Právní úprava pozemkových úprav / Legal aspects of land consolidation

Since the second half of the 19th century the land consolidation has been carried out as an administrative proceeding in the territory of the Czech Republic. As a result of a gradual development, the scope of land consolidation is becoming broader and goals of the proceeding are becoming more and more ambitious. What issues can be solved using land consolidation and which instruments are used to accomplish that? How do public and private interests affect the land consolidation and parties to the proceeding? What is, or rather what should be the course of the land consolidation proceedings? Are measures adopted in the proceeding actually being implemented in the landscape? Submitted master's thesis draws attention to substantive and procedural aspects of the matter, relevant case law, as well as statistical data and other evidence regarding concluded land consolidation. The first part of the thesis deals with historical development of land consolidation, focusing on the 19th and 20th century. This chapter aims to allow for a better understanding of the basis of the effective legal regulation, which adopts some former concepts, while firmly abandoning others. 政府自民國七十六年起,即以土地重劃方式試辦農村社區土地重劃,且陸續針對農村社區相關民生公共建設制訂相關法規,於民國八十九年公佈實施【農村社區土地重劃條例】,使農村辦理整體建設配合地籍重整及交換分合有法源的依據。不過,農村社區土地重劃業務實施至民國九十六年底,已進行農村社區土地重劃建設之社區僅有四十八個,所佔比例甚低,且農村社區土地重劃實施之內容,僅偏重在公共設施之硬體建設,以應居住生活之需,然其與農地重劃之配合,及其對生態環境之維護卻顯得十分不足,理當進一步檢討與改進。再者,放眼國際,知悉國外農村土地重劃制度之演化值得我國省思,尤其是德國之農村土地重劃實施百年之經驗別具特色,該國不僅著眼在調整坵塊型態及耕地結構等方面,同時也配合農村發展策略與自然景觀維護,以發揮農村地區生態與景觀維護之功能。由此知悉現代化土地重劃已不再僅是改善農業生產結構之手段,而是被視為一種多目標的農村發展工具。 因此,本研究主要運用文獻分析法、案例研究法及深度訪談法,對欲擬列探討之課題作深入的研究。收集國內外農村社區土地重劃相關文獻,包括:農村規劃的理論和方法,及相關法律規定與案例等,從中探悉如德國等先進國家藉由推動農村土地重劃以促進農村發展的經驗;另針對目前台灣農村社區土地重劃的功能及實施過程所遭遇之問題等項目加以探討,並透過深度訪談之方式,以瞭解地方居民的想法與意見,並觀察重劃後之發展是否達到其原先設定規劃之目標與效益,再藉由德國實施農村土地重劃之規劃原則,加以檢討我國重劃制度之方向與問題,最後研提未來的改進方案,以供有關當局之參酌。 / The government has been trying to readjust the rural community by land consolidation, and formulate relevant laws and regulations one after another on public construction, which is related to people's livelihood of the rural community. In the 89th year, the government published the “Regulations on Land consolidation in Rural Communities”, serving as the source of law in the steady implementation of the cooperation between the overall construction and the re-construction of rural communities, as well as the exchange of cadastral division. However, in the end of the 96th year of R.O.C., the implementation of re-zoning the land of rural communities has only covered 48 communities, which have been readjusted and re-constructed. The proportion is very low. What’s more, as to the content of the implementation, it focused on hardware construction of public facilities to meet the needs of living. Speaking of its relationship between agriculture and land consolidation and its impact on the maintenance of the ecological environment, it is insufficient. We should further review and improve it. Furthermore, if we look into the international situation, we will figure out the evolution of foreign systems of rural land consolidation. Especially in Germany's rural land consolidation, the experience of implementing the consolidation of the rural land for a hundred years is unique. It focuses not only on Hill block patterns and adjusting the structure of arable land aspects, but also on trying to be in line with the rural development strategy and the maintenance of the natural landscape, so as to play the ecological function and the function of landscape maintenance in rural areas. From this, it is known that the modernization of land consolidation is no longer a means which is only to improve the structure of agricultural production, but seen as a rural development instrument with plural goals. Accordingly, the present study will makes use of literature analysis, case studies and depth interviews so as to make an in-depth research on those tasks which are planned to be discussed. The collection of relevant literature on domestic and rural community land consolidation includes: theories and methods on rural planning and relevant legal provisions and precedents, from which we can try to pry into the experience of promoting the development of rural areas by initiating the consolidation of rural land provided by developed countries like Germany. Moreover, after dabbling into the present functions of the land consolidation in rural communities of Taiwan and the problems encountered in the implementation process, we should also try to understand the ideas and views of local residents through the way of depth interviews and observe if the original goal and benefits are attained after the readjusted. Still, we should check the direction and problems of our consolidation systems by comparing with the regulations and principles adopted by Germany when it carried out the implementation of land consolidation and finally make a proposal for programs of future improvement for the light of relevant authorities.

This master thesis deals with the elaboration of a plan regarding collective facilities in complex land consolidation within the cadastral area of Ločenice municipality. Introductory chapters focus on the theoretical part, in which land consolidation is described as well as the scope of exploratory work, which are necessary for the elaboration of the plan and its content. The content of the practical part is the evaluation of detailed survey of the terrain in the area of interest and the subsequent proposal of particular measures according to methodology. In conclusion, the results which emerged from the plan of collective facilitiesare evaluated. The results are processed in text and graphic form.

