly that neuropathic pain medications only relieve the pain associated with the neuropathy but achieving adequate glycemic control remains the only established approach for slowing down the progression of the neuropathy and other complications associated with the diabetes. / text

The relationship between mbira dzavadzimu mode and Zezuru Spirit Possession. This thesis investigates the relationship between mbira dzavadzimu modes and different levels of Zezuru spirit possession. The research adopted an ethnographic paradigm. Fieldwork, participant observation, face-to-face interviews and video recordings were employed during data collection. The theoretical underpinnings of the research were grounded in Neher’s 1960 theory of auditory driving1, Seeger’s 1987 theory of metamorphosis, Wiredu’s 2007 theory of interpretation and Tempels’ 1959 theory of cosmology. The researcher carried out the research from an emic perspective. Both deep reflexivity and narrative reflexivity frameworks were used in the writing of this documentation and editing of my film. The position of mbira music in the religious life of the Zezuru is quite significant in that it is used to evoke spirits in spirit mediums during occasions when the Zezuru communicate with their ancestors. Mbira music is embedded in the modes and tuning systems played on the mbira. The Zezuru believe that the modes belong to the ancestors and are passed from generation to generation as part of their heritage. Cette recherche propose un modèle théorique qui distingue deux modalités d'expérience de consommation appliquée au domaine de l'oeuvre d'art contemporain: à travers la possession d'une part, à travers l'accès à l'expérience sans possession d'autre part, ainsi qu'une analyse des deux catégories de consommateurs étudiées: les visiteurs et les collectionneurs. Ce modèle est fondé à la fois sur des réflexions philosophiques -en ce qui concerne les modes d'existence "avoir ou être"- et sur les analyses du désir du consommateur avant et après l'expérience de consommation, c'est-à-dire la valeur perçue. Les résultats empiriques, à travers deux études qualitatives (entretiens profonds et notes personnelles, analyses du contenu et analyses intra-inter textuelles) et deux études quantitatives (questionnaires, analyse factorielles et modélisation avec équations structurelles) avec l'échantillon des visiteurs et des collectionneurs d'art contemporain, montrent que le désir du consommateur est différent vis-à-vis de l'accès -la visite- et vis-à-vis de la possession. Ainsi la population désire-t-elle davantage d'évasion, de surprise, d'esthétique et de calme par la visite d'exposition d'art contemporain. Les valeurs perçues après la visite sont celles d'évasion, de stimulation et de philanthropie. A l'inverse, la population montre le désir de "garder des liens familiaux" par la possession d'oeuvres d'art contemporain. La valeur perçue après la possession est celle de contentement. Curieusement, les collectionneurs d'oeuvres d'art contemporain ne montrent pas un désir possessif plus fort que les visiteurs. Ils ont, en revanche, un désir philanthropique significativement plus marqué alors que les visiteurs, de leur côté, montrent un désir d'intellectualité plus affirmé que les collectionneurs.