以成長管理策略指導土地開發之研究

台灣地區數十年來隨著社會經濟的快速發展,都市計畫地區內之人口數,自民國50年以來,平均每年約以7.45%的速度增加。為了滿足日益增加的都市人口活動需求,故需不斷地在有限的都市土地資源上進行開發活動。然而,由於在規劃、組織、管制等方面的不周延,導致土地開發常缺乏計畫性指導原則,產生例如交通擁擠、環境污染、公共設施與開放空間的不足、生態環境的破壞等許多不同性質的問題,而無法真正健全都市的發展,對於都市型態與都市機能亦產生許多的負面效果。 本研究以台灣地區目前公部門常實施之市地重劃與區段徵收為例,藉由文獻資料的整理分析與問卷深入訪談的方式,探討相關的政府承辦人員及專家學者們對於上述兩種土地開發方式所產生的土地開發問題性質之看法。期以美國成長管理理念為基礎,並透過管理的規劃、組織、指導、管制四大功能的分析,提出成長管理策略與相關配合措施之建議,俾指導土地開發活動的進行得以滿足促進都市發展,健全都市機能的目標。 本研究基於上述的理念,對於市地重劃與區段徵收所產生之土地開發問題的分析,研擬適當的成長管理策略,作為政府在土地開發管理上的參考。首先在規劃方面應建立明確的土地開發原則,配合相關技術工具的實行,以指導土地開發活動的進行;在組織方面應加強各相關單位之協調整合;在管制方面則是擬定適當的管制性計畫並透過電腦技術的運用,監測與掌控土地開發的速度與都市發展、公共設施之間的配合;在指導方面則是須有效整合土地開發各相關單位之意見及解決其發生之衝突,清楚界定土地開發相關單位間的權責以達成彼此間的共識。此外,亦須加強民眾在土地開發過程中的參與機制,以爭取民眾的支持而減少土地開發所受到的阻力。 / For decades, Taiwan has experienced rapid social and economic development. Since 1961, the population has increased about 7.45 percent annually in the urban planned districts. In order to accommodate the increasing urban population and activities, it has to develop scarce land resources. However, weakness in existing planning systems, government structure, policy context, and control strategies for managing development and growth has led to many problems, such as traffic congestion, environmental pollution, public facility provision, open space deficiency, and ecological environment destruction. Those problems produce negative impacts on urban development, urban pattern, and urban firnction. Based upon the functions of management, such as planning, organizing, leading, and controlling, this study investigates the problems of urban development in Taiwan, particular in the development by urban land consolidation and zone expropriation programs. The approaches of literature review and questionnaire are adopted in order to understand deeply the problems of land development in Taiwan. Furthermore, the strategies of growth management of American experiences are discussed. Finally, some practical suggestions for land development in Taiwan are presented. This thesis explores the background of existing problems related to urban land consolidation and zone expropriation programs and develop workable growth management strategies and suggestions. First, in planning aspect, government should establish clear land development principles associated with relative technical tools to guide development which is satisfactory in timing, location, and quantity. Second, in organizing aspects, government should bring more about integration and coordination among relative institutions to yield administrative efficiency. Third, as for controlling aspects, government should develop feasible land use plans and apply the computer techniques for monitoring land development pace and service level. Fourth, in leading aspects, government should regulate the clear responsibilities among relevant institutions and resolve the possible conflicts to bring more about consensus. Finally, government should strengthen citizen participation in the land development process to win public support.

The thesis deals with the processing of exploratory work according to valid methodology in the cadastral area of Přídolí. It provides a list of all the information that is needed for further processing of land consolidation. In addition to the basic characteristics of natural and economic conditions in the area, major emphasis is put on the data acquisition and processing in the field of transport system, soil degradation, locations and state of all elements for control of soil erosion and territorial system of ecological stability, water supply conditions and landscape value. The processing of the obtained documents, field survey and territory analysis should be used to optimize the land consolidation process, especially common facilities planning.

The goal of this thesis is to draft a project documentation of the new field road reflecting water retention and accumulation within the complex land consolidation. Territory, suitable for the construction of this new field road, is located in the foothills of the Novohradské hory, about 12 km southeast of the village Trhové Sviny. The chosen location with local names "U hrušky" and "Na 22 hektarech" is located in the eastern part of the cadastral area Dlouhá Stropnice. Proposed practical solution of project documentation of side field road design category P4,0/30 completed with a suitable alternative drainage is based on the theoretical summary of the literature review in this thesis. Other objects - fall culverts and landscaping the surrounding areas are included in the conception of project proposal. An integral part and basis for making the draft was field survey and subsequent analysis of the current status of the affected area.

This diploma thesis presents a plan proposal for the common facilities in a complex land consolidation carried out in the locality of Loučky u Jihlavy in the Vysočina region. The first, theoretical part is a literature research of land treatment and the plan for common facilities including the scope of exploration work necessary for its preparation. The practical part comprises field work, its assessment and description of the cadastral area. The thesis provides a complete list of information and findings of the fieldwork with focus on measures leading to accessibility of the land parcels, anti-erosion measures, water management measures and measures to ensure climate protection. The findings are listed in both a textual and graphic form.