Au cours des dernières quarante années un grand nombre d'études ont analysé les comportements de possession et utilisation des véhicules. Cependant, la plupart de ces études traitent le problème d'un point de vue statique, en omettant les dynamiques qui vraisemblablement guident ces décisions. Le caractère durable des véhicules suggère l'importance de ne pas ignorer l'aspect dynamique des problèmes d'achat, possession et utilisation automobile. Ce travail utilise une approche désagrégée structurelle, basée sur des choix. Le document est composé de trois parties. La première propose une description du problème, par l'analyse de la littérature existante. La seconde présente les opérations préliminaires effectuées sur la base "Parc Auto" pour pouvoir l'utiliser comme panel de véhicules. La dernière partie a pour objectif d'introduire les quatre applications réalisées au cours de ma thèse de doctorat. Une première application propose une approche hédoniste des prix des véhicules. Le deuxième chapitre de cette dernière partie estime un modèle de Rust pour des ménages mono-équipés (c'est à dire une seule voiture à disposition par année) les décisions concernant leur voiture. Un modèle dynamique discret\continu des choix de la durée de possession et d'utilisation des véhicules pour des agents tant myopes que prévoyants. Le dernier chapitre présente un programme dynamique tourné vers le futur pour le problème de la planification des achats. Dans les trois applications, un facteur d'actualisation est utilisé pour tester différents hypothèses de comportement dynamique. Mes résultats indiquent que la préférence temporelle d'un ménage est un élément crucial dans étude de ces décisions. / During the last fort Y years, a large number of studies have analyzed the behaviors related to car holding and use. However, the majority of these studies consider the subject from a static point of view, ignoring the household dynamics and the driver's needs, which are very likely to drive such decisions. The durable character of a vehicle suggests however that such a dynamic cannot be ignored in the study of the vehicle purchase, holding and use decisions. This work employs a disaggregated, structural approach based on real choice to address these dynamics. The document is composed of three parts. In the first part a description of the problem is provided through an analysis of the available literature. The second part includes the description of the operations which are performed on "Parc Auto". This database needs in fact some preliminary treatment if one wants to use it as a vehicle's Panel. In the last part the four applications considered are presented. A first application proposes a hedonic approach to the vehicles' prices. The second chapter of this last part estimates the Rust model for mono-equipped (Le. only one car owned each year) households' decisions concerning their car. A dynamic discrete\continuous choice model of car holding duration and use for both myopic and forward-Iooking agents follow. ln the last chapter a dynamic forward-Iooking program for the purchase planning problem is presented. ln the three dynamic applications, a discount factor tests different effects of dynamic behavior. My findings indicate that a household's time preference is a crucial element in studying these decisions.

Commun aux diverses provinces de l’Empire, il permet autant d’établir un lien administratif, commercial et culturel avec la capitale romaine, qu’il creuse un fossé entre ceux qui savent la maîtriser, et les autres. Instrument du quotidien des forts romains, l’écrit est le liant indispensable permettant aux légions en place de gérer le territoire. Le monde civil n’est pas en reste. Au-delà de la symbolique, c’est l’ensemble des activités funéraires, alimentaires, économiques ou encore religieuses qui semble avoir été impacté. Tout Breton baigne, à divers degrés, dans cette nouvelle culture de la communication écrite, celle d’une expression durable de la volonté, qu’elle soit individuelle ou commune. Likewise, he tell us regarding the cumbersome situation and the null legal certainty that existed about this theme before the emission of the Fourth Civil Cassation Plenaries.After the Plenaries, the author points, were given rules to identify this matterand reach uniforms conclusions by judges, which represents an advance in the predictability of the judicial decisions about the eviction by precarious occupation. / En el presente artículo el autor no presenta la situación de los precarios y los procesos de desalojos donde se ven involucrados. Asimismo, nos cuenta acerca de la situación engorrosa y la nula seguridad jurídica que existía acerca del tema antes de la emisión del Cuarto Pleno Casatorio Civil. A partir del Pleno, señala el autor, se dieron reglas para identificar este problema y llegar a conclusiones uniformes por parte de los jueces, lo que representa un avance en la predictibilidad de las resoluciones judiciales sobre el desalojo por ocupación precaria.

Name: The acquisition of ownership My dissertation deals with the area of the acquisition of ownership, more precisely acquisition of title. I chose this topic after consulting my supervisor at the beginning of my course in 2010. During the course of my studies, however, a new Civil Code (Act no. 89/2012 Coll.) was adopted and came into effect in January 2014. This therefore presented an opportunity to compare the existing regulations contained in Act no. 40/1964 Coll. (now designated as the old Civil Code) with the new regulation, as well as with other regulations such as Act no. 141/1950 Coll. (designated as the middle Civil Code), the government draft of the Civil Code dating from 1937 which was never adopted due to the developments in the political situation and the General Civil Code which was adopted from the Austrian law known as the ABGB (Allgemeines bürgerliches Gesetzbuch ). Some institutions of original acquisition have also been compared with the German BGB (Bürgerliches Gesetzbuch) or the new Russian Civil Code.
